This Agreement, entered into this 19th day of July, 1988, by
and between Howard Kehrl (hereinafter the "Applicant") and Pitkin •
County (hereinafter the "County").

WHEREAS, the Applicant has an existing sinqle-family ""�`�

residential structure on his property, described as 0296 Glen Dee �?:3::.

WHEREAS, the Applicant intends to construct a new residence
to replace the existing structure and wishes to maintain the �?
existing structure during the construction period; and tr`:
WHEREAS, 53-8.11(d) , of the Pitkin County Code allows for i°�`�:; ;
temporary use of such existing structure during the construction �
peziod of a new structure. �
NOW THEREFORE, the parties agree as follows: � ! �

RECITALS
- �
1. The County will allow the Applicant to maintain the
� existing structure during the construction period of a new
I sittgle-family residential structure. In consideration of �
, this action the App2icant agrees that no occupancy of the �
new replacement residence shall take place until the �c
issuance of a 30 day temporary certificate of occupancy.
The applicant further agrees to demolish or remove ��
i completely the pre-existing structure within the 30 day �r
period following the issuance of the temporary certificate
'i of occupancy, at which time the county aqrees to issue a
final certificate of occupancy upon compliance with all •
'� applicable requirements. �n no event sha21 demolition occur
later than 18 months from the date of issuance of the
i building permit for the new residence. �

! 2. The Applicant agrees that he will not attempt to modify ,s'.,
this agreement by seeking to maintain the pre-existing ;,
structure as employee housing.

- 3. The county acknowledges that this Agreement meets the _ z
requirements of 53-8,11(d) that Applicant provide a written �
guarantee to demolish the pre-existing structure. �y : ;,
