'. WAF'RF.AR� in the course of replacing the Hunter Creek Bridge �}
and making certain improvements along the right-of-way for Red � �
� Mountain Road, it was necessary for the County to obtain �<:- ..:�
additional lands for right-of-way along that road; and
y�7F�RF.AC� Dr. Robert Oden, the adjoining property owner, is -
i agreeable to the donation of the required lands in return for the
; County's commitment to certain restoration work and payment for `
' an appraisal of those lands; �1

� NOW, Tf�REFORE, BE IT RESOLVED BY THS BOARD OF COUNTY •�; -'
? CONBrIISSIONERS OF PITFCIN COIINTY, COLORADO that the County shall ' '�
� accept the donation of those tracts of land referenced in the
�, attached "Agreement for the Construction of Right-of-Way" and
�+ "Quit Claim Deed" from Dr. Robert oden upon the terms and
f' conditions described therein, and that the Chairman of the Board
- rt is hereby authori2ed and directed to execute those documents on
� behalf of the Board of County Commissioners. '

AGREEMENT FOR THE CONSTRUCTION �F ROAD IMPROVEMENTS
THIS AGREEMENT made this fi(�� day of ����_, `
198�, by and between Robert R. Oden as General Partner of Oden �
and ompany, a limited partnership, hereinafter referred to as
Oden, and the Board of County Commissioners of Pitkin County,
Colorado, hereinafter referred to as County; `"�..

WHEREAS, Oden has granted to the County a certain deed �.s�,��
for roadway purposes; and �'�'`"•=

,{ WHEREAS, to protect the remainder of the Oden property, the I
� County has agreed to construct certain improvements and make
certain design changes, more fully described below.

'� NOW, THEREFORE, Oden and County, in consideration of the �
mutual covenants hereinafter set forth, agree as follows: �
5 Article 1. Land Donation Ordinance � �
The County shall adopt an ordinance acknowledging the `' •
donation of portions of the Oden land and accepting the Quit .
Claim Deed for the two parcels of land as described in the
attached "Exhibit A."
' Article 2. Appraisal �
The County shall engage the services of a real estate -
appraisal consultant to develop and provide to Oden an opinion of
value for the two gift parcels. �
'� Article 3. Right-of-Access �'

� The County shall allow and not restrict in any way the right
of access to Lot 1 of Oden Lot Split, recorded in Book 20 at Page i
90, from the Red Mountain Road. � . z

Article 4. Design Changes f
The�ounty shall modify the current construction plans for � �
the Red Mountain Road to reflect the following design changes. �

1. The concrete curb and gutter shall be installed to '
establish a curb cut for access to Lot 1 of the Oden Lot Split
without cost or charge to Oden and at a location mutually '<
acceptable to Oden and the County. �f�^

2. All lands on Lot 1 or the gift parcels whieh were
� physically disturbed by the construction of the road and bridge )� ,
improvements shall be top-soiled and seeded following t'�. ,
� construetion.
