WHEREAS, Pitkin County, a Colorado Home-Ru1e County, is the C;�
# owner, sponsor and operator of the Aspen-Pitkin County (Sardy
;,,� Field) Airport, located in the vicinity of Aspen, Colorado, and has
-,- authority to regulate aommercial activities and to license space,
and commercial operations at the Airport, pursuant to, inter alia,
" 1973 C.R.S. 30-35-202, 41-4-101 et sea•, Titla IV of the Pitkin -
,4� County Code, Section 8.7 of the Pitkin County Aome Rule Charter; '

WHEREAS, Pitkin County desires to enter into a Contract
T Agreement with the Aspen Chamber Resort Assaciation (ACRA) for the
:;;,� purpose of providing Guest Services at the Aspen-Pitkin County '
�� Airport, under the terms and conditions of the Contract Agreement
attached hereto as Exhibit "A"; and
'�``� WHEREAS, on the recommendation of Staff, the BOCC finds that
';;��� the Contract Agreement }s in the best interest of the County, and
;;� its guests. � -

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF PITKIN COUNTY, COLORADO:

t �; Section l. The Chairperson, or Vice-Chair of the Board of �'
`¢'�; County Commissioners is hereby authorized and directed by the Board
of County Commissioners to sign this Resolution, and the Contract
�� Agreement which are necessary to execute the Agreement Dated
Decemher �, 1989, on behalf of Pitkin County.
Section 2. This Resolution, and Contract Agreement shall �
be available for public inspection during nornal business hours in ';�,
the office of the Pitkin County Clerk and Recorder, Pitkin County �' '
Courthouse, 530 E. Main, Aspen, Colorado. �

WHEREAS, the County and the ACRA desires to provide for
j informational and other "Guest SeYVices" to tourists and air
y.� travelers to the Aspen and Snowmass area arriving through the -
Aspen-Pitkin County (Sardy Field) Airport during the 1989-90 ski

'=�`� THE COUNTY'S OBLIGATIONS ARE AS FOLLOWS:

4<� 1. To provide the ACRA access to an information desk in the ^
� arrivals/baggage claim area of the commercial terminal -
• "`� (attached as Exhibit "A"), and all informational and
directional signs, which in the sole discretion of the
��'`x� Director of Aviation may be necessary therefore, inside and
-� outside the commercial terminal building.

contact") responsible for carrying-out all County obligations,
� and assuring ACRA compliance with obligations set forth within

County SherifE's Department shall be reasonably available to �,;... :
provide support and assistance to ACRA employees when -
necessary, especially in the case of emergency and civil l�;;
disturbances. The County's authorized representative and �.

in Guest Services activities under this Agreement.

with airport travelers.

� ya d. shall be responsible to initiate help and assistance to

y:i �� ACRA, and maintain appropriate personal hygiene.

the periods identified for employee "breaks", or if 3

�"'� 3. To provide no less than ten (IO) total employees for the �
Airport Guest Services program. To provide no less than one
(1) trained supervisory employee per eight (8) hour shift.
Supervisory employees shall be responsible €or supervising the
- work and performance of all ACRA employees during each -�
respective shift. Minimum staffing levels per eight (8) hour :y '

5. To provide training and instruction for all ACRA Guast Service r= `"= �
`' � employees including: CPR and first-aid, Guest Service
personnel policies and regulations, and basic airline �'�� ,

� 3 6. The ACRA's representative shall submit a written status report �
� � of the Guest Service program to the Director of Aviation, or
i ' his authorized representative, on at least a weekly basis. � `
This report may be the same as that provided to the President

`1;;� 7. To be solely responsible to compensate and provide bene.fits �::`,
" for ACRA employees provided £or under this contract.

�y:.,, 8. To provide employees with suitable dress and attire. Uniforms
shall be selected in coordination with, and input from the
�,;,�;, Director of Aviation. ACRA employees shall be required to
.;.;E; dress in the issued uniforms during all duty hours.

arising out of any act which may be brought, asserted, or
���� established against the County for or on account of the ACRA,
-"i:� its agents or representatives, or employees under this

� `� 10. To provide workmen compensation insurance in the limits ;
�,�"r� required by law, public liability insurance, personal injury, '
and property damage insurance witih limits of at least '��
`?n;� $1,000,000 per occurrence for public liability, and $1,000,000
��;-:r for property damage. . __ Satisfactory evidence of all such
- -'insurance must be provided to the County.

`�'� 11. The ACRA, its agents or representatives, and employees shall
.,Y�:'-�' comply with all County and Airport rules and regulations and ��

�`-�">`"` directives as reasonably promulgated by the County. �
12. The ACRA, its agents or representatives, and employees shall 3 •
be required to report any violation of airport regulations,
- or other local, state or federal laws immediately to the
Director of Aviation or his authorized representative.
- Employees may also be required to submit written and/or verbal _
witness testimony on behalf of the County, if such testimony 7xs

i reserves the right to reject any ACRA employee based upon the

'��;=h provisions set forth herein, the other party may submit written
- notice of noncompliance. If such noncompliance is not remedied -
'�= •;�y� with ten (10) calender days, written notice of Agreement
;�-�; cancellation shall be mailed, return receipt requested, -and the
�r-s:� Aqreement cancelled thirty (30) days after the date of receipt.
