OF PITKIN COUNTY, COLORADO '
TDENTIFYING THE APPLICABILITY OF
RESOLUTION NOS. 88-64 AND 88-65
TO PENDING IAW IMPACT SUBDTVISION APPLICATIONS ,:;�:.

RECITALS ij'..
1. On December 29, 1987, the Board adopted Resolution No. �
s7-111, regarding vested real property rights.
2, On June 29, 1988, the Board adopted Reso2ution Nos. 88-
64 and 88-65, amending the Low Impact Subdivision Regulations.

a 3. At the time of the adoption of Resolution Nos. 88-64 and I�,
88-65, there wera pending before the County several low impact ! �
`;� subdivision applications. In order to consider the applicability
'-� of these Code amendments to such applications, the Board '
� conducted a hearing on July 11, 1988. Parties with pending
';� applications appeared and presented testimony.
`� 4. In consideration of the provisioas of Resolution No. 87- i
- ".I 111, the Board has determined that applying the requirements oE
� Resolution No. SS-65, to all pending low impact subdivision
: applications 3s consistent with the Code. In addition, no
,� evidence has been presented to show that this determination would �
'�' be inequitable or work undue hardship on such applicants. �
�� 5. While a 1 in Resolution No. 88-64, to the
pp y g pending low
;� impact subdivision applications for property outside the ;
�� downvalley area, i.e., Smuggler Mountain Estates Parcels A and B,
would be consistent with Resolution No. 88-111, equitable '
� considerations mitigate in favor of allowing these applications
;� to proceed. i
" 6. The determinations embodied in thfs resolution apply to L
,� matters of procedure only, and do not constitute a determination
that any pending low impact subdivision application will be
,y granted or denied.

,. Commissiohers as follows:
