� and the Town of L+asalt acting tF�rough �nd on behalf of the Basalt
Police Department, ("Department").

In order to better serve and protect the residents and •, i
visitors ef F'it{:in County and the Town of Rasalts to promulgate
coordination and cooperation between the parties, to maximize the '
use of�limited resources, to facilitate the parties ability to
'" 4u1fi11 their statutory responsibilities �nd to formalize and
- document er.isting� informal, unwritten agreements and,
SCOPE
The Scqpe of this document sha21 apply to all sizes �nd :r
types of incidents occurring within Fitkin County and the Town of `
Basalt including but not limited to all types of fires, hazardous ¢
materials, extrication, dive/rescue, ambulznce/emergency medical
service, transportation, civil, natural, search and rescue, and
other incidertts.
WHEFtEAS, both parties have staEutory responsibilifies for
law enforcement and peace keeping within their respectiva
jurisdic±ions and,
WHEREAS, both parties have at times, limited resources to
fulfill their respective responsibilities and, :.`

NOW THEREFOkE, in consideration of the premises and of the
mutual covenants and obligations set out below� the sufficiency
of which is h�reby ack.nowledged by the respective parties hereto� •
IT IS AGREED AS FOLLOWS:

I. DEFINITIONS ; t-

AS5ISTING PARTY/AGENCY: An agen�y or party directiv contributing
resources to another agency for incident control purposes. -
ZNCIDENT: An occurrence r�quiring a�tion in order to prevent or
minimize potential injury, threat to life and/or damage to ;�
i property or natural resources. Everv incident requires a command `;�
presence.
! INITIAL ATTACK: Resources initially committed to an incident. j, i-
INITIAL PERIOD: The initial period of an incident shall be
defined as that period of time from initial response by either
agency'!intil 1�:UU A.M. of the day following that initial
� - response by either �gency.
� EXTENDED ATTACK: Resources committed to an incident beyond the
� initial period.
! REQUESTIIVG F'AFtTY/AGENCY: An agency or party asking for resources. �

RESOUkCES: All personnel and major items of equipment available,
or potentially availahle, for assignment to incident tasks on
which status is main�tained.
II. MUTUAL ASSISTANCE
� 2.1 In the event of any disaster or other incident occurr-
ing within Pitkin County or the Town of basalt the response to
which may be facilitated by the use of either party's resources, f
both parties mutu�lly agree to furnish under the terms of this
agreement, upon any reasonable request and at no cost� any and _ �"':
all aid, equipment, manpower, resources and assistance it may
' . h�ve available to the r�questing party on an actual or standby
basis for the initial period of the incident. 1

III. DIRECTION AND CONTkOL •

.1 It is mutually understood by both parties that the ;r�,_�.
amount and type of resources made available by the assisting +.#:.-,
party to th� requesting party under the terms of this agreement !--��"�<-
shall be ��nder the sole directien and control of the assistin❑ `�� '''
party. Notwithstanding the mutual obligations of response and ''r'�'
assistance set out above, neitner of the parties fiereto shall be f;
required ta respond or assist to �ny e:<tent that, in its own -
' opinion, would seriously jeopardixe its own ability �or response
� within its own jurisdictian. � ��':',,;;:
I 3.2 It is mutually understvod by both parties that any per— F1`
sannel wno are furnished �aill operate as far as possible under
their oan supervisors� and �ny equipment furni.shed will ordin�ri— ,
� ly be operated by personnel of the agency providing the equip— -_
ment.
� -- �.� When possihle, personnel and equipment from the
� assisting party should be used in support capacities to minimize
the e::posure to hazardous situations. An attempt should be made
S to use the aesisting agency's personnel so as to limit their
� involvement in subsequent criminal �uetice proceedings. �

IV. RESFONSE AND REASSIGNMENT
.
4.1 Tne respense o6ligations of both parties hereto shall
remain sub�ect �t all times to all current procedures, rules� �
regulations and statutery responsihilities of the respective
parties.
� 4.2 It is mutually understood that each party will respond .
to incidents in Pitkin County and the Town of basalt under the
terms ef this agreement only where and when in tl-�e mutual opinion _+�;,
' of both parties it is deemed reason�ble� necessary, appropriate
znd feasible.
4.3 It is mutu��lly understood that at any time� specifical— !' 1�
ly including the initial period of any incident, the assisting �
party may in its sole discretion c�ll or reassigr� its resources y� _
, from thrt incident; provided tn��t the requesi:inq party is �,

' V. PROCUREMENT FFOCEDURES •
5.1 Only the Sheriff or in his absence the Undersheriff ar '�``� '

in the absence of both a Sheriff's Department Patrol Director are r
authorized to request the use ef Department resources under the F�=`��'
terms of this agreement. That request shall be made to the Chief � '
� of the Department or in his absence the on-duty/omcall officer !`'.��
� of the Department. �
4 5.2 Only the Chie+ of the Department or in his absence the -
on-duty/on-call of�ficer ef the Dep�rtment are authorized to �
� request the use of Sheriff resources undEr the terms of this ,`
� agreement. That request shall be made to the Sheriff or in his �
i absence the Undersheriff er in the absen�e of both a Sheriff's �
` Department Patrol Director. . �' ',

'� �• VI. MUTUAL RESPON5I5ILITIES I� .

_ f b.i Each party shall remain solely responsible at all times -
for maintaining a complete, current listing snd st�tus of �11 0{
{ the resources that it provides to the other party for the
� dur�tion of the incident. � .

6.2 Each party shall remain solely responsible at all times t
for all salary, wages� 6enefits or otfier compensation for any of
� its personnel who may be responding to or involved in an incident
� at the request of the ather party hereto. Said personnel shall
. remain solely the personnel of the responding party under its own
� direction, control and supervision and shall not be deemed loaned
or shared personnel. As such, each party shall retain the sale
� responsibility for providing unemployment and worF;mens' compensa-
4 tion be�efits -For said personnel.

{ 6.3 Each party sha11 maintain insurance including t�ut not
limited to General Liability coverage and insurance on any af its •�
equipment, veFricles and other physical facilities which may be �s,r
utilized pursuant ta this agreement.
_ t 6.4 E+y resp�nding to an incidEnt at the request of the ` 1`�
i other party, e2ch of the respective parties hereto waives and �
� releases any claim to which it miglit otherwise be entitled as a q i
j restilt of darnage to its property or inSury to its persannel �'�
• incurred during said response, except where such claim arises out �
af gross negligence of the other party or its personnel.

6.5 Each party endorses and shall attempt to function and
oper�te as much as possible under ±he Incident Command 5ystem for
the duration of the incident.
6.6 Each party insures that all apprcpriate members of
their agencies/departments are hriefed en and become familiar j �
with this document. � -

6.7 Notwithstanding anything in this agreement to the � ;�:�+� ::
contrary, it is agreed by both parties hereto tl-iat either party !:;�`:9 .

7.1 This agreement shall be in effect until terminated in �,,i
� writing by either oi the parEies.

-- 7.2 The terms of this agreement shall apply only for the
initial periad of an inrident. In the event th�t resources are
provided for response to an incident after the initial period has
exFired� Eh� assis£ing agency may request reirotrursemertt from the
requesting agency at a predetermined manpower and equipme�t rate
fvr any and all assisting agency resources that will be utilized
for that incident after the initial period of that incident, "

;. 7.3 This agreement does not supercede or stipp]�nt any other
pre-e::isting �greements or procedures not pertaining to the �;
subject matter contained herein on either parties part nor does
it ahdicate any statutqry responsibility on either parties part.
7,4 Either party may in its sole discretion terminate this
Agreement upon thirty (�.��) days written notice to the other
party.
