He clarified that due to the seasonal changes, there will be no �s� operation after dark. With regard to annual reviews, they thinks it is important, particularly in the initial years, to have the ability to address �,�� the county commissioners as to whether or not, the limitations in '�"��- '�1 the operating plan are adequate and are being complied with. � ;;� .,,ft�: ;� With regard to the hours of operation, they thir►k there needs to . . ; be some limitations place on the days of operation. Their inifiial proposal to the applicant was that the 23 days of racing of � scheduled events and the 13 days of Friday afternoon training in ''-� • } the operation p2an was acceptable, the 13 days of Friday afternoon .` training would be okay. Beyond that, with respect to club �?�� activities, they have proposed a couple of alternative scenarios. "�••' � One was to allow racing on alternate days during the week as " � opposed to the weekends with hours of operation of ten to six. a Another possibility was allowinq it to occur everyday Monday thru Friday but having limited hours of operation of ten to three or four. � Grafton Smith appeared before the Board to encourage approval of the continued operation of the race track. However he would like to see some sort of flexibility to a12ow the applicant the ability --- to deal with outside requests for use of the track especially for '� education or public service uses. ,! Vann responded to Mr. Grafton's comment, they will continue to try � � and accommodate the driver's traininq programs ahd other uses by `� � , the police and sheriff's departments. � � � With respect to an annual review, he thinks it is reasonable to - come back after the first year and see what they are doing. Tract A not only has the conflict with i the elk habitat, but in their opinion, has substantial geoloqic hazards as discussed in pages two throuqh four of Mary Lackner's � . memorandum. At that time, one of the larger parcels was conveyed as two, 35+ � acre parcels to result in the existing four, 35+ acre parcels. ' �� i �' The 1041 Hazard Review and General Submission Application �;-� was submitte@ to the County on April 2, 1992. Sinae that date, r.,�!t the Applicants have employed planning consultants and had various '`� •' site visits and meetings with referral agencies, including the ' Division of Wildlife, State Forest Service, State Geologic ; Department, representatives of the Ute Indian Tribe, the Crystal � River Alliance, the Crystal Environmental Protection Association, � � Inc,, and Carbondale Fire District, to understand and attempt to � ! meet and satisfy everyone�s recommendations and concerns. Over ' � the last two years of this intensive planning process, the �;; . Greenwald family has collectively spent approximately $100,000 on --- consultinq fees and costs, legal fees, and fees charged by the . At this time, three of the homesites, although one is � separated by the Crystal River, are located within a relativeiy . ii , small radius of a few acres within the 145+ acre develop�ent. �' - The Tract A site has been placed in an area closest to or within the brush to minimize its impact to the elk and to preserve the wet, grassy meadow by the river for elk grazing. Note that Kevin Wright of the Division of WildYife has consistently stated that i he is less concerned about the potential impact to the elk (Site �;;... A) than to the sheep. Althouqh the sites have proposed caretaker `� w i units, the Site A caretaker unit would be the unit currently , , . existing on the west side of the river, which would act as a small ranch manager�s unit for the entire four lot development. The Applicants recognize that there are overlapping and sometimes conflicting concerns on behalf of various referral �`; agencies. We understand that wildlife appears to be the County�s ' � greatest concern. However, it is our position that the Applica- tion's site plan, as well as the revised site plan, adequately "-- mitigated all 1041 hazards. Kevin Wright began his presentation t. at the July 13 hearing by stating that he believed all four sites ',j, adequately mitigated all wildlife concerns. ;, .`, I Therefore, we respectfully request approval of this j consolidated application in its current form, including the � � ! latest revision as recommended by P&Z (attached hereto as Exhibit i "A"). In the event this Application is denied, the Applicants , will be forced to consider all of their alternatives, one of ,- which will be to bring individual applications to the County for ' each originally configured lot. Recent "� , ; activity on the fan has been restricted to the southernmost <,�.� • j portion of the property but the potential is there for flows ? � in other parts of the fan. These lower sites have some � I measure of protection frora the waning stages of a #low by the � I new road (along the old railroad bed) which will intercept �' . material in its borrow ditch. Positive landscaping behind all these sites is recommended, and, site specific soils �;i�; investigations will be necessary, especially since ;:�� . ' hydrocompactive soils may be present. . The upper site should have a berm behind it at least six feet in vertical relief to deflect flows around the sites, and one � � foat higher if the alternative upper site is approved. The primary hazards which Mr. Lampiris has requested �s'<�:` .:r.:<:: •: mitigation are: 1) the potential debris flow affecting all the a homesites on the east side of the river, but more stringent .Y:;:..�_,�. - mitigation is required for homesite A; 2) potential seismic fault '';.:,�_ activity on all parcels; and, 3) rerouting the irrigation ditch � + wh�ch lies above homes3tes C and D. � ,,, ,;> - s€ • Mr. Lampiris� comments regarding the potential debris flow, � �. including the need for a six or seven foot berm in addition to a �°± � rear foundation wall constructed to withstand a minimum of 200 �ij pounds per square Poot, raises concern with staff that development ;��A should not take place in this location. County Engineer Bud Eylar �� indicated at the Development Review Committee meeting that homesites should be relocated to avoid this hazard. However, �',i� �': .
