RESTRICTING DEVELOPMENT ON CERTAIN PARCELS LOCATED IN TAE RICHMOND HILL/LITTLE ANNIE AREA Ordinance No. 93-� � RECITALS � 1. The Planning and Zoning Commission forwarded comments and 'ti-, recommendations on development of the Richmond Hill/Litt2e Annie . :,�; planning area to the Board of County Commissioners on June 8, 1993 . during a lunch � worksession. These recommendations cited • development pressure on this area and supported restricting _ development based on concerns of lack of adequate County services, �, ' and the lack of ability of the County to provide emergency and other services to this area at a level usually expected in connection with residential development. 2. Pitkin County S,and Use Code Section 2-24 Compatibility with Adjacent or Nearby Public Lands, states that it is the policy ' of the County to preserve and protect public lands from the impacts ` p� '', of incompatible development. �!Q, ..i ''-"�i: 3. Pitkin County Land Use Code Section 2-24.2 further states that it is the policy of the County to avoid development that will , encourage the intrusion of roads or high levels of human activity on such lands. . r 4. These provisions provide policy direction as to the -----';.� County's position on development in areas which are considered ` rural and remote. ' ~`'� 5. The Richmond Hill/Little Annie area contains character � ` and resource qualities which require protection under the � � provisions of Pitkin County Land Use Code Policy 2-24 and other ;�. Epolicies and regulations of the Land Use Code. �:`, ( 6. The Pitkin County Land Use Code does reguZate development ' in this area under the provisions of Section 5-4UO, Division Four - j Areas and Activities of Local and State Interest, and Section 6- i 3, General Submission. After extensive review of rural and remote issues by the � � Planning and 2oning Commission and the Board of County Commissioners, the Board of County Commissioners is preparing to enact comprehensive legislation in respect to this area. Ordinance No. 93-.� Page 2 NOW, THERSFORE, BE IT ORDAINED by the Soard of County Commissioners that it does hereby amend Section 3-2, AREA AND BULK REQUIREMENTS, of the Pitkin County Land Use Code by adding the `a following provisions: "Al2 parcels zoned AF-1 located in the Little Annie/Richmond Hill � area, as shown on the map titled "Board of County Commissioners Exhibit 'A', June 15, 1993", shall be restricted to a maximum development of 300 sq. ft. of above qrade floor area, inclusive of - all structures. This calculation specifically prohibits any exemptions in the calculation of square feet of floor area." 8E IT FIIRTSER ORDAINED, that this ame�dment shall not efEect those parcels within the described area which have vested Site Specific Development Plans, provided that deve2opment of these • �' parcels must conform to the provisions of the vested approval. '�i -`4 BE IT FIIRTHSR ORDAINED, that this amendment shall not effect any parcel within the described area which is located within any legally platted subdivision. :�2 �; HE IT B'IIRTHER ORDAINED, that this amendment shall not effect '; any parcel within the described area which is located adjacent to • � ;; • and served by winter maintained County roads. _�� `' HE IT FIIRTHER ORDAINED, regardless of the provisions of �j Article 7 of the Pitkin County Land Use Code, that any leqal ,� slsucture made non-conforming as a result of this Ordinance which :� is demolished or destroyed to any extent may be .restored as of � right, regardless of the extent of demolition or destruction, _ .__ -- ;; subject to the issuance of a building permit. The building permit � �' for restoration/reconstruction must be issued within one (1) year =`: '� (12 months) of the date of demolition or destruction, whichever is first. The Board may approve an extension to the one year �� deadline. The proposed building reconstruction/restoration must ' Y� conform in terms of use, number of dwelling units, configuration and area and bulk to the bui2dinq which was partly or fully `'• demolished or destroyed. The reconstruction/restoration may " include insignificant modifications to the original design if the � Planning Director finds that such modifications are necessary to . � allow the use or structure to meet basic life, health and safety � standards of the Building Code. The Board of County Commissioners. � may permit other modifications to the restoration/reconstruction of a non-conforming structure, not authorized by the Planning � . � Director, subject to the following standards: A. Buildinq Code Standards, Hardships or Improvements to Function and Appearance The applicant demonstrates that the purpose of the development � is to: I. Meet practical difficulties and hardships which arise; � or II. Improve the function and appearance of the structure or . use.
