AN ORDINANCE OF THE BOARD OF
COUNTY COMMISSIONERS OF PITKIN COUPITY, COLORAAO,
AUTHORIZING THE CONVEYANCE OF THE COUNTY
TRAILS SYSTEM TO THE CITY OF ASPEN, COLORADO
ORDINANCE NO. 88-� �
RECITALS
1. In accordance with Section 8.7.1 of the Pitkin County "`'
Home Rule Charter and pursuant to Resolution No. 86-90 the Board "�'�3 "
of County Commissioners submitted to the electorate on the ballot `•�i•�:::
for the general eleation held on November 4, 1986, the question ::'
• of whether the Board of County Commissioners should be authorized x'`-���' ,
to convey the County Trail System to the City of Aspen, Colorado, `
subject to a restriction that such property must be used for park �,`_: ,�.
or recreational purposes unless otherwise approved by the �:;•.�:' '
registered qualified electors of the City of Aspen, and upon such ;i°_:. i..,:
additional terms and conditions as the Board of County Commis-
sioners deemed necessary. ':���"�.` �:�
2. On November 4, 1986, the electorate of Pitkin County '�
authorized the conveyance of the County Trail System to the City
of Aspen, as described in Paragraph 1 above.
3. The County owns or has easements over approximately
twenty miles of trails located in the City of Aspen and the
unincorporated areas of Pitkin County. Both the City and County
- are lawfully authorizefl to acquire and maintain trails for the
purposes of hikinq, bicycling, equestrian, pedestrian, and
recreational uses. - ! ;� .

4. The County and the City entered into a joint maintenance '
and polioing agreement dated September 13, 1976, whereby the �

County assumed responsibility for the oosts of maintaining,
repairing, and siqning a11 of the trails within the City of t: :

Aspen. '

5. In accordance with the Trails Agreement between the �
parties, the County ,and the City desire to terminate the afore-
said agreement and to convey the County Trail System to the City
of Aspen because the City has a Parks and Recreations Department
because the City has demonstrated its willingness to budget for
this purpose, and because the trails serve as an Aspen metropoli- '.:
tan area resort amenity. � �
, NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF PITKIN COUNTY, COLORADO, AS FOLLOWS:

1. The County shall convey to the City of Aspen all its
right, title, and interest in and to all easements, rights of
way or dedications pertaining to or included within the County
Trail System.
2. With regard to those portions of the County Trail System �
in which the County holds fee simple title, the County shall
convey to the City easements for trails purposes. ` �

3. With respect to those portions of the County Trail � ''
System that cross parcels of land owned or held by Pitkin County �•���
for purposes other than trails, (including, without limitation,
the Jenny V. Lode, U.S.M.S. No. 5310, Tracts C-I, Lots 6, Ruby
5ubdivision, Northstar Nature Prsserve and Lot 8 of the Pitkin
; Reserve, but excluding Wagner Park), the County, to the extent of �;.,::�
its interest, shall convey to the City irrevocable, non-exclusive
• easements for trails purposes. Such trails shall be of suffi- ;
oient width (but not less than ten feet) for the purposes � 5
intended and consistent with and aomplimentary to the Trails �
'• System segments it adjoins. ;

4. All buildings and other improvements situated on the
� County Trail System, including fixtures and other property
� affixed thereto and all and singular rights and appurtenances
pertaining thereto shall be conveyed to tha City o£ Aspen.
5. The conveyance of property pursuant to this Ordinance
- ! shall be subject to a restrictive covenant prohibiting the use of
such property for any purpose other than trail, park, or other
recreational purposes unless othexwise specifically approved by �. .
the registered qualified electorate of the City of Aspen. -?
