;=� WHEREAS, technologies exist which can reduce pollution from
existing woodstoves and fireplaces, and
:3 WHEREAS, Aspen has experienced unhealthful levels of
particulate pollution and the Board of County Commissioners desires

:k'� WHEREAS, woodburning has been determined to contribute to high
:,'� particulate levels, especially to the toxic particulates, and '��

.� WHEREAS, the Board of County Coaunissioners, for the purpose

visitors of Pitkin County, desires to amend Sections of the Pitkin

The enalt for a violation of Sections as hereinabove amended '"`.

shall be the penalty provided for in Section as follows:

"Any person convicted of violating any provision of this '€.� �
article shall be punished by a fine of not more than three hundred ��':4-A::,.
dollars ($300.00), for each separate offense, and may be enjoined �' -
from any further or continued violation thereof. Each day any �'`.-: .,�
; violation of this article shall continue shall constitute a Y
separate offense." �

iIf any section, subsection, sentence, clause, phrase or �
!-` portion of this resolution is for any reason held invalid or �.,. �
t� unconstitutional in a court of competent jurisdiction, such portion ;.1:-
= shall be deemed a separate, distinct, and independent provision and
;.:�j shall not affect the validity of the remaining portions thereof. r..�
Section 4 �
Nothing in this resolution shall be construed to affect any � �
.�;;i right, duty or liability under ang resolutions in effect prior to
the effective date of this resolution, and the same shall be
continued and concluded under such prior resolutions.
