COLORADO, APPROVING THE FINAL PLAT FOR THE
WILIAUGHBY PONDS ESTATES

WHEREAS, on July 12, 1988, the Pitkin County Board of County
�i! Commissioners reviewed the final plat application for the

Willoughby Ponds Estates Subdivision; and
WEIEREAS, in March of 1987 the Board approved the detailed
��; submission for the Willoughby Ponds Estates pursuant to !`
�:'�� Resolution 87-31; and

,,,, WHEREAS, the Board found the final plat appiication to be in
- ,:� �
compliance with the conditions of detailed approval; and

�'' NOW, THEREFORE, BE IT RESOLVED that the Pitkin County Board

;.; � of County Commissioners does hereby approve the Final Plat for
<� � the Willoughby Ponds Subdivision with the following conditions of
� approval:
,:�:;� � 1. Prior to the signature of the final plat by the Board of
;� County Commissioners, the applicants shall revise the final
-.� plat documents as follows. These shall be approved by the
_:.� Planning Office and County Attorney.

��;':;� a. Exhibit "A" o£ the Subdivision Improvements Agreement
•�a shall include a footnote which indicates that the e
°.:g improvements are tied to specific recorded documents �
�=; such as a drainage plan or a utility plan.

�.:'� _ � b. The applicant shaZl record a utility plan and drainage
plan with the Final Plat. These shall be consistent
with Tom Newland's memo dated July 1, 1988 and with the
detaaled submittal documents. These shall be reviewed � t
by the County Engineer prior to signature by the Board � �R.�

more clearly note that the bonding for improvements
shall occur prior to the issuance of any building �'
permit for the property with the exception of a remodel j
or reconstruction of the existing house. �
e. The�� Obligations Contingent" section of the Subdivision
Improvements Agreement located on page 13 shall be
reworded to reflect that the obligations of the
-�;� property owner with regard to subdivision improvements
shall begin at such time a 2ot is conveyed or at such
� time a buildzng permit is requested, whichever occurs
=•� first.
`':� f. The applicants shall provide a waterline easement
-.�-7 between Shady Lane and Willoughby Way consistent with
;A.�Y� the request by the Water Department noted in the
memorandum by Jim Markalunas dated June 7, 1988. This
easement shall generally run parallel to the sewerline
:: ,�' easement to 5hady Lane. This waterline easement would
`;;� not be granted until such time as the applicants makes
`�9 the subdivision water tap connection to Willoughby Way.
'� Thi.s shall be stated in the Improvements Agreement.
�;;.'"� g. Page 19, paragraph 4 of the Subdivision Improvements
'''� Agreement should be changed to read "Each lot owner
.Y�� shall submit a driveway plan to the County Engineer's
:�-:� office for approval of an encroachment permit before a
_. � building permit is issued.��
�,. � h. If the optional pond is built, an excavation permit
`;;,-`:� shall be obtained from the Engineering Department.
"� 2. The County Attorney sha11 review all final plat documents
:;_'V;� prior to signature of the £inal plat by the Board of County
-: Commissioners.
