1987 the Pitkin County Board of County Commissioners (hereinafter �;
'4'4 "Board") reviewed an application by Gayla Gregory and Paul Hurley
,y (hereinafter "Permittee"} for a special review for an outdoor
'r eating and drinking establishment on the parcel in Redstone more £ "`
`-� '
i� specifically described as Block 2 Kistler Subdivision; and
`;,� WHERF.AS, the Board found that the application is in �.
. �
�,•;�� compliance with the area and buZk requirements of the Land Use
�;.;� Code; and �
,�
= - �, the Redstone Histori.c Preservation Commission made
a recommendation to the Board to deny the application based on '
_- the Historic character of the neighborhood and the
,��:.
incompatibility of the type of proposed use; and
Wf�:REAS, the Board made a finding that the Historic
''�t Preservation issue was not compelling enough to deny the
��+4�:�: . ..
" application at thi.s time.
;��y� WHEREAS, the Board granted the permittees Lemporary approval .

within Resolution 87-88 to operate the popcorn wagon during the
�� summer of 1988 subject to a review in the fall of 1988 for %
conformance with conditions oP Resolution 87-77 and the Special

:;�� &eview Criteria of the Land Use Code and; � �_,. `�

a letter from the permittee addressing all of the conditions of
Resolution 87-77; and '
WHEREAS, the Board did consider the permittee's operation at '
a duly noticed public meeting on September 27, 1988. �%'';:
.� NOW, T�REFORE, BE ZT RESOLVED by the Board that it does '
, hereby grant the permittee special review approval pursuant to ;. :
3 Section 3-6 of the Land Use Code and the following conditions. � ,` :

;,� 1. All material representations of the applicant made � '`
within the application submitted to the Planning Office �,
� on June 5, 1987 and in public meetings before the Board
,:� of County Cotamissioners sha21 be adhered to unless
>,� otherwise noted in the resolution of approva2.

."i 2. Tn the fall of each year, but no later tYtan November 1,
� the permittee shall submit a written report to the
,,;.$ Planning nirector attesting to the continued
� conformance of the operation with conditions oP the
resolution granting special review approval. If after
"r� reviewing the statement as well as comments from
� concerned citizens the Planning Director determines �
that the use is not in conformance with the provisions
t:� of the special review approvai, it shall be
�:� recommended to the Board that a hearing be held to
�:"� consider revocation of the special review approval in
-�� accordance to the procedures identified by section 3-
� 6.3 of the Land Use Code (Limitations on Special Review
Approval).
3. The popcorn wagon shall be permitted to operate from
March 31 until November 21 of each year.

,,:.� 4. Neither the permittee nor its customers shall occupy j '
the Cedar Drive easement with any uses includinq
- ``1 parking. z
5. The design of the wagon and surrounding facility sha12 �
- adhere to the following guidelines.
a. The wagon shall be 8' x 18" as represented in the �I.

be reviewed by the Planning Office. If the
Planning office finds the changes to be •
substantial, such changes will be presented to the •
Board of County Commissioners for their i.:
consideration and approval. Curtains will not be �
� required to be located on the windows a£ the
wagon.
c. The popcorn wagon site sha1Z not be fenced.
d. The trash receptacles shall be painted a dark 4
=�;�'j color.
,''i;.l 6. The permittee shall seek to hook-up to public water
i supply and sewage disposal systems. In the event that
;� � in the determination of the Environmental Health
Department the existing water supply and sewage
�•1'<;� disposal system is no longer adequate for any reason,
��.;?s;: the Environmental Health Department raay require
corrective actions to be taken including closure of the
''`F�`: facility until it is hooked-up to the public water
' supply and/or sewage disposal system. '
.;�.`y� 7. Prior to initial operations, in the spring of each -
':�;�>Y.� year, the permittee shall submit to the Planning
:;;,;t-,: Director an agreement £or use of public restrooms at
the park or in the immediate vicinity of the popcorn
wagon. In lieu of submitting an agreement annually,
" the permittee shall submit to the Planning Director a
-rf�',; long-term agreement for use of bathroom facilities at
- the park or in the immediate vicinity of the popcorn
wagon.
`;:;��; 8. If the applicant seeks to serve alchoholic beverages on
;��r`- the premises there a hearing shall be held before the
