�? WHEREAS, the Aspen Consolidated Sanitation District, �
„nj4�'. hereinafter "District", has applied to the Board of County

;.: � for approval of a Special Use Permit pursuant to Section 3-6 of s``

the Land Use Code for operation of a ground flisposal system for

WHEREAS, the - property is zoned RS-20, containing
�-q approximately 50 acres located on the terrace north of the Upper
� � Woody Creek Bridge more specifically described in Exhibit "A"; -

�':'"-�� WIIEREAS, the Board reviewed this application at a duly
� noticed public hearing on January 10, 1989, at that time evidenae
�',_� and testimony were presented with respect to this application;

- WHEREAS, the Land Application methods proposed herein could
be highly beneficial to �he land in question and could permit :�. ,

� the recycling and reuti2ization of nutrients from the digested
� sewage sludge, both of which are considered desirable; and

WHEREAS, the proposed program will be incompatible with

NOW, THEREFORE, BE IT RE50LVED by the Board that it does
hereby grant a SpeciaZ Use Permit for Five (5) Years from the ,:;��-"
� date hereof to Aspen Consolidated Sanitation District subject to ��

1. Review for Comgliance,

� a. The District's operations of the Site shall be
J reviewed at an annual public hearinq, unless
;� atherwise amended by the Hoard, in the month of
April starting in 1990, to address compliance with
.cS the aonditions of this resolution; �
`' "� b. The District shall provide the Board an annual ? � `�
,;�� letter of compliance from the Colorado Department
`� of Health.

r�� 2. Safetv and MonitorinQ Proqram. The District shall
'�`? continue to monitor soil, ground water, run-off,
'j;� vegetation, and odor as required by the Colorado ° -
�+ Department of Health's Domestic Sewage Sludge
,;s:y Regulations and the County odor limitation. The
� operation of the sludge disposal facility shall meet
- the objective perYormance standards set out below:
':;�� a. The District shall take such reasonable measures
�•;�j as may be required by the County, to monitor any
claimed contamination of domestic or other wells
'�� in the area which could be attributable to the
,1'+� operation of the site. The County may monitor
each well on a regular basis reporting the results
to the owner, the District and the Board of County
� Commissioners. Such program is to be carried out
at the cost of the District;
`��' b. If there is probable cause to suspect that the e
,�;:`� contamination of ground water has occurred, the
i County may order the District to monitor, at its
expense, each well claimed to have been �
confiaminated, with the results reported to the
t� awner and the Board of County Commissioners.
Thereafter, upon provision of thirty (30) days -
� prior written notice, the County will set a ` �
� hearing concerning the suspected contamination. �..
� At the conclusion oP such hearing, if there is � .e`�,
evidence that the District's sludge application �"°
operations are the cause of such contamination, � ,.
._j the County Commissioners may, as a condition of

this permit, order the District to install, at its '
expense, any and all devices, as may be necessary " -
to prevent future contamination and take such �-;.:.'
corrective measures as are deemed necessary for '
the protection of the public health and safety.

3. Reauired Performance Standards. The facility and site F� ?%
shaZl not be operated except in accordance with the
__ following standards:
a. Tn regards to odor, the applicants shall
�-��`:� incorporate the latest requirements of the State
;:;�:�'�1 � of Colorado odor regulations with the exception
'::�,: that the detectable odors shall not exceed a
".':s� volume of 7:1 at the perimeter of the site. The �?
'� � bistrict shall conduct such sampling and take snch � �•
-� measurements so as to further investigate the
-_F_� feasibility of the 7:1 standard, and to develop
correlation, if any, between the 7:1 standard and
,V��:;;� potential complaints concerning odors from the
� site. The odor standard shall be discussed in the
:,,�;;,_i annual review to determine it's appropriateness; �
{:�,,�� b. The applicants shall comply with the Iatest .
' �= requirements of the Colorado Department of Health
:�j;y�:,� Domestic Sewage Sludge Regulations;
��L� c. Surface run-off from the site shall be contained
� entirely within the site, and if practical, run-
off from adjacent locations, shall be diverted
`'?,^� around the site to natural drainage channels;
F�� d. The noise level shall not exceed 75 decibels at
'�'� the perimeter of the site;

e. Sludge applied to the site or other material
.w}?� resulting from disturbanaes of the surface in
`� connection with the operation at the site shall be
retained and managed in a fashion that prevents
potential pathogens from leaving the site;

f. The applicants sha11 keep their qates locked,
� provide adequate signs and maintain the perimeter
i fencing on the site; ti;;.

g. The District shall provide to the County all �
- results of soil and vegetation monitoring tests `:'�,t�'�b,'•

��M�;� 1. Work smaller areas when mixing the sludge
� into the soil;

3. Maintain a "log" of when odor conditions

= to establish optimum site use times;

n. The applicant shall continue to keep abreast of Z�:`•
alternative treatment methods and seek other 6:�;- '_
disposal areas which would utilize sludge for
agricultural uses;

� security, visual impacts, composting and
i alternative treatment methods, made by the
applicant in their application and public meeting
-' shall be adhered to unless otherwise amended by �
other conditions (a transcript of material
� representation is attached as Exhibit "B") ; �

�.y�� require an amendment to this Special Review Use
' Permit;

',� q. No soZid wastes other than soil cover material and

disposed of on the site; stabilized digested
`;.� sewage sludge shall be as defined in Colorado

`'� r. The Applicant shall provide a written report 45
�;:a� days prior to the annual hearing on alternative
treatraent methods and composting efforts;

Ly, s. The annual report shall be submitted to the
•:j:;� Planning Office for review, 45 days prior to

:�•:,� _ annuaZ hearing.
4. Violations: Hearings. In the event that the County
determines that probable cause exists to suspect that
_ the District is not acting in compliance herewith, the
- County, upon provision of thirty {30) days prior �
written notice, may require a public hearing to
�""t. determine whether non-compliance has occurred. At such
;:;;} hearing, the District and the county shall have the k
- right to present evidence to the Board concerning i
noncompliance. At the conclusion of such hearing, if !�.
there is a preponderance of evidence of non-compliance, ; : •
� the BoaYd of County Commissioners may amend the Special
Use Permit imposing such additional, reasonable
;,� conditions for the protection of the public, or -;;;, .,
,�,� adjacent lands; or (in the case of willful, continued
violation of the conditions hereof) may revoke said �
