This ordinance amends the existing fee structure for the County to allow for a 3/12 percent increase on those items that are mentioned. (;: ` i There are two particular fees in the ordinance that are worthy of i note. One is the addition of the land manaqement fee which was not in existence. The Board had question as to whether there was an j Amendment No. 1 impact as a result of that. It is the opinion of the County Attorney's Office and also Tom Oken that there is not an impact in adopting that fee. Under Amendment No. 1, the � limitations that exist as a result of Amendment No. 1 are in the ; �: aggregate as opposed to the specific fee that may be imposed. In • addition, it is associated with an out going cost. �-, Haughey said the second issue that has come up is whether or not the zoning fee late fee is a fee for a fine. If in fact it is a fine, it cannot be greater than $$300 however, it is set for $380 and he would suggest that the Ordinance be amended to set it back at $300. � � . - Tuite opened the hearing to public comment. Last year when �" there s ecial review ? p permit was reviewed, there were several conditions of approval that the Board wanted staff to follow � ,; through on. The two conditions she would like to talk about tonight is the revegetation work that is taking place and the ; participation between Elam and the County in that effort. She said next year the plan is to do more hydro mulch on the property to establish some more revegetation. Also, Woody Creek thihks that , Elam has been doing a great jab, and did make a note of that. She referred to memo from the Woody Creek Caucus with this regard. A i copy of this memo is made a part of this record as EXHIBIT ��8��. ' . Houben said another issue regards the reconnection of the County Rio Grande Trail. When the new road was put in place up to the Elam Gravel Pit, the road cut was made through the trail. Therefore, the trail has to be realigned, and that is the responsibility of the County. Staff is working with Elam to try to reestablish that trail. ! Ethridge referred to the width of the trail. He said he thinks it ' �,�F. i would be more appropriate that the trail conform to the standards � `�. 1 that are being developed by the Open Space and Trails Committee. � I Bill Aerosmith stated, that they are willing to participate in the trail. What he is concerned about is safety. Also, because they don't know what is being constructed at this time, they don't know what their participation will be. -- --"a Tuite opened the hearing to public comment.
