REPEALING ORDINANCE NO.87-37,AND AUTHORIZiNG
A CAPITAL CONTRIBUTION OF$100,000.00 TO THE ASPEN
VALLEY HOSPITAL DISTRICT FOR TI�CONSTRUCTION
OF THE ASSISTED LIViNG FACILITY

1. On June 22, 1987, the Board of County Commissioners approved '`:'. �;
Ordinance No. 87-37, providing for the County's contribution towards the '�'_�
constroction of an Assisied Living Facility, and establishing other arrangements �?..
between the Board and the Aspen Valley Hospital Disirict ("AVHD") for the
��;•.:. `,
construction 'of a 3enior Activities Center and a County Health and Human ;:: .,
Services Building on the AVHD campus. �� ,�'`� '`� `

2. The Boazd and AVHD now agree that the construction of the Heal.th ,
and Human Services Building by AVHD, and the development of Parcel A by
AVHD no longer represents the most praciical means to achieve the construction
of the Health and Human Services $uilding.
3. Since the development of Parcels A and B will not be undertaken by
- AVHD, the conveyance of property contemplated by Ordinance No. 87-37 is no
longer necessary. � ��

4. AVHD still plans to build the Assisted Living Facility the consuuction ��
of which is to the mutual benefit fo the parties. ;;;1

NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY '``
C011RNIISSIONERS OF PITKIN COUNTY,COLORADO,AS FOLLOWS: i;

Ordinance No. 87-37 is hereby repealed.
Sec�ion 2
- The Chairman of the Board of County Commissioners of Pitkin County,
- Colorado, is hereby directed to authorize a capital contribution towards the
funding of the construction of the Assisted Living Facility of $100,000.00 • �:'�.
payable within 30 days of the issuance of a building permit for the Assisted '�.,;;::
. Living Facility, and subject to the conditions specified in Seciion 3 below. r,�i ; ;

1. AVHD will build and operate an "Assisted Living Facility" on the hospital
campus as shown on the site plan, Exhibit "A: attached hereto, and shall
give first priority for residence to those living at the Pitkin County
Community Center at the time of issuance of a Certi�cate of Occupancy who .
otherwise meet the applicable medical and residency requizements
specified in Resolution No. 87-121.

2. The contribution authorized pursuant to Section 2 above will be refunded `�E=•�3.-
to the County if a Certificate of Occupancy is not issued within a reasonable ;�'`�!�';;
time as required by the Pitkin County Building Code. �

As used herein, the term "Assisted Living Facility" shall mean: a facility � ��
designed to serve elderly and others w6o need assistance, such as meal ` i .
prepara[ion, housekeeping, and activities of daily living but who do not need full �
time medical or nursing care; specificall�� refers to the project described in the � `� `,
General Submission application submitted by AVHD to the County.
Section 5
This Ordinance may be published after adoption by title and short
