F;. � WHEREA.S, the Board of County Commissioners of Pitkin County, Colorado reviewed the proposed Brush Creek Water District t �y.,_- s Service Plan at its regulaYly scheduled meeting on March 28, �::� 1989; and .; _ 9L':. '�- WHEREAS, the Planning Commission reviewed the proposed plan �.� .. '� on March 7 and 28, 1989; and ,-� .;;t.:;� Wf�AS, the Planning Commission had concerns with the land •;,,�� use implications of the plan as initially proposed, and ,. requested that the applicant amend the plan to assure that fi�� service to the Brush Creek Village Subdivision would not result _ts ..r�., in compromising other County land use goals; and �.� WHEREAS, the applicant amended the proposed district service r;� ,; c�'. plan to address some of these concerns; and WHEREAS, with conditions imposed on the district and additional amendments made to the same plan, the Planning 4� Commission is confident that the proposal can adequately address ,: ;"'� the prior concerns of �he Planning Commission; and �fi � ti�_RF.Afi� the Board makes the folZowing findings regarding �' � '� the proposed special district: ,� 1, � :^ ; � l. The facility and service standards of the proposed F�:,.- i special district are compatible with the facilit and Y {.•-�'� service standards of Pitkin County, City of Aspen, Town �< - of Snowmass Village and Snowmass Water and Sanitation ��:i=: District; �`' ' 3. The proposal is in substantial compliance with the �'°'` . ; Pitkin County master plan adopted pursuant to section `' �' - 30-28-106, C.R.S.; r.'' ^ j 4. The proposal is in compliance with the NWCOG 208 Water �' r;:<�I Quality Management plan; �=`� 5. The creation of the proposed speciaZ district will be �' in the best interests of the area proposed to be �;, �,. ;. - served. ti<:. -�' NOW, TI�REFORE, BE IT RESOLVED that the Board of County Commissioners of Pitkin County, Colorado approve the Brush Creek � .. •2.;a;- _' Water District Service Plan with the following conditions of ,?�:� r:.;'��'..". approval: �R'::" 1. All parties acknowledge that the potential for the failure of individual septia systems within the �3` subdivision will be increased based upon the increased . .��''`��� consumption of water after the installation of the new ''�''ti` water system, in conjunction with the natural limitations in this area on the performance of >�;�: , 5�,�:�� individual sewage disposal system. Implementation of ` �'� +�;:- the Service Plan is at the risk of the homeowners with =�;,�;-< respect to the potential for the failure of septic �:�:y� systems and erosion or landslides. If this occurs, any -°°, violation of State or Local regulations regarding �='-^ individual sewage disposaZ systems and water quality `� must be corrected at the expense of the homeowners. The plan� shall be amended to state that the district shall p rsue planning the installation of a sewer - system. -=j 2. All costs to the residents of Brush Creek Village for ; ,� connection to water sezvice shall be financed by the � - _ proposed individual homeowners. ;,:'i .:. ,,j �,�, � 3. The district shall submit to the County for review and approval any water rights selected for purchase. Any material deviation in the r:! Service Plan from the parameters referenced below will require the approval of the Board of County w:`== `l Commissioners: ia. Approximately 60 acre feet of water will be �`� ,: ; required for the district to operate under the service plan; the actual amount of water required �` to service the district is anticipated to be .11 S cubic £eet per second; � ;`;;'_� b. $100,000 has been set aside for the purchase of water rights; and ` � ':;,;„j�. �-�4y c. Minimum stream flows established for Snowmass ;� � < � Creek will not be affected. �� ` � �__4� 4. Any raw water storage or other facilities required for � the service to the district or by the Snowmass Water '�'=''� and Sanitation District shall be first approved by the �u;=�;?Y� County under its Codes for a 1041 review or extension --• :� of major utilities. �.y, �"�� 5. Upon formation, the District shall adopt regulations for water conservation, water curtailment during .:-;!j�, drought and compulsory plumbing codes like those ;;�.r�^ adopted by the City of Aspen. These proposed ��;�:;; requirements are subject to approval in accordance with the intergovernmental agreement identified in condition ;� _ #, Y �� h 6. The facilities installed by the district shall meet �i.;�=' AWWA standards. .��`' 7. The district shall enter into an intergovernmental ;?i.. �`"_�;: agreement among the County and the Snowmass Water and ! _ :�'a: Sanitation District or the City of Aspen to ensure that "{�' all facilities are consistent with established County ' ;`_,�±;� general regulations as well as the requirements of the � ;� � district. The agreement shall insure that the system is designed exclusively for the use of the Brush Creek Village Subdivision and shall be limited to that use. - The water line shall be sized to serve only the Brush . Creek Village Subdivision. Implementation of the service plan must be preceded by compliance with applicable provisions of Section 5-400 - ; (1041 regulationsj of the Pitkin County Land Use Code. y;;-, � This includes not only site selection and construction � of the major extension o£ a water system, but also any , � potential 1041 hazard areas. In addition, the district must coordinate with the County and obtain the County's ��^` � approval for any construction within the Brush Creek ii::.r � ,i Road right-of-way or any other County Road. The ,,,;, district is responsible for its own costs in any such •-=;t;'; installation and repair to any public facility as a � result of such installation and repair to any publio facility as a result of such installation. r ' ir�'�� 9. A conneotion to Aspen may remain as an alternative p . t;�{ source but under no circums tances, h o w e v er, s hall a - line be extended through the Owl Creek Valley.
