-( NOW, THEREFORE, BE IT RESOLVED, by the Pitkin County Board `�

'.':� 1) A written agreement shall be negotiated between the
Applicant and the Board of Directors of the Gateway
��;� Homeowners Association regarding the Applicants' -
�:y-,� acceptance, of the Gateway Water Treatment Plant filter
unit backwash discharge into ponds located on the
:-,� Applicants lots. Said aqreement sha11 be made prior to
issuance of a buildinq perntit.
'�� 2) A site specific sewage disposal system such as an
� engineered mound or a system of similar design shall be
�A,� designed for the site prior to issuance o£ a building
permit. - :`

- 3} The proposed residence shall be allowed one fireplace
aad ona certified wood stove and shall comply with
''� applicable Pitkin County Air Quality regulations in
"a� effect at the time of issuance of a building permit.

�� 4) County noise regulations sha1Z be adhered to during
,'� aonstruction of the proposed residence pursuant to z
Section 2-23 of the Pitkin County Land use Code. {
;� 5) Prior to recording of this document, the Oh-Be-Joyful
Homeowners Association shall, by a two thirds vote,
,.'� amend paragraphs one (1) and seventeen (17) of the Oh-
Be-Joyful Protective Covenants to allow the building i `

Protective Covenants, paragraph number one, which
