� �_,j WHEREAS, the United Bank of Cherry Creek (hereinafter

� "Applicant") is the holder of a deed of trust for a parcel of ;

-'� land described as that part of Lot 2 Aspen Racquet Club Subdi- �

•:i vision Filing Number 2 which lies southerZy and easterly of the
;� -
.� roadway identi£ied as Club House Drive all according to the plat `��
�vy _ _
i:^� recorded in Plat Book 15 at page 61 in the records of Pitkin <i
�'� County; and
" � WHnREAS, the applicant is seeking to subdivide the existing
.,,� -
:�:� single-family residence which is loeated on the subject parcel in
.,� accordance with Section 4-2.2{a) (6} of the Land Use Code which
.� creates a subdivision exemption for fully developed lands; and �
�±� WHEREAS, it was determined by the Board of County Commis-
:;� sioners (hereinafter "Board") that the Aspen Racquet Club
Subdivision constitutes fully developed lands because the
- existing tennis club and house on the parcel exceed the permitted
maximum floor area by over, 200 (two hundred) percent; and �
`� WF�REAS, the Soard considered the application at their ; ��
- .regular public meeting on January ii, 1988. �
NOW, THEREiTORE, BE IT RESOLVED by the Board that it does
