I i INCIDENT: An occurrence requiring action in order ta prevent or minimize potential in]ury, threat to life and/or damage to property or natural resources. Everv incident requires a command ;}�s;-':";;, i pr"esence. �, ; 7 ' i INITIAL ATTACK: Resources initially committed to an incident. � " � ��.:;:;: T� i INITIAL PERIOD: The initial period of an incident shall be �'�' ` ;j defined as that period of time from initial response by either � agency until 10:00 A.M. of the day following that initial i response by either agency. � EXTENDED ATTACK: Resources cammitted to an incident beyond the e initial period. ^ ' i% REQUESTIN6 PARTY/AGENCY: A� agency or party ask.ing f or resources. � ' RESOURCES: All personnel and major items ot equipment available, or potentially available� for assignment to incident tasks on whi�h status is maintained. III. DIRECTION AND CONTROL S�} ' 3.1 It is mutually understood by both parties that the �'ari.' amount and type of resources made availa6le by the assisting ,�s � � party to the requesting party under the terms of this agreement �r`i shall be under the sole direction and rontrol of the assisting I;�`,....;`` party. Notwithstanding the mutual obligations of response and � � � assistance set out above, neither of the parties hereto shall be I required to respond or assist to any extent that� in its own � opinion� would seriously jeopardize its own ability for response within its own jurisdiction. ' 1 �y '1 3.2 It is mutually understood by both parties that any per- 'j i � sonnel who are furnished will ❑perate as f ar as possible under 1 � their own supervisors, and any equipment furnished will ordinari- ;,� " ,� ly be operated by personnel of the agency providing the equip- '�1_'� :;� ment. :� 3.3 When possible, personnel and equipment from the .� assisting party should be used in support capacities to minimize the exposure to hazardous situations. An attempt should be made _ ;; to use the assisting agency's personnel so as to limit their � involvement in subsequent criminal justice proceedings. c } t ,� � IV. That request shall be made to the Chief oF the Department or in h�is absenre the Sergeant of the Depart- ' ment or in the absence of both the on-duty/on-call a4ficer of the � Department. 5.2 Only the Chief af tfie Department or in his absence the • r - Sergeant qf the Department or in the absence of both the on- �1 ` duty/on-call officer of the Department are authorized to request ' � the use of Sheriff resources under the terms of Ehis agreement_ f�"' a'�:-`:, -�, ! That request shall be made to the 5heri4f or in his absence the ��.'f;•;"; �l Undersheriff or in the absence of both a Sheriff's Department p ? .. i Patrol Director. ! ,� VI. MUTUAL RESPONSIBILITIES 6.1 Each party shall remain solely responsi6le at all times _ . tor maintaining a �omplete, current listing, and status of all of "`3 the resources that it provides to the other party for the '�i duration of the incident. : � Z' 6.2 Each party shall remain solely responsible aE all times ,� for all salary, wages, benefits or other compensatian for any ❑f its personnel who may be responding to or involved in an incident at�the request of the other party hereto, Sa3d personnel shall �i;I remain solely the persannel of the responding party under its own �:K direction, control and supervision ancE shall not be deamed loaned ;� ❑r shared personnel. I within the jurisdiction of tne other party without prior request � ( from that party, where such action is deemed by the party taking f � ' J the action necessary to prevent or minimize immediate threat of Iharm to life or property. In any such case, the agency taking : , initial action shall notify the appropriate ,i«risdictional agency � ,;; of that action as soon as possible_ �c'-=��'' ' ` � � ` � :� V I I. TERMS ���.,t` I j-t;;,::' . � .� 7.1 This agreement shall be in etfect until terminated in S ( � writing by either party upon thirty (30) days written notice to �:a the other party. i � 7.2 The terms of this agreement shall apply only for the j initial period of an inc3dent. In the event that resources are = :� provided for response to an incident after the initial period has f expired, the assisting agency may request reimbursement from the � . ,�i requesting agen�y at a predetermined manpower and equipment rate � -for any and all assisting agency resources that will be utilized i • a for that incident a-fter the initia2 period of that incident. � ':;� 7.3 This agreement does not supercede or supplant any other ,, pre—existing agreements or procedures not pertaining to the sub.iect matter contained herein on either parties part nor does , .;,s' �� it abdicate any statutory responsibility on either parties part. � a� ';.i � ,;� ._ �.:i �t�:6.
