F`� ; WHEREAS, pursuant to Senate Bill #219, the Colorado General � . i.:' _=� Assembly enacted C.R.S. 24-68-101 et se ., concerning the t i : . establishment of vested real property rights; and ',� WHEREAS, in order to implement this Article, and especially �.r;# to designate that approval which triggers a vested property ';:>� right, it is necessary for the Board of County Commissioners to '` . ':�.`� amend the Pitkin County Land Use Code by addressing the issue of ','' ;..;y vested real property rights. This resolution is intended to be "�'� consistent with C.R.S. 24-68-101 et se 1 :.,-j _,g. , and in the - ..t.'� implementation of this Resolution reference must be made to the �` statvte where neeessary to assure consistency. � ^'�4� NOW, THEREFORE, BE IT RESOLVED by the Board of County .�'>.._ 's=� Commissioners of Pitkin County, Colorado, that the Pitkin County ' i Code, Title II, is hereby amended by adding a new Section 6-5.7, ' to read as follows: '?:?��.. "6-5.7. Vested Property Rights 1) A vested property right shall attach to and run with the applicable real property upon the approval of a Site ::;:�,; • Specific Development Plan. 2} For purposes of C.R.S. 24-68-102(4) and this section, Site ":� ' Specific Development Plan, shall be deemed to be the _',;;� Detailed Submission approval described in Section 6-4 of the Code. Where Detailed Submission approval is not required, `�`' the Site Specific Development Plan shall consist of the '' -;:_<:i Final P].at approval identified in Section 6-5. Resolution No. 88-9� Page 2 ' creation of a vested property riqht. !:.. _ ._ ,.,,,.....;.:«.3j._:.,::.!'Vested.-ProQerty.-Riqht" means .the right to undertake and �•- ' complete the development and use of property under the terms ° ' . and conditions of a Site Specific Development Plan. � �.:. ; . 4) Approval of a Site Specific Development Plan may be made with or without conditions, and the failure to fully abide - by the terms of any conditions approval will result in a �"' forfeiture of vested property rights. 5) A property right which has been vested as provided herein shall remain vested for a period of three years, unless extended by the Board of County Commissioners or the ��f� Planning and Zoning Commission, as appropriate, in their ' complete discretion on a case-by-case basis. The Board or , _ .�'� :��7 the Commission shall consider both the needs of the County `t�:�i and the applicant in determining to extend the period of ;�°� vesting beyand three years. Any such extension shall be in '`,=3 the form of a development agreement duly authorized and - `��' executed by the landowners and the County and reasonable �' ? conditions may be imposed in granting of any such extension. ;;�'�� 6) The establishment of a vested property right shall not . exempt the applicant from requirements for Final Plat approval, building permits, or other necessary permits or :i},� approvals applicable subsequent to the approval of the Site Specific pevelopment Plan. The establishment of a vested property right sha21 not preclude the application of the ��,-�� requirements of the Uniform Building Code, Fire Code, , ;,�`� Plumbing Code, Electrical Code, Mechanical Code, or other • Y,Y� requirements necessary for the protection of the public health, safety and welfare. - 7) As soon as practicable following the date of site specific development plan approval, and in no event later than fourteen (19) days following such approval, the County Clerk �.�'.°� or the Planning Office shall cause a notice to be published in a newspaper of general circulation in Pitkin County, ,�� advising the public of the approval and the creation of a - vested property right. The progerty shall be published with - such notice. Approyal of a Site Specific Development Plan - shall be subject to judicial review, and the period of time permitted by law for the filing of any such action shall : :� ' begin to run from the date of publication. -I�,`.'��_?� ' 8) This Resolution is effective January 1, 1988, and shall � w ' a p pl y to any site specific development plan approved ��L<<; : thereafter.
