"�' WHEREAS, the Aspen area has exceeded healthful levels of
total particulates tor most of the years from 1975 through 1987,
_,,,.� and,
��;? WF�REAS, the Aspen area has measured three exceedances of the
' health standards for PMlp pollution, in the first winter of
monitoring, and
WHEREAS, the Colorado Health Department believes that a large
� fraction of the PMip pollution on a high poZlution winter day
[^y?� comes from woodburning, and
_' WHEREAS, this PM}p pollution, in addition to being a health
' � hazard, impairs visibility, thus harming the quality of life for
':ry"��� residents and visitors, and
'.z^.,.� WHETtEAS, the County Commissioners have adopted a Local
Implementation Plan agreeing to require fireplaces installed in
the metro areas of Pitkin County having natural gas service to be
',;;,� equipped with and used only with gas logs, or other alean-burning
technology, and
°"� WHEREAS. the County Commissioners, for the purpose of "
. ��� protecting the health, safety and welfare o£ the residents and
visitors oE Pitkin County, desires to amend Title III, Air
=:=;�� Pollution Regulations, Pitkin County Code, to regulate construc-
'.�-�� tion and use of fireplaces.
'�`'� NOW, Tf�REFORE, BE IT RESOLVED BY TfSE BOARD OF COUNTY
C�MMISSIONERS OF PITRIN COUNTY, COLORADO, that Title III, Air '
`�°� � Pollution Requlations of Pitkin Count Code be and hereby is
� :�_-�� amended as follows.

addition of a new section (d) to read as follows: d."'

(i) In areas where natural gas service is provided to the
property line, after January 1, 1989, no fireplace shall be
` constructed which does not contain qas logs and is not
provided with natural gas service to the fireplace, unless
the Aspen/Pitkin Environmental Health Department has
` determi.ned that the fireplace to be constructed has emissions �
� less than or equal to those of a certified stove as specified
r=�.�•:�i in Regulation No. 4 of the Colorado Air Quality Control •
Commission, when tested in the open-door mode, accarding to a
test procedure approved by the Colorado Department of Health
_ - and the Aspen/Pitkin Environmental Health Department.

�:;%j (ii) In areas where natural gas service is provided to the .
property line, no fireplace constructed after January
~��y� 1, 1989 may be operated with wood or other solid
material as a fuel source, unless the Aspen/Pitkin
Environmental Health Department has determined that the
_ r^_;� device to be used has emissions equivalent to
those of a certified stove, when it is operated with
'r;=,;:;:i doors open.
,�'� �� Section 2
�'� If any section, subsection, sentence, clause, phrase or
J�=�`� portion of this ordinance is for any reason held invalid or
i? .r� unconstitutional in a court of competent jurisdzction, such
portion shall be deemed a separate, distinct and independent
�,� provision and shall not affect the validity of the remaining
portions thereof.

Section 3
=�`;'"� Nothing in this ordinance shall be construed to affect any
`T.'�=��. right, duty or liability under any regulations in effect prior to
`',",=:�� the effective date of this resolution, and the same shall be
continued and concluded under such prior resolutions.

- A public hearing on the ordinance shall be held on the 17th
day of Mav , 1986, in the County Commissioners Room, Pitkin
. County Courthouse, Aspen, Coiorado.
