Harris Jr. and Dorthea Bent, for 1041 and General Submission approval for a two story log structure main residence and accessory garage and artists studio in the Terilamis �Q, Subdivision approximately two miles up West Sopris Creek Road. Sassano said the issues associated with the application are � wildlife, wildfire and some minor geologic hazards. � with regard to the wildlife issue, the property is in the vicinity of the area known as the crown. And the Division of Wildlife has -- looked at the application and have indicated that because the building envelope is located on top of a flat ridge area, that it's � , �'`! been well sited to avoid the slope and shrubbed areas on either II side. And those areas are primarily used by elk and deer for • `., winter range. There is no critical habitat in the vicinity of the building envelope although there is critical habitat in the area. '' As a result, Kevin Wright has recommended that dogs be prohibited � ° and that fencing be prohibited with the exception of fencing that may be needed to keep cattle grazing on adjacent BLM land out in which case the standard DOw fencing is recommended. ICevin Wright did not identify an area outside the envelope as an area of influence, although he has recommended prohibition of dogs. �" - She knows there are portions of the crown that are considered to f � be critical and the sloped areas off the ridge are more critical, y_ � But in terms of mapping, the site is shown as normal winter range. I �l` Ethridge said this is an important issue because is was introduced �.. � last week, as part of the Hines application, and was made part or the record as a development having areas of influence. And if ' there is no information concerning this tonight it could be a � serious submission on the Board's part, given the evidence that it �� allowed to be introduced on the Hines property. ' ' 1 ' Sassano said she has no specific information regarding range of � � , influence at this time. j " � i _ � Sassano proceeded with her presentation regarding the application. . 1 She said with regard to geologic hazards, the ridge where the building envelope is located is flat with a three to five percent s grade. As the slopes drop away, there are slopes greater than I thirty percent. The applicant has mitigated that hazard by � avoiding these slopes. The access drive on the property is also pt1 located on a flat area. With regard to the wildfire hazard, the �"�I Colorado Forest Service has made their standard recommendations for . thinning of vegetation and providing defensible space. And the ij applicant has agreed to provide sprinklers within the residence and , also to use a noncombustible roof material. : . � With regard to the access road, the appliaant has agreed to comply � with the same requirements that were required of Mr. Bork's , :: , - approval. They will improve the road from Mr. Bork's property up > to their site, and pay for those improvements. G' Child pointed out, that Kevin Wright's memo addressed a single 1 � ' ,�� j story home and now what is being talked about is a two story ' � structure. � , r• ' ± sassano said what happened was when Wright was on site, the �' ' applicant represented that they planned to build a one story ranch � style house. Subsequently the applicant did some conceptual design "+': for the home and came up with a two story cabin structure. This : was discussed at the Planning and Zoning Commission and they � � '-' ' decided that they really did not think the height, given a decent � �� i design, would impact wildlife, and did not think this was a ��; i significant issue. Ethridge commented that he thinks it would be a mistake to consider this application out of sequence tonight, because of the previous testimony concerning the Hines application and the area of influence. And by approving this site, there may be consequences ; created on adjacent properties or public lands that the Board is not aware of because of the zone of influence. And he thinks this ' _ is important information that the Board needs. Tom 5tephens, representing the applicant, stated that defining the . area of influence to wildlife is going to be the best way to get � a handle on preserving wildlife characteristics. However, the ' ridgeline where this home is located does not provide any � significant winter range. There is one meadow on the site that � Wright wanted them to stay away from because he felt that activity � ;� i in that area can be seen from the surrounding areas and may affect wildlife movement. And that is why he recommended, that the home ; be located in this area, and is specifically why he wanted aIl ; activity outside of the meadow area. So without speaking with Kevin specifically on the area of influence, that is the best he can do in terms of recapping their discussion and his thoughts. � � ------- - Ethridge said he wants to see the critical habitat around the ��, �'�,�; parcel so he has a c2earer sense of what they are doing. And he =�=i thinks that is the least the Hoard should do in this case. `� Tuite opened the hearing to public comment. There being no �; � comment, he closed the public hearing. �'.. : A discussion ensued as to whether or not the application should be tabled to allow an opportunity for Board members to visit the site and the Division of Wildlife the opportunity to define the area of � „�.: • influence. 3 _� i Tuite commented that he would like the area of influence clearly ;i ` � ; defined and in written form from Kevin Wright. �(,, ' Child agreed that he would like to have the area of influence �'i��. He would prefer that the jowner of the tracts right now do what the West Sopris Creek Ranch � • has done, which is come in with a comprehensive plan for the Board to review. i Stephens responded that he would make that recommendation to Harry Terliamis. Commissioner Ethridge moved to table the application and continue ' the public hearing to February 23 pendinq a site visit. And to direct the DOA and ataff to identify the aritical habitat adjacent . With a aecond by Commiasioner Child, the motion failed , � -`� with three yea votes by Commissionera Tuite, True and Crorley and � two yea votes by Commissioners Ethridqe aad Child. ' Crowley said that staff, the DOW, and the Board have set all the criteria and the applicant has agreed to meet the recommended conditions. Therefore, he thinks this application should be - ---=--=�a approved on its own merits. �:i "�'':'j Stephens said the DOW has been up on site, and they have expressed I all the concerns that they know to express. This is the specific \ location that they wanted, based on their concerns. They have had ' j the Forest Service on site, and this is the specific location that � ! they wanted the home, based on their concerns. They have not i raised the issue of a fireplace. Although, based on their criteria � and their concerns, they said this is the spot. In terms of visual � impact, they are not within a mapped ridge line review. And when they were on site, he said very specifically, that his concern was with wildfires started by a residential use. As he put it, in the event that this house catches fire, the best the Basalt Rural Fire District is going to do, is give his clients a lift down to a hotel. As long as they knew that it was going to burn down, he is fine with it. It is the brush that he is " . concerned with. Stephens said he would say, unless he has not down - his job well, that his recommendations are hased on the faat that ! he was on site and made specific recommendations.
