'" WHEI2EAS, the Board considered the proposed Code Amendment at �

'; a duly noticed public hearing on March 29, April 12 and April 26, ..

i; NOW, Tffi?REFORE, BE IT RESOLVED by the Board that it does
j '
,� hereby adopt amendments to Title II, Pitkin County Code, by -:t
�; repealinq and re-enacting the following sections of the Land Use .� �
Code as follows:

Section 5-503.3 (d) Time of Permit �„��

; The Board may issue an initial, short-term trial permit Por a � . �;
• time period not to exceed five years from the date of issuance.
'. Prior to the expiration of the initial, short-term permit but not , .
j longer than 1 year before such permit expiration, the � !��
operatorjpermittee may submit an application in accordance with �;ti=�;-�.�
Section 5-303.1 to convert the short-term permit to a iong-term �
permit. Upon application, the Board shall consider the degree to �"� ',•,:
which the operator/permittee has complied with all of the terms � f ,

and special conditions oE the initial, short-term permit,
citizens comments and changing conditions which may affect the �
sand and gravel operation. Upon expiration of the initial short- E:.��: .
term permit, ahd after a duly noticed public hearing, a long-term '9 -
pel�nit may be issued to be in full force for a period of time �.i' ;;
specified by the Board. The Board may extend a long-term permit �
�, :
for such additional time as it deems appropriate or it may modify
the permit in other appropriate fashion without the need for an
application for a new permit if the Board determfnes after a duly
; noticed public hearing that a new application is unnecessary at
; the time such extension or modification is requested. ,
j 5-503.3(e) Annual Reports/Hearings �� ..
�: (1) During October of each year, but no later than October 31,
� the operator/permittee shall file a written report with the
� Planning Director demonstrating compliance or non-compliance
'�; with conditions of the sand and gravel permit pursuant to '
� Section 5-303 and other provisions of the County Land Use Code.
�� The Planning Office shall review the operator/pern►ittee annual i.
written report to determine compliance with the permit and
;� prepare a report to the Board to be reviewed at a duly noticed
' public hearing in December. The purpose of the hearing shalI, be
.;� to review the annual written report of the permittee and to '
'�� provide an opportunity for the citizens of Pitkin County to �;'
t{ comment on the sand and gravel operation.
;
� (2) Based upon the annual hearing, the Board shall have the powez ,
,.� upon good cause being shown, to modify the permit to require
certain corrective measures to be taken or to direct the County
�� staff or its agents to enter upon the premises and to take .
corrective measures Yequired by the Board; impose new or
.`�j additional conditions, standards or restrictions to addresS
environmental concerns required by considerations of public �
:{ health safety and welfare or to achieve the objectives and � �
purposes oE the original permit or to bring the permit into
compliance with other laws or regulations regulating permits to ,�
or uses oE the site; the cost to be assessed against the ,�
operator/permittee and his sureties. ;;•

� (1) Whenever the Board has reason to believe that there has
occurzed a violation of the permit, written notice shall be given �;.
� z to the operator or the alleged violation. Such notice shall b6 � �"'

upon the a2leged violator or his agent for service of process. �� ,;.:.:
� If served by mail, any such notice shall be deemed to be f�;:"
j effective three (3) days after deposit in the IInited States mail, f ,�:.
,� sufficient postage prepaid. The notice shall state the portion � �"'_
of the permits alleged to be violated and a summary of the facts �''�'�y

alleged to constitute the violation, and may include the nature
of any corrective action required. '

(2) In the event the County determines that the � '°
R .:
operator/permittee is not acting in compliance with applicable +:i
permits and that the health or welfare of the community requires ��
immediate action, the County shall require the =
operator/permittee to cease operations within twenty-four (24) :�
hours after delivery of written notice to such effect for a
period not exceeding thirty (30) days during which time a hearing
shall be held as specified in these regulations. -

(3) Any member of the public who is aggrieved by a failure of the ���,�..
operator/permittee to comply with the terms and conditions of the �; �
applicable permit shall have standing to enforce the conditions �� ,�.
of the permit, by reporting any alleged violation to the County �1
;� and requesting a hearing thereon, in accordance with the �
requirements of this section.
''. (4) The Board may, upon the request of the permittee, any
'; interested party, or on its own motion, hald a hearing to �
� determine the nature and extent of any alleged violation and
shall have the power, upon good cause being shown, to revoke,
� suspend, or modify the permit to require certain corrective
� measures to be taken, or to direct the County or its agents to
enter upon the premises and to take corrective measures required �j
by the Board; the cost to be assessed against the operator and
his sureties. The hearing shall be held no sooner than ten (l0) �
days and no later than thirty (30) days after the issuance of any
,; notice of violation, unless a different date is specified by the
Board for good cause.
� (5) If the Board suspends or revokes a permit of an operator, the
operator may continue previously permitted operations only for
i the purpose of bringing the previously permitted operation into
� satisfactory compliance with the provisions of the operator's
y County permit, or to carry out reclamation requirements of the
i State of Colorado. The Board may reinstate the permit of the -
operator upon compliance with the terms of the suspension or on �'
such later date as the Board may deem appropriate.

- (6) In the event that a permit is revoked by the Board, the Board ' i
may specify that neither the permittee nor a successor thereto ��
for the same site may re-apply to the Board for a sand and gravel q< �,
� permit £or up to one year after the date of revocation or the � �
date all permit improvements and inventory was actually removed
and all operations actually ceased, whichever date occurs last. , ',
(7) In the event any operator fails to comply with any order of f3 ,. ,.°�^ ,
the Board issued after hearing, the Board may revoke the permit `, F`Y���
and request the County Attorney to bring suit for a temporary � �:`

restraining order, a preliminary injunction or a peratanent
injunction to prevent any further or continued violation of such
order. The Board may also seek such penalties or other relief as �`,?�' �
are provided by statute or the Land Use Code for any such ; Y�,"
violation. Suits hereunder shall be brought in the District ��:?<'s.
Court for Pitkin County.
