WHEREAS, the FAA and the County entered into a Memorandum of
� Agreement which specified certain responsibilities for installa-

.� " tion of a new Air Traffic Control Radar Beacon System (ATCRSS) at �
'� the Aspen/Pitkin• County Airport; and

WHEREAS, •the FAA and the County, based on changed circumstances
arising since the original Agreement, now desire to modify this � '

Agreement to change the various rights and responsibilities. � ;

NOW THEREFORE, said Memorandum of Agreement is amended in the
following respects and these only:
1. Article I, B. is amended to read in its entirety as follows:

"B. BASE BUILDING: The FAA shall provide all architectural� F'�:3'_.
mechanical, and electrical enqineerinq services for design :�}f;,;.
of the Base Building and parking area(s) to be constructed i;::,;.';
adjacent to or near the Aspen Airport Traffic Control Tower
' at a site(s) mutually agreed to by the parties. The County �
� shall provide all other services required for construction of �•
; the Base Building and parking area(s) in accordance with �
specifications provided by the FAA.° �

; 2. Article I, D. is amended to read in its entirety as follows: j

� "D. BEACON FACILITY: The FAA shall provide all architec-
tural, mechanical, and electrical engineering services for �
� design of the Beacon Facility. The County shall provide all
; other services required for construction of the Beacon
! Facility in accordance with specifications provided by the •
� FAA. The Beacon facility is to be constructed near the
! -_ � summit of Cozy Point, Pitkin County, at a specific locatfon
- - identified by the FAA.�� -
� 3. Article I, E. is amended to read in its entirety as follows:
! "E. BEACON FACILITY ACCESS ROAD: The County will acquire �
rights to design and canstruct an access road to the facility ��
and will so design and construct said road."
. 4. Article II,_B., first paragraph,_is amended to read as
i
follows: �
"S. The County and the FAA shall enter into four (4)
' . separate leases for the components of the project described
i in Article i, B.-E., as set out above. The leases shall have
terms of no longer than five (5) years with lease payments to
begin on a date of beneficial occupancy (DBO) ; the DBOs shall
be mutually agreed upon. Target DBOs for the Project shall ��y".�
! be: the access road, November 1, 1988; the remote site,
i February 1, 1989, and.the Base Building, April 1, 1989." :e

"The FAA will provide full-time Resident Engineer
services for the construction of the components of the
project set out in I.B. and I.D., according to the FAA,
Northwest Mountain Region, Airway Facilitiea Divieion, .
Resident Enqineer Guidelines dated September 1, 1988,
which are incorporated herein by this reference. The FAA
also will provide, through a contract with an independent
testinq firm, necessary construction-related soils '.i=�:��<.-.
