PROVIDING FOR A SPECIA� ELECTION ON THE QUESTION

WHEREAS, the County of Pitkin in the State of Colorado (the ' .
"County" and the "State," respectively), is a duly created �
;.� political subdivision of the State, organized and operating as a
�:� home rule county pursuant to the general statutes of the State
1°`' and a county home rule charter (the "Charter") adopted pursuant
l� to the Colorado County Aome Rule Powers Act; and
WHEREAS, providing affordable housing for residents of the �
'� County is a recognized public purpose of the County, to which end
the County and City of Aspen have formed a joint housing
- �`.� authority and the Aspen/Pitkin Planning office has recently
��� issued an Affordable Housing Production Plan; and -
;?:'� WHEREAS, the Affordable Housing Production Plan identifies
the community's housing needs and suggests the following measures
to meet those needs:
"� o Financing/refinancing for individuals and projects.
,�:.;
,;,�� o Production of Low Income/Special Group rental units.
o Production of Single-Family Type Housing.
o Conversion of Mobile Home Parks.
o Enforcement of Housing Authority Guidelines.
o Combining community resources to meet the needs of
affordable housing fox employees.
o Amending the City and County Land Use Codes and Zoning Maps
as incentives to preserve and produce affordable housing;

WHEREAS, the Board of County Commissioners of the County ;
._ .� (the "Board") has determined that it is necessary and desirable
(i) to acquire land for, produce, finance, or otherwise provide
_`� affordable housing for County residents, (ii) to borrow funds in
the maximum amount of $6,000,00o for such purposes by the
issuance of bonds or otherwise, and (iii) to pledge revenues
_;,� accruing to the County from its general ad valorem taxing power, ;;:
without limitation as to rate or amount, as security for such ;:;.;E`.�°

WHEREAS, the Colorado County Home Rule Powers Act at C.R.S.
30-25-201 (6) (a) and (b) authorizes the county ��to contract an
indebtedness on behalf of the County and upon the credit thereof,
by borrowing money or issuing the bonds oE the County, for any �>�'•
public purpose of the County,...but no debt shall be created ti:�=
unless the question of incurring the same is submittefl, at a �t':•,..�
regular or special election of the County, to the registered �
electors thereof ahd a majority of the registered electors voting � � -`.
upon the question vote in favor of creating such deb£.'�; and
WHEREAS, Section 10.1.1 of the Charter provides as follows: �
-� "Limitations on Borrowing: No income, sales, excise, property,
transfer or any other tax, whether now in force or a new tax,
-� shall be committed in favor of any debt of the County unless and r .
until the commitment of the tax to the indebtedness and the
indebtedness shall be submitted to and approved by a majority of .
the electors voting at an election called for such purpose."; and -;

T' WHEREAS, Section 6.7.1 of the Charter provides as follows: i�'+::'
"Validity of Elections: No measure concerning tax increases or � '
;`:,:;-� an increase in the indebtedness of the County shall be valid
° until the measure shall have first been submitted to and approved
;�;='� by a majority o£ those actually voting in the election or
�� ane-sixth of those electors registered to vote-in the County at
::�� the time of the election whichever is -
, qreater."; and
+.`:���� WHEREAS, the City of Aspen and the Aspen School District
each have an election scheduled for May 2, 1989, and the City
has proposed a funding source for afPordable housing on such
_�'� ballot; and

WHEREAS, it is therefore necessary and appropriate to submit
:.,�-,� to the qualified electors of the County, at a special election to ,_
be held on Tuesday, May 2, 1989, the question set forth herein; '�s;
�� and
� WHEREAS, Section 6.4 of the Charter provides that "all
issues to be placed on... a special election ballot by the Board
;.4�� of County Commissioners shall be submitted to the Clerk and
'�' Recorder at least thirty (30) days prior to...the special '
`� election."

NOW, TAEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY

Section 2. The Board has determined, and hereby
determines that the interest of the County and the public
interest and necessity require (i) the acquisition of land for,
: production, financing, and other means of providing affordable `}° '
housing for County residents, (ii) the borrowing of funds for

such purposes by the issuance of bonds or otherwise, and (iii) � :.
the pledginq of revenues accruing to the County from its general
- ad valorem taxing power as security for such borrowing. ��.'.`

' � Section 3. Such borrowing may be incurred at one time or -
.,;;� from time to time in the maximum aggregate principal amount of

�� Section 4. Each such borrowing shall bear interest at a
net effective interest rate not exceeding l0� per annum if
T�� tax-exempt or 12� per annum if taxable, shall be payable within � '
•F=� 25 years from its date, shall be secured by a pledge of revenues a'�
,, �r accruing to the County from its general ad valorem taxing ; '
�; power, and shall be on such other terms as the County may
determine. Each such borrowinq may be evidenced by bonds, notes,
�:<n->y or such other evidence of indebtedness as shall be determined by
� the County.
` Section 5. The proceeds of such borrowing shall be
�!�`*� administered by the Aspen/Pitkin Housing Authority.
'�s`�� Section 6. Pursuant to Section 6.5 of the Charter, a
special election shall be held in the County on Tuesday, May 2,
�'� 1989, between the hours of 7:00 a.m. and 7:00 p.m. of said day,
��� at which there shall be submitted to the qualified electors of
;ti;, the County the question of borrowing funds, which question shall
be in substantially the following form:

Section 9. Absentee voting will be permitted for said
election in the manner provided by law. Regular ballots shall be
provided for absentee voters which ballots shall contain the same
question as that appearing on the ballot labels of the voting
machines. Absentee voters wfthin the limits of the City of Aspen ;.,,�;,�_ .
shall file applications for absent voters' ballots and completed .;",,
absent voters' ballots with the City Clerk at 130 S. Galena, �:�;,;���t;;.��
� Aspen, Colorado 81611. All other absentee voters shall file with ;'�;�"°.-
the County Clerk and Recorder at 506 E. Main St., Aspen, Colorado '`:;:��;._
81611. The City Clerk and County Clerk and Recorder are hereby
authorized and directed to deliver to one of the election judges �� �.",r:
;� for the absent voter polling place all absent voters' envelopes
� received prior to and including 7:00 p.m. on said election day. '
; The procedure for the casting of absent voter ballots shall be
� conducted in the manner set forth in part 1 of article: 8 of title
�:� 1, Colorado Revised Statues, as amended. Each absent voter shall ti
sign an affidavit stating that he is a qualified elector of the
� County and that he has not previously voted at said election. �,;
