>_,�; WHEREAS, the Board of County Commissioners adopted a Sales
? Tax Resolution on October 7, 1968, imposing a 2� countywide sales
tax within Pitkin County which was approved by the electors of
;;-� Pitkin County on November 5, 1968, and which became efPective on
•.s;t� July 1, 1969; and

..� WHEREAS, said Sales Tax Resolution 2�as been amended to
':�;� provide for the distribution of the 2$ sales tzx as follows: `'
��� (a} 43� to be retained by Pitkin County for its exclusive
'�� use.

--'�� (b) 57� to be allocated among the incorporated cities and
:..;;� towns within Pitkin County in proportion to the amount
of County Sales Tax collected within their respective
' corporate limits; and
= WHEREAS, pursuant to Resolutions 83-24, 85-45, and 85-46,
r)) the Board of County Commissioners amended its Sales Tax
:_�;� Resolution, dated October 9, 1968, to inarease the county sales
°::� Lax from 2t to 3$, and to apply the portion of the increase
allocated to Pitkin County to public transportation purposes
';;;:�`� within the County; and
WHEREAS, the City of Aspen currently has a 1� sales tax and
the Town of Snowmass Village currently has a 1$ sales tax; and
- WHEREAS, the Board of County Commissioners has determined to
- amend its Sales Tax Resolution, dated October 7, 1968, as
:`�?� amended, to increase the county sales tax from 3g to 4�, and to
;;:� apply the portion of the increase allocated to Pitkin County to "
the acquisition and maintenance of interests in land for the
1�-j purpose of preserving open space and establishing trails in
��^� Pitkin County; and �

, WHERERS, the increase in the county sales tax, if approved
and imposed, would result in the imposition of a total sales tax >'`
by the State o£ Colorado, the County of. Pitkin, the City of ��'' `'
i'`�.� Aspen, and the Town of Snowmass Village in excess of 7$; and � `, .,

Commissioners that the increase in the county sales tax shall �
not go into efPect until the conditions set forth herein are
satisfied; and
WHEREAS, it is necessary to submit such proposal to the ;
registered eiectors of the County before this Resolution shall �
become effective; j'
THEREFORE, BE IT RESOLVED SY THE BOARD OF COUNTY

COMMISSIONERS OF PITKIN COUNTY, COIARADO:
.. Section 1. Additional Sales Tax. The Sales Tax Resolution,
dated october 7, 1968, as amended, (the"Sales Tax Resolution") is s
,# hereby amended to provide for a 4� county sales tax on the sale � ` .
:{ of tangible personal property at retail, and the furnishing of �t
�;;� services as provided in §29-2-105(1} (d), Colorado Revised
-y Statutes 1973, as amended, and upon all taxable transactions
within Pitkin County. All other provisions of the Sales Tax
,;f� Resolution shall apply to the collection, administration and
'^:l enforcement .of this sales tax except as hereinafter provided.

':�{ Section 2. Imposition of Additional Sales Tax. There is
3 hereby imposed on all sales of tangible personal property at
°;� retail and the furnishing of services as provided in §29-2-
_r 105(1) (d) , Colorado Revised Statutes, as amended, a tax equal to
.:;:.� 4� of the gross receipts. �
;,-;1 Section 3. Receitit of Additional 1$ Sales Tax bv Pitkin
.::+ Count}� and A1Zocattion to its Incorgorated Municipalities. All
receipts of the additional 1� county sales tax which are
;:�.j collected within the Caunty and its incorporated municipalities
::., shall be allocated and distributed prompt2y upon receipt to those
;i.:; municipalities as follows: �
a. The City of Aspen shall be allocated an amount equal to
-_ that portion of the additional 1� county sales tax
� which is collected within its corporate limits;
�,=,_� b. The Town of Snowmass Village sha11 be allocated an !..

which is collected within its corporate limits.
Section 4. Use of Additional 1� Sales Tax bv the Countv. !�

Section 5. Election and Amendments.
a. Before this sales tax Resolution shall become i.' ,
effective, it shall be submitted to and receive the `
approval of a majority of the registered electors of ! ,
Pitkin County voting at a general eleation to be held
on Tuesday, November 8, 1988; and said majority shall
alsc number at least one-sixth of the registered
electors of Pitkin County. The question shall read as
follows: •
t � "COUNTY SALES TAX FOR OPEN SPACE
I:_� Shall the imposition of an additional one-percent _
(l�) county sales tax, as outlined below and more
�� specifically set forth in Resolution # 88-_, be
�'•��'; approved?
1. the additional revenues retained by the
, *� county from this increase will be segregated in a =
�=..a separate fund
- �•-,�=::� 2. such revenues will be expended solely for the
acquisition and maintenance of real property,
',•''t-� water rights, development rights and other
�r'y interests in land, and payment of any indebtedness

incurred in connection therewith, solely for the
purpose of furthering open space and establishing
_ trails within the county.
3. this only increases sales tax in the
- unincorporated area of the county since Basalt is
r<wj exclnded and Aspen and Snowmass Village will
rescind 1� of their sales tax in exchange for an

5. approval shall also constitute authorization ,{
for the commitment of the tax revenues to
indebtedness and approval of such indebtedness up

term of 20 years i -.

� 6. the Board of County Commissioners shall � ;_�
appoint an advisory board to review the needs of � ;:;;'
the County for open space and trails, and the � v�.

County Commissioners for the prioritization of
land acquisitions, the financial resources to be
committed, and manner in which such
recommendations should be implemented." -

b. Except as to the additional rate of one percent (1�) ' '
imposed herein and the distribution and use of the tax �,��, .
revenues, the Board of County Commissioners may amend, j':.
alter or change this Resolution, subsequent to adoption �
by a majority vote of the Board of County '
Commissioners. Such amendment� alteration or change �
need not be submitted to the electors of Pitkin County
for their approval.

Section 6. Effective Date. The additional tax levied by � li `
i this Resolution shall be effective and sha21 be in force at 12:01 t
' a.m. on the first day of January, ].989 (January 1, 1989) or on t• '
the subsequent first day of the January or July next following '
the satisfaction of the conditions set forth in Section 8 hereof '
�� and the forty-five day notice period for the State of Colorado.
� The other provisions of this Resolution shall be effective upon
- j adoption.
� Section 7. Termination. The additional one percent (1�)
,� sales tax of Pitkin County imposed by this Resolution shall �
, continue in effect until repealed by the registered electors of
} Pitkin County at an election held for such purpose. Howsver, so ,�
long as there remain outstanding any bonds or obligations of the ;.
t County having a lien on the proceeds of all or any portion of the �
,� sales tax, or the obligations of the City of Aspen or the Town of �
Snowmass Village having a lien on the proceeds of all or any
•� portion of the sales tax to be reduced as described hereinafter, �
neither shall the sales tax be repealed, nor shall the
°. application of the proceeds derived from such sales tax be
' changed in any way which would adversely affect the security of
� such bonds or obligations.

,� Section 8. Conditions Precedent. This Resolution shall not
� be effective unless and until each of the following conditions ,
shall have been met: "

- � a. The City of Aspen shall have taken due proceedings -
� reducing its existing sales tax by 1�; and 1't
y b. The Town of Snowmass Village shall have taken due �
� 3 proceedings reducing its existing sales tax by 1�. '� , 7

� Section 9. Severabilitv, If any provision oE this � �
� Resolution or the application thereof to any person or �- -
� circumstances is held invalid, such invalidity shall not affect ���;r�;���,
