WHEREAS, the Pitkin County West Buttermilk General �
Improvement District (the ��District") , in the County of Pitkin
{the "County��) and State of Colorado (the "State"), is a quasi- '
municipal subdivision of the State and a body corporate with the '
��+� limited proprietary powers set forth in Part 5, Article 20,
- Title 30, Colorado Revised Statutes, as amended, being duly
...,`� organized as a public improvemerit district pursuant to Resolution
No. 98-,� of the county; and
'A-"`� WHEREA3, the Board of County Commissioners of the County
is ex-officio the Board of Directars of the District
(the "Board�'} ; the Chairman of the County is ex-o£ficio the
Chairman and President o£ the District; and the County Clerk and
Recorder of the County is ex-officio the Secretary of the
: District; and
'�-��,� WHEREAS, the Board has the power and authority to Ievy
and collect ad valorem taxes on and against all taxable property
-'�~� within the District by certifying annually to the Board of County
Commissioners of the County the levy or rate fixed; and
WHEREAS, the interest of the District and the public
interest and necessity demand and require the acquisition,
�:� construction, installation and completion of a11 or a portion of � -z
,^� the following street improvements: curbs, gutters, culverts and
- other drainage facilities, paving, lighting, traffic and safety
`-� controls and devices, grading and other street and safety
protection improvements, together with all necessary, incidental, ;(;.

WHEREAS, the District has never before held any election
on the question of contracting any bonded indebtedness for any
purpose or in any amount; and ,
WHEREAS, the Board now deeras it necessary and desirable
that a resolution be adopted declaring the public interest and
necessity for the Pzoject and calling an election of the issuance k-�
of the general obligation bonds of the District therefor. �'•

', NOW, THEREFORE, BE IT RESOLVED HY THE BOARD OF DIRECTORS �_
� OF THE PITKIN COUNTX WEST BUTTERMILK GENERAL IMPROVEMENT DISTRICT,
IN THE COUNTY OF PITKIN AND STATE OF COLORADO:
Section 1. All action heretofore taken (not
inconsistent with the pravisions of this Resolution) by the �°
District and the officers thereof, directed towards the Project #l,. '
� and the objects and purposes hereinabove stated and the issuance t�'i.
;� of the District's bonds for such purposes be, and the same hereby � � .
(.� is, ratified, approved and confirmed. i. .
Section 2. The Hoard has determined, and hereby �
3 determines that the interest of the Distr3ct and the public
� interest and necessity demand the provision for and the '
acquisition, constzuction, installation, and completion af the i
improvements, facilities, equipment, and properties herein
':� described in order to carry out the objects and purposes of the
District and require the creation of a general obligation
.,� indebtedness.

; Section 3. The objects and purposes for which the �
� indebtedness is proposed to be incurred are to provide funds for
c3efraying, in whole or in part, the cost of acquiring,
�.`� constructing, installing or completing curbs, gutters, culverts
and other drainage facilities, paving, lighting, traffic and
;;� safety controls and devices, qrading and other street and safety
protection improvements, together with all necessary, incidental,
and appurtenant facilities, improvements, land, and easements,
for the District and its inhabitants. The total estimated costs
= of such works and improvements, including all costs incidental to
;?;; the authorization and issuance of the bonds, will not exceed

' Section 4. The total aggregate amount of the principal
of the indebtedness to be incurred for the Project pursuant to
� this Resolution sha21 not exceed the sum of $375,000, with the
bonds to be issued from time to time, and the maximum net � ;

/� eleven pexcent (11�) per annum. As provided by Section Gt�

Section 5. A special bond election of the electors of
the District (the "election") shall be held within the boundaries •
of the District on Tuesday, June 28, 1988, between the hours of
7:00 a.m. and 7:00 p.m. of said day, at which election there

part 5 of article 20 of title 30, Colorado Revised Statutes, as

Section 13. One oP the judges of election shall keep a
poll book which shall contain the name and address of each
elector voting which shall be entered in regular succession under
the appropriate heading in the po12 book. Inmediately aPter the .
closing of the polls, the judges shall open the ballot box and .
proceed to count the votes cast by paper ballot and shall
continue to count without adjournment until finished. As soon as
all of the votes shall have been counted, the judges sha11 *"=�'�' �

promptly coraplete the certificate of returns provided by the :;
Secretary, stating the number of votes cast, the number of excess �`�'':;
ballots, tne nwaber of unused ballots, and the number oF votes ��'
for and against said question submitted and shall promptly If

certificate of returns shall be posted in a conspicuous place on
the outside of the polling place. All of the election materials

I the Board, following the date of such election. Immediately upon �

Absentee voting will be permitted for the election in
the manner prescribed by law. Request for an application for an
absent voter's ballot may be made orally or in writing. An

i day of said election (or otherwise stating the reasons provided by
