In order to better serve and protect the residents and

maximize the use of limited resources, to facilitate the parties �
ability to fulfill their statutory responsibilities and to
�i formalize and document existing, informal, unwritten agreements

%� The Scope of this document shall apply to all sizes and j
types of incidents oc�urri�g within Pitkin County and the Town of ,
Snowmass Village including but not limited to all types ot fires,
hazardous materials� extrication� dive/rescue� ambulance/emergen—
�y medical service, transportation, civil� natural, search and
res�ue, and other incidents. -s,
WHEREAS, both parties have statutory responsibilities for
Flaw enforcement and peace keeping within their respective
]urisdictions and�

( WHEREAS� both parties have at times� limited resources to 'i. '
Ifulfill the3r respective responsibilities and� r�� �
iWHEREAS, each party has some resources that would be ,'��
� beneficial to the otl�er party in fulfilling its statutory

NOW THEREFORE, in cansideration of the premises and of the

i INCIDENT: An occurrence requiring action in order ta prevent or
minimize potential in]ury, threat to life and/or damage to
property or natural resources. Everv incident requires a command ;}�s;-':";;,

i INITIAL ATTACK: Resources initially committed to an incident. � "

T� i INITIAL PERIOD: The initial period of an incident shall be �'�' `
;j defined as that period of time from initial response by either
� agency until 10:00 A.M. of the day following that initial
i response by either agency.
� EXTENDED ATTACK: Resources cammitted to an incident beyond the
e initial period. ^ '
i% REQUESTIN6 PARTY/AGENCY: A� agency or party ask.ing f or resources. � '
RESOURCES: All personnel and major items ot equipment available,
or potentially available� for assignment to incident tasks on
whi�h status is maintained.
''�� II. MUTUAL ASSISTANCE
:�� 2.1 In the event of any disaster or otner incident occurr—
ing within Pitkin County or the Town of Snowmass Village the
� response to which may be facilitated by the use of either par£y"s ,,,
resources, both parties mutually agree t❑ furnish under the terms i.
y ot this agreement� upon any reasonable request and at no cost� ��
any and all aid� equipment� manpower, resources and assistance it �
�� may have available to the requesting party on an actual or ,
! standby basis for the initial period of the incident. `.�` '

� tual agreements with any other agency or private or governmental
entity.
III. DIRECTION AND CONTROL
S�} '
3.1 It is mutually understood by both parties that the �'ari.'
amount and type of resources made availa6le by the assisting ,�s � �
party to the requesting party under the terms of this agreement �r`i
shall be under the sole direction and rontrol of the assisting I;�`,....;``
party. Notwithstanding the mutual obligations of response and � � �
assistance set out above, neither of the parties hereto shall be
I required to respond or assist to any extent that� in its own �
opinion� would seriously jeopardize its own ability for response
within its own jurisdiction. '

'1 3.2 It is mutually understood by both parties that any per- 'j i
� sonnel who are furnished will ❑perate as f ar as possible under 1 �
their own supervisors, and any equipment furnished will ordinari- ;,�
" ,� ly be operated by personnel of the agency providing the equip- '�1_'�
:;� ment.

3.3 When possible, personnel and equipment from the
.� assisting party should be used in support capacities to minimize
the exposure to hazardous situations. An attempt should be made _
;; to use the assisting agency's personnel so as to limit their �
involvement in subsequent criminal justice proceedings.

,� � IV. RESPONSE AND REA5SIGNMENT
� 4.1 TI-�e response obligations of both parties hereto shall
� remain subject at all times to all current pro�eduras, rules,
j regulatio�s and statutory responsibilities of the respective
� parties.
�:� 4.2 It is mutually understood that each party will respond
to incipents in Pitkin County and the Town of Snowmass Village ;:
,� under the terms o-f this agreement only where and when in the g
� mutual opinion of both parties it is deemed reasonable� neces- C"
sary� appropriate and feasible. :i
4.3 Tt is mutually understood that at any time, specifical- -�
ly including the initial period of any incident� the assisting - _
? party may in its sole discretion call or reassign its resources ,{, .'
from ihat incident; provided tfiat the requesting party is r_ "
: notified of any impending change in as timely a manner as
� possible and in doing so the assisting party does not thereby -' ;�

' V_ PR�Cl.lREMENT PROCEAURES

5.1 Only the SI-�eriff or in his absence the Undersheriff or '��':;=�

in the absence af both a Sheriff's Department Patrol Director are fc'�:,'-":
authorized to request the use of Department resources under the n.�"`�; -
terms of this agreement. That request shall be made to the Chief
oF the Department or in h�is absenre the Sergeant of the Depart-
' ment or in the absence of both the on-duty/on-call a4ficer of the
� Department.
5.2 Only the Chief af tfie Department or in his absence the • r -
Sergeant qf the Department or in the absence of both the on- �1 `
duty/on-call officer of the Department are authorized to request '
� the use of Sheriff resources under the terms of Ehis agreement_ f�"'

-�, ! That request shall be made to the 5heri4f or in his absence the ��.'f;•;";
�l Undersheriff or in the absence of both a Sheriff's Department p ? ..

,� VI. MUTUAL RESPONSIBILITIES
6.1 Each party shall remain solely responsi6le at all times _
. tor maintaining a �omplete, current listing, and status of all of
"`3 the resources that it provides to the other party for the
'�i duration of the incident. :

6.2 Each party shall remain solely responsible aE all times
,� for all salary, wages, benefits or other compensatian for any ❑f
its personnel who may be responding to or involved in an incident
at�the request of the other party hereto, Sa3d personnel shall
�i;I remain solely the persannel of the responding party under its own �:K
direction, control and supervision ancE shall not be deamed loaned
;� ❑r shared personnel. As such� each party shall retain the sole -
:� responsibility for providing unemployment and workmens' compensa-
tion benefits for said personnel.

,� 6.3 Each party shall mai�tain insuranre including but nat
.� limited to General Liability coverage and insurance on any of its �',e
`! equipment, vehicles and other physical facilities whi�h may 6e j
;� utili�ed pursuant to this agreement.
6.4 Ry responding to an incident at the request af the
j other party* ea[h of the respe�tive parties i-iereto waives and -
� releases any �Iaim t❑ which it might otherwise be entitled as a =n ^r -
i result of damage tv its property or in�ury to its personnel �`.< �,:`

6_5 Each party endorses and shall attempt to runction and
operate as mucn as possible under tl�e Incident Command System for
the duration of the incident.
� 6.6 Each party insures tnat all appropriate members of
j their agencies/departments are briefed on and become familiar ;,�•:,.

i b.7 IVotwithetanding anything in this agreement to the � �
contrary, it is agreed 6y both parties hereto that either party
may but is not obligated to take initial action ❑n incidents a..:.
I within the jurisdiction of tne other party without prior request �
( from that party, where such action is deemed by the party taking f � '
J the action necessary to prevent or minimize immediate threat of
Iharm to life or property. In any such case, the agency taking :
, initial action shall notify the appropriate ,i«risdictional agency � ,;;

� .� 7.1 This agreement shall be in etfect until terminated in S (
� writing by either party upon thirty (30) days written notice to
�:a the other party.

� 7.2 The terms of this agreement shall apply only for the
j initial period of an inc3dent. In the event that resources are =
:� provided for response to an incident after the initial period has
f expired, the assisting agency may request reimbursement from the � .
,�i requesting agen�y at a predetermined manpower and equipment rate
� -for any and all assisting agency resources that will be utilized i •
a for that incident a-fter the initia2 period of that incident.

':;� 7.3 This agreement does not supercede or supplant any other
,, pre—existing agreements or procedures not pertaining to the
sub.iect matter contained herein on either parties part nor does , .;,s'
�� it abdicate any statutory responsibility on either parties part.
