RESOLIITION OF THE BOARD OF CODNTY COMMISSIONERS
OF PITRIN COUNTY, COLORADO
RESCINDING RESOLUTION � 88-88 AND AMENDING RESOLUTION # 88-89
Resolution No. 88-�

WHEREAS, the Board of County Commissioners of Pitkin County,
Colorado, has adopted Resolution # 88-88 on September 19, 1988, •.
providinq for a increase in the County sales tax from 3� to 4�, "' �
and submitting such increase to the eleatorate for approval at s'..
the general election to be held on November 8, 1988; and pv�9�
WHEREAS, such increase in the County sales tax will not be :.`:.
effective until the City of Aspen has taken due proceedings ° '
� reducing its existing sales tax by 1�; and
�
WHEREAS, the City's bond counsel has advised that the City
ri may not reduce its existing tax without approval of the owners of
� bonds secured by such sales tax and that it does not appear
-�c feasible to obtain such approval nor is it economic to refund �
'�� such bonds at this time; and ;

.::3� WHEREAS, the Board of County Commissioners does not wish to
=,� place the sales tax question before the voters since the tax can !
��# not be implemented for several years; and !
_ ":� WHEREAS, the Board also adopted Resolutidn # 88-89 on
•;.;:� September 19, 1988, providing for a countywide use tax and _
_ .� submitting it to the electorate for approval at the general
;.�;;� election to be held on November 8, 1988; and
;;� WHEREAS, the use tax question included the following
reference to the sales tax question, but the sales tax question
will no longer appear on the ballot:
�,��� '�if ballot question �1 for an increase in the sales tax �
;z.� rate is approved and implemented, the use tax rate will �
be 4�; otherwise, the rate will be 3&"
;;�'y`� NOW THEREFORE, BE IT RESOLVED BY THE SOARD OF COUNTY
'',.� COMMISSIONSRS OF PITKIN COUNTY, COLORADO, as follows: ;
_:\,� 1. Resolution # 88-88, providing for a increase in the County �
sales tax from 3� to 4$, and submitting such increase to the
;:;;j electorate for approval at the general election to be held on
- - November 8, 1988, is hereby rescinded and the County Clerk is
directed to remove such question from the ballot.
2. The use tax question adopted in Section 5 of Resolution #

"COUNTY USE TAX FOR ROAD IMPROVEMENTS
Shall the imposition of a use tax, as outlined below and �,
; more specifically set forth in Resolution � 88-89 as
amended, be approved? • �`;'
�::;:;.,
1. tax proceeds will be segregated in a separate capital ��%'•
improvement fund �;,,;

2. at least 50� of the net revenue received will be used � '
;;� solely for improvements to State Highway 82 within Pitkin
� County
,;
3. the remainder will be used solely for capital
�+�j replacement and improvement of County roads and bridges �
�$�'j 4. the use tax rate will be 3�

'2 5. effective for ten years from January 1, 1989, to
.'*,� December 31, 1998 �
6. levied on the privilege of using or consuming in the
County any construction and building materials purchased at �.
- , ,'.� retail and for the privilege of storing, using or consuming
in the County any motor and other vehicles, purchased at
�� retail on which registration is required
'�:4� 7. the tax . does not apply to vehicles and mater�3ls
;� already subject to County sales tax, generally those '
purchased within Pitkin County

�- 8. approval shall also constitute authorization tor the :;
+� commitment of the tax revenues to indebtedness and approval i
•.� of such indebtedness up to a maximum principal amount of
$3,000,000, at a maximum interest xate of 10$, and for a �
maximum term of eight years." ,
