SCOPE �� ''
The Scope of this document shall apply to all sizes and
types of incidents occurring within Pitkin County including but
not limited to all types of fires, ha�ardous materials� e:ctrica-
tion� dive/rescue, ambulancelemergency medical servi�e, transpo-
rtation� civil, natural, search and rescue� and other incidents.

WHEREAS� the District has st2tutory responsi6ility far �fire `� '�f
suppression, both structur�l and wildland, within its fire ' �'
protection district and, ;;;�;
WHEREAS, the District does not have any air6orne fire �� I
suppression equipment ior wildland fires, �nd may have to pay �'.:
directly �for this service on a case by case� as needed b�sis and, t'
;�. ,.
WHEFtEAS, the possihility e:sists that the District may be
liable far bearing the cost of fire suppression of a wildlznd
fire that origin�tes within its fire protection district but
escapea to anothar jurisdiction and�

WHEREAS, the District does not have insurance to cover the
suppression costs of an escaped wildl�nd fire and,

suppression for prairie and iorest (wildland) fires for those
areas ot private and State owned prc�perty within Pitkin County.
WHEfiEAS� the 3heriff is empowered by statute to call to his
aid such persons 2s he feels are necessary to assist him in the
per�Formance of his fire suppression duties� including calling
fire departments out of their respective fire prote�tion dis— '

crowd control along with security and investi�ation to all types

diction and� ��

'i WHEREAS, the Sheriff has been appointed hy County resolu— !';�;
tion the Designated Emergency Response Authority for hazardous ,
material incidents occurring within the unincorporated areas of
Pitkin County including federal� state and county highways and,
WHEREAS, both parties recognize � need for e�rh others
resour�es in order to fulfill their respective obligations and
are desirous of strttct�iring a mutually beneficial �greement�
NOW THEREFORE, in consideration of the premises and of the
mutual cvvenants and obiigatiuns set out below, the �ufficiency �

1 2.4 Each part� further agrees that upon request by either
party, each party shall provide to the other party without cost .

� it may have availahle by reason nf any funding� mutual aid, ,i
support or contractual �greements with any other agency or �

,•� III. AI�,ECTION AND CONTROL
� ' 3.1 It is mutually understood by both parties th�t the `
, amount and type of resour�es made available by the assisting
party to the requesting party under the terms of this agreement
;� shall be under the sole direction and control of tfie assisting � �
party. Notwithstanding the mutual obligations of response and �
assistance set out above� neitfier of the parties hereto shall be
required ta respond or assist to any e>ctent that� in its own �
opinion� would seriously jeopardize its own a6ility for respo�se
within its own jurisdiction.
3.2 It is mutually understood by both parties that any per- '
sonnel aho are �urnished will operate as far as possible under
their own supervisors, and any equipment furnished will ordinari-
Ly be operated by personnel of the agen�y praviding the equipment

4.2 It is mutually under-stood that each party will respond
to incidents in Pit�;in County under the terms oi this agreement
only where and when in the mutu�l opinion of both parties it is
deemed reasonable� necessary, appropriate and feasibl�.
- 4.3 It is mutually understood that at any time, specifical-
ly including the initial period of any incident the assisting •
party may in it5 sole distretion c�ll or reassign its resources •
from th�t incident provided th�t the requesting party is notified -
of any impending change in as timely a manner as possi6le and in %="�

V. PftOCUREMENT PROCEDURES "i:<

5.1 �nly the Sheriff or in his absence the Undersheriff or 3t; �

authorized to request the use of District resources under the *; I
terms of this agreement. That request shall be made to the Chief •
o-F the Fire Protection District or in his a6sence a Fire Bepart- �+ `�
ment Officer.
5.2 Oniy the Chie4 of the Fire Protection District or in
his absence a Fire Departm=nt Officer are authori<-ed to request
' . ._ . the use of 5heriff resources under the terms of this agreement.
Th�t request shall be made to the Sheriff or in his absence the -
Undersheriff or in tne ahsence of both a Sheriff's Department

� VI. MUTUAL RESF'ONSIBILITIES �..

6.1 Each party shall rem�in solely responsible at all times
fnr maintaining a complete, current listing af all of the
resources tnat it provides to the other party for the duration of
the incident.
6.� Each party shall remain solely respon5ible at all times
for ali salary� wages benefits or other compens�tion for any of �.
its personnel who may be responding to or involved in an incident y' ;
at the request of the otner party hereto. Said personnel shall _
- remain solely the personnel of the responding p�rty under its own � i
direction, control a�d supervision and shall not be deemed laaned '
or shared personnel. As such each party sh�ll retain the svle t.
responsibility �For providing unemployment and worlcmens' compensa- ,� `
' tion benefits for said per-sonnel. �' •!

6.3 Each party shall maintain all ne�essary insurance on
any of its equipment, vehicles and oiher physical f�cilities
, which may tae utilized pursuant ta this agreemenk.
6.4 Py responding to .n incident at the request of the
other p�rty, each of the respective parties hereto waives and �
releases any claim to which it might otherwise be entitled as a
result o4 damage to its property or injury to its person�el
incurred during said response, except where such claim arises out >
of gross negligence of the other party or its personnel. � `�`�""''

VII. MISCELLANEOUS �,� �i'

7.1 'fhis agreement does not supersede or supplant any other
pre-existing agreements or procedures not pert�ininq to the
' sub�ect matter contained herein on either parties part nor does
it abdicate �ny statutory reeponsibility on either parties part.
' 7.2 The terms of this agreement shall apply only for the �
� "initi�l period" of an incident. After rhe initial period has
� e�;pired, the �ssisting agency may request reimbursement from the � _
� requesting agency at a predetermined manpower and equipment rate ,.�
for any and all assisting agency resources that will be utilized '
` for that incident after the initial period of that incident. ��
i7.S Nothing in this agreement sh�ll be construed so as to
, prohibi± or in any way restrict the District from taF:ing any
�ctio� on incidents outside of the Fire Protection Distri�t
'; without prior request 6y the Sheriff where such action is deemed
appropriate by the District. In any SLlCi1 case, the District shall
notify the appropriate jurisdictional authority of that action as
soon as possible.
7.4 This agreement shall be in effect for a period of ane .1
i year from the date set out above and snall automatically renew _
thereafter for succeeding one year periods until formally "''
j cancelled in writing by either of the parties hereto. ;
