1.� In accordance with Section 8.7.1 of the Pitkin County � ,::::;.::.
Home Rule Charter and pursuant to Resolution No. 86-90, the Board •-!.-•; .
of County Commissioners of Pitkin County, Colorado, submitted to ,'?�,`.,
the electorate on the ballot for the general election held on :�; :
November 4, 1986, the question of whether the Board of County
Commissioners should be authorized to convey Wagner Park to the -
City of Aspen, Colorado, subject to a restriction that the -
property must be used for park or recreational purposes unless
otherwise approved by the registered qualified electors of the :;;..�;..<; ;
City of Aspen, and upon such other terms and conditions as the ?��:"� ';. _:��
Board of County Commissioners might deem necessary. :� � ;

2. At the general election held on November 4, 1986, the
electorate of Pitkin County authorized the conveyance of Waqner
• � Park to the City of Aspen, as described in Paragraph 1 above.
3. The Board of County Commissioners desires to convey
- Wagner Park to the city because it is located in the city,
because it is maintained by the city, and because it is a urban
amenity.
NOW TAEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY � �
COMMISSIONERS OF PITKIN COUNTY, COLORADO� AS FOLLOWS: y:4 '

County, Colorado, is authorized to execute a deed conveying �,
Wagner Park to the City of, Aspen, Colorado, subject to the terms
and conditions of the Tr�ls Agreement between the City and the
County and subject to a restrictive covenant that such property ��

must be used for park or recreational purposes unless otherwise
approved by the registered qualified electors of the City of
Aspen.

WHEREAS, the County is the owner o£ that certain parcel of 's'`'

land in the City of Aspen located at 120 East Main Street, upon _

which parcel the Pitkin County Library is currently located, and; � a' '�
WHEREAS, RFTA has had a bus stop located at the curb of Main � � � • `

Street in front of the County's property for some tirae and wishes
to ereat and maintain a bus passenger shelter upon the County's � ,,
land for use by RFTA passenqers in connection with that bus stop, �
and;
WHEREAS, both the County and the Board of Trustees of the

Pitkin County Library are agreeabZe to the location of said "'r
shel'ter upon the County's land, provided that it does not �;�
' unreasonably interfere with the operation of the Library or the
ingress or egress of Library patron5 to the Library, '�
NOW THEREFORE, BE IT ORAAINED BY THE BOARD' OF COUNTY
COMMISSIONERS OF PITKIN COUNTY, COLORADO AS FOLLOWS:

hereby approved and adopted and that the Chairman of the Board of
