-;�', Suzanne Konchan, Planning Director, commented that she presented
the Commissioner with two documents. One is a emergency ordinance
�` 4 to the Land Use Code restricting development on certain parcels in
�. � the Richmond Hill and Little Annie area to a total of 300 square
� feet of floor area inclusive of all structures. She added a
� provision that the calculations would prohibit exemptions from the
� calculation of floor area, except for below grade spaces. The
reason she did that is because under the application of the Land
. Use Code for example, 750 square feet of garage space is exempted �„
from floor area. And so to insure that all above ground spaces
counted in this restriction, she included that more specific �C•
language so it was clear. At the advise and her discussions with "
� Tim Whitsitt, the Board can have first reading on an emergency
ordinat�ce tonight. Staff will publish a notice in the daily for
second reading on June 15 next Tuesday evening at the regular R

� Konchan noted that the second portion of this is a resolution that
the Board could consider for first reading this evening that needs
to be published for a 30 day notice, that would restrict the
� acceptance and processing of either land use applications or
building permits in the same geographic area for a period of six
months. Among the situations in both of these documents, is the
' fact that we do have a policy in the existing code that seeks to
protect remote parcels and its titled compatibility with adjacent
� or nearby public lands where it seeks to preserve and protect
public lands from impacts of incompatible development. She further
i stated on the sixth situation, that there has been extensive review .
� of rural and remote issues by both the Planning and 2oning
Commission and the Board of County Commissioners. And that the
r Soard is preparing to enact comprehensive legislation with respect
to this area. And that the processing of applications in this
interim period would compromise the effectiveness of this effort
, to lay specifications for why we are doing this in this manner.
She pointed out that under the emergency ordinance, she has
included a be it further ordained provision that calls far this to
sunset in two months. Her recommendation to the Board would be at
second reading of the resolution that restricts the acceptance of
applications, the Board would appeal the emergency ordinance
because it would no longer be in effect. She presumes that will
� happen in about five weeks because of the noticing requirements to
3'i�� meet the 30 day. She has included the two months just to make sure
that if there is any glitches that it is covered.
John Ely commented that the official paper of record is the Aspen
Times Weekly not the Daily News so that miqht affect the time
� period.

� Cindy Houben presented the proposed maps of the Richmond and Little
-- Annie area that are to be incorporated in this proposed
�� legislation.

Tuite asked if was staff's recommendation that the mining claims
on the face of Ajax be included at this time?
Houben responded that there is not real good information on some
� of those, but the Board may consider them in the geographic area.
John Ely commented that although the Board may want to extend the
� � area to make it as all encompassing as possible now, he thinks the
. most logical way to do this is to follow what it has been studying
and recommending up to this point, and not reach too far beyond
that, if at all.

Commisaioner Ethridqe moved approval of firat readinq and aet for
aecond reading on June 15, an Emerqency Ordinance Restrictinq
Development on Certain Parcels Located in the Riahmond Hill/Little
i Annie area. Commissioner Child aeconded the motion.
Ethridga moved aa amendmeat to the text, to reatrict maximum
development to 300 aquare feet of above qrade fioor area only
� inclusive of all atruatures. liith a second by Commissioner Tuite,
tbe moYion passed �►ith tLree yea votes by Commisaioners Tuite,
Child and Ethridqe.

Tuite commented that these area emergency resolutions, they did not
� want to do this; they have been studying rural and remote areas for
several months now and they had hoped that they wouldn't see a lot
of action on this that they be given time to prepare a reasonable
----� --- zoning for this area, and we think we need this moratorium to give -
��'��.;��.. us the time necessary to plan this in the proper way.
