OF PITI�N COIINTY, COLORADO AMENDING SECTION 4-6.1(c)
AND 4-6.1(D) OF THE PITKIN COUNTY I�AND USE CODE

WI�REAS, the Pitkin County Planning and Zoning Commission
--��; (hereinafter "COmmission") adopted the Pitkin County Down Valley
Comprehensive Plan in January of 1987 and proposed legislation to

:,.:� the Board to create a low impact subdivision procedure in April
_,�f,,!
of 1987; and

,� Wf�REAS, the Board of County Commissioners (hereinafter
�==',� "Board") adopted Resolution 87-80 on Septemher 21, 1987, enacting
.:�:,
� ;:��� a revised version of the low impact subdivision legislation; and _
`�''� Wf�REAS, the Board did direct the Planning Office to
�:..;:�',,:c�
��
initiate a Land Use Code amendment clarifying the County's
� criteria for a low impact subdivision approval based upon a
_�. ��
_�;,<� determination of whether a development proposal is or is not low
-':i� impact in nature; and
:`:�� WHEREAS, the Commission considered options for amending the
�':'-;i::.�
-y��� low impact subdivision regulations at a special meeting on May 3,
,_��_�� 1988; and
-y��.� ,r
WHEREAS, the Commission voted not to recommend Land Use Code
� -�:v� Amendments to Section 4-6.1(c) ; and
+_�?1 WHEREAS, the Board considered Land Use Code amendments to
� °��`i Section 4-6.1(c) and despite the recommendation of the Commission `�•',�i

approved the Code Amendments to 4-6.1(c) on first reading on May � ,
17, 1988; and

deviated from the Commissioners; and
`"r WHEREAS, the Commission considered the referral of the

scheduled public meeting on June 7, 1988, their June 14 public �'

���� WI�REAS, the Commission recommended lanquage changes to the

staff and requested the staff to forward the changes to the

ti�iFIEREAS, the Board considered the proposed Land Use Code
•+'< Amendment to Section 4-6.i(c) at their regularly scheduled public
meeting held on May 17, 1988; and
�.::::;� WHEREAS, the Board considered Land Use Code amendments to

Sections 4-6.1(C) and 4-6.1(D) at a duly noticed public hearing
on June 28, 1988.

migratory routes, winter range or calving areas.

areas, but manmade landforms may be used on a limited �-
basis to complement development.
(iii) Guidelines to Minimize Interference with Agriculture and
Wildlife
�� .
� a. Applicants shall adopt covenants which are intended to
_.:, minimize interference with agriculture and wildlife,
`�'� including, but not limited to provisions for adequate
water rights, prohibition of dogs, and maintenance of
fencing between residential and agricultural uses.
b. Where appropriate, developments shall utilize Planned
�;:<�; Unit Development (PUD) requlations to create lots which
y��;; are smaller than the minimum lot size oP the Land Use
Code for the underlying zone districts.
c. Roads serving developments shall be constructed at a
�{r� sufficient distance from property boundaries so that
�::-0a
_ .:� normal maintenance including snow removal does not
- damage agricultural fences.
�'"-�� d. Developments shall make provisions which ensure the
�.��;;� maintenance of fences if development sites adjoin stock
� operations.
�-�Y'� e. Developments which are not permanently occupied shall
_�;�� make provisions to ensure adequate maintenance for
irrigation ditches which traverse the site.
f. Developments shall make provisions to ensure historic
- access to ditches, headgates, or roads used to maintain
- agricultural fences. Alternate access easements
`__';� suitable for these purposes may be considered.
:`�` (iv) Priority Preservation Lands
a. In determining which lands shall be restricted against ?
''�'=`� development as provided in subsection (C)(ii), the
