Tricia McKenzie appeared before the Board to request that Commission members reconsider other options regarding their home • , in East Owl Creek. A copy of McKenzie's written presentation is • made a part of this record as BSHIHIT ��A��. Several members of the public spoke on the McKenzie�s behalf to j encourage Commission members to reconsider the options. Also, j several people requested that a summary of the events regarding this matter be made available to them for review prior to the July 27th meeting. 4�h� True commented that the Board made a fair and just offer and tried � to correct and did the best they could, by adjusting the resale i price, they have loaned the McKenzie and Dinmoor money. Ae noted that they have adjusted all the homeowner's in the project not just McKenzie. Everyone there was given an equal opportunity to accept , j an offer of five options. However, McKenzie and Dinsmoor are `. rejecting all of those five options. =.` Tuite stated, that he thinks the County does owe it to the ?'^'"'- community to give the facts as the Board has seen them. He asked staff to put that together for anyone wishing to review the history ,� of the matter. � � McKenzie asked the Board if they would grant an extension of time � to allow them the opportunity to compile the figures involved in �V i certain aspects of construction of their home. � ' I ! � Tuite asked Ms. McKenzie to get the figures together and submit �;; � them to Tom Baker of the Housing Authority and then he will get in i touch with Baker. ' - Child said the reason for making the motion is that he feels there are two sides to the equation. One being the desire to respond to the Woody Creek Caucus and their land use planning effort there. i Two there was talk about moving Aspen Earthmoving to the dump site, but he does not think there was enough time spent talking about � whether it was realistic to expect that they could be accommodated � them at a reasonable rational timeframe. Silvia Davis, County Clerk and Recorder, commented that between `� first and second reading, one change has been made to the j resolution to read that the Board of County Commissioner's request � that the November 2, 1993 election be conducted by mail ballot. � � `; Tuite opened the hearing to public comment. Jim Crowley and Les Oakes appeared on behalf of the Brush Creek , � Water District to express a concern with regard to a mail ballot � election. Crowley said they have some problems £rom an ' � ! administrative point of view. He said in a special district � election people wha are qualified to vote are those how own j property in the district and live in the State of Colorado whether . � or not they live in the district and or otherwise registered to ' � vote, and people who are registered to vote and live in the district. They are not certain whether the Cler)c's office can make i sure that all those people who own property within the district but i live out of the district but within the State o£ Colorado get ballots. Also, they are concerned about people being able to vote on the question who are not qualified to vote on the question. f y Davis assured Mr. Crowley and Mr. Oakes that with regard to �`�a, ? everyone getting a ballot, she is required to use the Assessor's 1 list in addition to their registration list. With regard to the 3 question if someone moves, when a ballot comes back it is checked to make sure that a21 the information is current with their voter � registration records, if it does not agree, the ballot would not be counted. He noted that this unit was illegally converted in 1976 and the applicant � subsequently purchased the property and would like to legaZize it via this procedure. ' Malloy said an issue that was brought up in the review by the � ' '' zoning office was that there was a question regarding an illegal � lot split. He referred to a plat depicting a line separating � =� parcels A and B. He said he has discussed this matter with the r county attorney, and he has determined that this is one legal lot � for puzposes of development. Also, it is the applicant's � understanding that it is one lot and the line is in error and should be removed as a result of this proposal. � Malloy referred to a referral comment from the Environmental Health I Department that the sewage disposal system permit needs to be amended to indicate the existence of the caretaker dwelling unit. � Carol Farino advised Mr. Malloy that there is not an individual septic system on the property; that they are hooked up to the City � sewer system. Malloy continued that the application does meet all the applicable � sections of the code for caretaker units. Staff is recommendinq _ �#� ' approval of the proposed caretaker dewelling unit subject to • conditions shown in the resolution. ! Tuite opened the hearing to public comment. There being no comment, he closed the public hearing. He said the plans for a house in excess of 15,00o square feet were submitted to the building and rejected by the building department and the zoning office because they exceeded 15,000 square feet. The applicants subsequently had meetings with the zoning oEfice, and decided what areas would be �: removed to bring the house into compliance and a building permit i: was issued for a structure of 15,000 square feet. The applicants I. are now back requesting approval to add back those areas which were � eliminated. He pointed out that many of the proposed additions are i below grade or internal and have a limited impact. He proceeded � �!, to review the drawings with showing the existing and the proposed additions requested with commission members. � Malloy said the applicant has provided a landscaping plan which � shows screening in the form of berms and plantings screening it r t from Lots 9 and io. A2so, they have brought with them tonight a � gentleman that has done computer simulation showing the view from I Lots 8, 9 and l0. Also, no lighting plan has been formalized , I although the applicant has indicated that there will be landscaping lighting ahd safety lighting on the path to the front entry, etc. However, there is no clear picture in terms of what they are proposing for lighting, and he thinks lighting is going to be a really important issue on the structure because it is visible from } town, and the lighting needs to be very carefully controlled in I order to minimize impacts with respect to that. Therefore, staff is requiring that the applicant come back through the planning office with their lighting plan so they can have a chance to review �:5� the quality of that lighting. The Board needs to determine if they : feel comfortable with staff looking at that or they want to review it themselves. Malloy summarized that if approval is granted to the applicant, _ they shall be required to go back to the building department with any change order to accommodate the changes that show up on the ` " plans. And in addition to that, they go throuqh the Board of Adjustment for the height variance. Staff is recommending approval ^`'� with the conditions as outlined in the resolution. • ,�� Pat McCallister, representing the applicant, asked if the Board would be more comfortable tabling the matter to allaw them the opportunity to provide a landscaping and a lighting plan? Y� '�� Linda Marcus, a homeowner on West Buttermilk Road, spoke against any home larger than 15,00o square feet as a precedent. Also, she said Mrs. Fifield called her and advised her that if this application is not approved, that they could still build a garage somewhere else and she does not feel this is the issue. But rather the issue is how much building is going to go up there not how many outbuildings they can add if they don't get this approval. :; ` Suzanne Konchan commented that all the exempted garage space that . "• they would be entitled to under the calculations of FAR have been �;� used up so additional outbuildings would be calculated as part of � �' FAR and subject to the regulations. T i A principal owner of Lot 9 and lo, and representative of the Eagle � Pines Homeowners' Association commented that the only real concern they have is with respect to the visual impact to Lot 9 by the roadway. However, he thinks the appropriate landscaping would ' mitigate the impact. ! Steve Hansen spoke to the landscaping issue. He said they would • � be putting in large mature trees and be very sensitive to the neiqhborhood. Tuite closed the public hearing. Malloy commented that he feels very confident working with the applicant in reviewing the landscaping plan and decipher whether or not that plan would accomplish the type of screening that is - �� depicted in the simulation. _ty Ethridqe moved a condition that the applicant and planning ataff � work toqether to develop a landscape plan of suffioient detail to provide the screeninq shown on the computer simulations presented to the Board of County Commissioners tonight. And ia the event � that was unsuccessful, that the plan be brouqht back to the Board :.__ --`:_:j for final determination. Commissioner Child, aeconded the motion. , ,��:� Konchan commented that the landscaping plan is already addressed � in Condition 3 so as to comply with the motion, staff will `� additional language addressing computer simulations. . Ethridqe amended his motion to add the aentence which vould add the consistency of the computer simulation ahown to the Board. Child accepted this to his second. The motion passed unanimously. . I A discussion ensued with regard to the lighting plan. �< ! Ethridge suggested that in context of this special review, the �. intent of the condition was for safety for pedestrians; lighting � � sufficient to allow access for pedestrians and turning movements for automobiles. Francis Krizmanich, representing the Planning Office, summarized this item as an application, submitted by Aspen Highlands skiing Corporation to replace four lifts with two lifts. The plan is to �', remove Exhibition 2 and Grand Prix Poma and replace it with a new � exhibition lift which would be a detachable quad chair and the second part is to remove the two upper lifts, Cloud 9 and the Olympic Lift and replace that with a Cloud 9 express. The application was continued at the Planning and Zoning Commission � " level to allow the applicant an opportunity to address staff's concerns with regard to mitigation of traffic impacts, noise, air quality, revegetation and visual impacts. In response to the ' concerns expressed by staff, the applicant submitted a revised plan t which was reviewed by the P&Z on June 8th. He proceeded to review vj the applicant's revised application which proposes Phase 1 for this i year, put in the new upper lift and hold off on the lower lift until next year. And as a part of impact mitigation, they agreed • _ I to run some bus service through Aspen neighborhoods and to local � lodges. Likewise, they have offered to run some of the lifts later � in the day to offset the peak time, planning to improve the base , � area circulation parking, and enforcement of no parking along Maroon Creek Road. I ( Krizmanich commented that given the applicant's proposal, staff 1 feels very confident that replacing only the upper lift will not - ��, � have the great utilization impact that they are concerned about. ��. � Also, staff feels it will be a good experiment to find out what i kind of utilization increases there will be which might help them ` further along with the entire mountain master plan; to gain some � understandings of the workings of Highlands. Staff is not so comfortable, however, in approving Phase 2, which is proposed for next summer because there is not a traffic analysis to go with the -----..1� project or the state implementation plan for PM10. Highlands has indicated that they plan to submit a master plan and this year and feel it would be most appropriate for the second phase of this � program to be included in the master plan where all the activities � i �., could be viewed in a comprehensive fashion. From a wildlife standpoint, Kevin Wright has asked for low profile homes however, he is not in the business of saying how high a low profile home is. Staff and the P&Z went with 22 feet with the thinking that they could probably sink one floor partially below grade. The reason for the size restrictions again are for limiting potential disturbance on the property. The -- =- - applicant has not had any designs done to the point, but these are _ parameters that they can design within, if this proposal is to move �.4� forward. And she thinks these are very important elements that the • Planning Cammission in consideration of. •� i � , Guy commented that from an architectural standpoint, the visual impacts of the house has a lot more to do with its design then some t� arbitrary number like 22 feet or an arbitrary number of 7500 square � feet. It is how it fits and blends in with the land. Ethridge commented that Highway 133 is a scenic highway and the issue to him is not just the homes, it is the extent that the road network that is going to be necessary to serve those residences which will be highly visible, and that is a major concern to him. � �i He thinks the wiZdliFe concerns is evident and can be better - mitigated. And he is very cohcerned about the unwillingness at � .'.' this point to agree to a house size restriction, both in terms of �w square footage and height, and most of the letters in opposition � of this development had to do with development on the east side of 3 the Crystal River and he shares that concern. Therefore, he cannot � support this application, but will support further planning to try r � and minimize the impacts., but this development is not ready for approval as far as he is concerned, based on the scenic impacts, wildlife concerns and the uncertainty about the size restrictions on the homes. Guy pointed out that the road network is basically the existing road that is there now. It is only the driveway to the site on A that is a new construction on the landscape. � Tuite commented that if that was put into a motion he would second it. He thinks a better job could have been done of clustering. He is not saying that he will deny this many units, but he agrees � �� that the size of the units are critical and riqht now, he is not comfortable with the site locations as presented in the proposal. Guy reiterated that they have investigated some dozen sites on the property, and every time they look at a different site, they have already looked at it and there are reasons why it can't be used. They have been through this numerous times to get to the preferred -----,',�;�`` sites, that these are the four sites that are the least impactive _ that can be found on the site. I measured the sound oE the cars at � the nearest neighbor's property line in order to use the. more ; ;• restrictive residential zone decibel limit of 55 dB(A) (during the ' pt - day). The sound from the cars was indecipherable from the ambient #��r� sounds in the area, which were created by birds and movinq vehicZes on McClain Flats and Highway 82. The special review provisions are - found in Section 3-6. � � The letter from Sunny Vann to Mary Lackner dated April 27, 1993, which requests this status determination, makes clear that the proposal involves changes, alterations, repairs, extensions, and restoration. In describing the proposed use, the request refers to "changes proposed for the property," construction, landscaping, clean-up, and extension of the use by the installation � of "a fleet of race cars" not currently present on the property. ( The request also describes the proposal for remodelinq of existing � structures and storage of race cars on the property which does not : , � currently occur. Finally, there is now no sports car club operating the property as a racetrack for members and quests, and this is a significant change from current operations and activities. At most, there have been one or two race events per year on the property during the last twenty years. The proposal involves a significant extension of that use, i.e., reqular and . constant use by club members. It is clear from this description of � the proposed use that special review approval is required pursuant � 5'c.. to Section 3-6.1 of the Pitkin County Land Use Code, because ' '�'�. chanqes, alterations, repairs, etc., as specified in Section 7- 1.1(a), are proposed for the property. k � 2. DISCONTINUANCE OF USE. Section 7-1.1(a) also provides that a use which is deemed to _.—__._..�;'-:: have apecial review approval may not be "resumed after ` discontinuance" unless further special review approval is obtained. Discontinuance is defined in Section 7-1.8 to mean discontinuance for a period of one year. These code provisions must be considered �� in the context of the allegedly "grandfathered" use of the � property, i.e., as a racetrack. We believe that the burden of � proof is upon the applicant to demonstrate that the property has been continuously used as a racetrack from 1977 to the present. ! The fact that other uses have continuously occurred on the property ' � is irrelevant to the fundamental question of whether this use is a � � use which has been discontinued for a period of one year from that �;•. date to the present. In our view, the information submitted by the � applicant is insufficient for you to conclude that the property has =� been continuously used as a racetrack. HIGEi IMPACT USE. �. , The "qrandfather" provision of Section 7-1.1(a) does not apply . to a "high impact use." Such high impact uses may not be continued without special review approval. A high i.mpact use is defined, in Section 7-1.1(b) to include "any other such heavy business, commercial and industrial use that is the source of significant cinders; dust; noxious fumes; smoke; noise; air or visual pollution, or the like, any of which is detrimental, a nuisance and injurious to the general welfare or to adjacent lands and uses." • , We believe that the intent of this definition of "high impact use," � - ; is to require a proposed activity such as the racetrack to be f considered in accordance with the special review provisions of the � code because of its substantial i.mpact on the surrounding community. While the applicant may arque that this is not a � "business" or "commercial" use and therefore not a high impact use, r we believe that this argwnent is incorrect and also elevates form . � over substance. Even though the racetrack will be operated as a � non-profit corporation, it is nevertheless a business. In t;��ti € addition, since the proposal includes provisions for additional use � by non-members, including other sports car clubs, driving schools, j and the Aspen Police and Pitkin County Sheriff's Department, we believe that the proposed activity falls within the meaning and � intent of the terms "business" and "commercial" as used in � � Section 7-1.1(bj. Therefore, it is a high impact use subject to __ e.� special review approval. �-:,,i At this point the issue before you is not whether the proposed jracetrack use should be approved or denied, but simply whether it � should be subject to special review. I first attended a PCA event at the track in 1972, but other PCA events were held there well before that, at least as early as 1967. The track was also used extensively by SCCA during the �a 1960s, 1970s, and 1980s. It was rented to individuals for S``�t�, 1 testing, instruction, and practice, one of these being Dick Reventlow, brother of Lance, son of Barbara Hutton. Dick lived j in Aspen in the 1970's and drove Porsches on the track. Our '� J three-day weekends in the middle of the long, hot summer must � have benefitted the hotels and restaurants of Aspen, too! ` < _ _�.�.� As a member of PCA and a motorsports enthusiast, I applaud you p ;���:� for your efforts to prese=ve and improve the facility, which has � ..•"`� over the past 30 years become a part of Aspen's history. ' . The racetrack has been operating for as long as I've been here (1979), and in my opinion is a unique feature of this community which certainly helps differentiate us from other resorts. Over the years, many groups using the track have stayed in our condos and hotel rooms, providing welcome bueiness during the summer months. ��� As long as the people who uae the track are abiding by the law, �noise,hours,etc..) there is no season to restrict its use. Elk utilize the oakbrush � . hillsi8e along the east side•of the pi^operty and trave2 down the _ :__� ridge to the wet meadow and south meadow. The hot springs located in the south meadow attracts elk in the winter due to less snowpack and available grazing. �\ This development will have negative impacts to elk and bighorn . sheep. Impacts will include but are not limited to direct habitat loss, displacement, loss of winter forage, and stress. It is ! � • difficult to select hamesites which will minimize impacts to both species. In order to minimize impacts to bighorn sheep, elk will . be more adversely impacted and viae versa. Since bighorn sheep are more sensitive to disturbance and stress, homesites should be ' selected to minimize impacts to bighorn sheep. On February 26, 1993 I met with Marty Pickett regarding the Tak�eguache Ranch and the new proposed homesite for the main house y (Tract A). The weather was bad so we discussed the homesite and - Ms. P.ickett provided me with an aerial photo of the new proposed . site. On 3/16/93 I inspected the new site. ' _ ' I still believe wildlife impacts (mainly to biqhorn sheep and elkj � would be minimized by maintaining the homesite where it was last � . reviewed; which is tucked up .to the edge of the oakbrush and � � meadow. The oakbreish and hillside above the homesite show heavy . € use by e].k and the oakbrush will help buffer the homesite with the � hillside. This oakbrush becomes more important in heavy winters � for forage area (browsing) whereas the meadow is covered with snow � � and offers little forage value. All the trails lead through the 4`,�� upper meadow to the lower wet meadow for foragirig activity. The development is in the center of the wintering grounds for a herd of over 100 elk. These are histozic wintering < grounds. The Avalanche creek Big Horn Sheep herd can be observed � a21 most daily during the winter ar�d spring months on the railroad grade within the development. What happens to these , animals? We feel all development in this area should be denied. • I am sure pou have received an impact study from the divison of wildiife. Development shauld be confined to the west side of the Crystal River. Filoha Meadows has been very sensitive to human impact in adjacent land. The same standard should be maintained for the Grange property. How long will we tolerate the weaZthy of the nation constracting . �� , their second, third, and fourth homes within the pristine valleys ,;.�, of our county? We expect the wealthy big guys to held to the isame tight standards the county imposes on the little people. I am a property owner who resides in my house above Redstone. I have observed wildlife in the Hot Springs Ranch area and Avalanche Creek for the 10 years I have lived here - as well as 5 years before moving here when �I lived in Glenwood and New . Castle. � I am opposed to subdivision of this property especially if it � involves houses being built on the east side of the river because of the wildlife. I don't feel it's right to deny property owners the opportunity to live on their properCy, but there is.an existinq house on this property which is located away from the area used by � •r wildlife. Just because the house is not luxurious enough is not • reason to divide the property. I've heard they really aren't interested in having 4 properties, but felt if they started there, they could negotiate to one house at least on the east side of the � • river.
