Jeffrey Evans, appeared before the Board to talk about petitions
} �'f�`-
which they have been circulating. He said there are two �.k,�:
, initiatives, one is to enable housing sales tax and the other is
to enable revenue bonds to be issued against it. He said basically
what he did was to mirror the Board's proposal as it stood last
Monday. The major exception being, they pulled out the use tax and �'
then all of the money would be used for highway construction. A
copy of his proposal is made a part of this record as EXHIBIT ��A��. ;�;i-

Evans said he essentially said to the voters that they were trying . .
_ to get a ballot initiative on the ballot in November, which
essentially says, that if there is going to be a half cent sales
tax, the money should be used for highway construction to speed up
the completion of highway 82. in most of the cases that was all S.
he had to say and he got a signature, He said the purpose for ;
appearing before the Board at this time is, that they think it
would be far more advar►tageous for the public and for the Soard too
if this could be on the same eYection so that people have the
"-- opportnnity to compare the two and doing it one election rather ��
than having a special election some two or three weeks aFter the ��,t.
election that is already scheduled.

�� ; True commented that he thinks there is a problem with this because ,
! of a limitation on the half cents the Board is proposing for use •
as mass transit.

Tom Oken commented that he sees two potential problems with it.
He said the ability to increase the county sales tax by one half
cent specifically puts it over the general seven percent ��.��
limitation. And that authority is only granted for a half cent to `"`'
! be used for mass transportation 3ssues; there is not a general �.r,
� j ability for the county to increase sales tax by a half cent. ` ' � �=

a highway carrying 23,000 cars a day is unquestionable mass :`i::-�

A discussion ensued between Evans and commission members regarding i:.
this interpretation. ,...:�,.

Oken commented that there is specific statute that says regardless ��.`�
of the seven percent limitation that can be exceeded for a half ,i�> "
cent county wide sales tax for the purpose of supporting mass ,j ��
transportation. So that just raises the question is four-laning �a
a highway mass transportation purposes, and that would be the f�
issue. �'�'

Evans responded that he cannot see how it's an issue. If you have
a two-lane highway and expanding it to four and one of the lanes .,,,�t
is going to be an HOV lane, that lane is a mass transit lane. He S'
said there is not conflict here whatsoever.
`� Ethridge commented that it is his feeling that elected officials �•
should stay out of citizen initiatives. First of all the input is
not understood and not appreciated; that has been the history on �;.'�
this issue. He said a citizen initiate is there to do this, but .�,
for the Board to do anything, including put it on the ballot as an .
alternative to the work that it has put he thinks would be a
- mistake.
Tuite said he does not have a problem discussing it because he �
thinks it needs clarification. s
Reid Haughey, County Manager, said the legislature was specific in ,' . .
creating a half cent funding source for mass transit. And there tiF
are a variety funding sources for roads. His concern would be that •
if the agreement between Snowmass, Aspen and Pitkin County is on q,
the .expenditure of these funds, by agreement of this Soard, that
is where the limitation on their uses occurs. He said it seems �+
`� that everyone may be heading a debate that is not necessary, tryinq
� to establish it within the legislation when there are contradictory
views on what that money can be used for. He said he feels as
strongly as Mr. Evans on the other side, that this was not money
that was intended for pavement but a source to be set up to
specifically supporting mass transit.
