BETWEEN
PITKIN COUNTY, COLORADO

' WHEREAS, the Forest Service has the responsibi2ity to issue Special Use �=�
, Permits and other approvals for development and land use activities on National �`y:
� Forest lands; and ��� � .'

WHEREAS, the County exercises jurisdiction over proposed development and �;_r�•�;.,
-`' land use with the County pursuant to the Pitkin County Land Use Code and
�g Building Code, as provided by Colorado law; and
pWHEREAS, it has been jointly determined by both the Forest Service and the
j County that the further coordination of their respective authorities is in the
best interest of the parties and the public. ..
' � WHEREAS, the Memorandum of Understanding for Land Use Planning
� Coordinatton of 197�+ between the parties should be supplemented with ;
�+ appropriate procedures for coordination and information sharing, without �.�
:I interfering with the respective jurisdiction of the parties.
NOW THEREFORE, in consideration of the above premises, the parties hereto.

.� A. DUTIES OF THE FOREST SERVICE. �'
i 1. The Forest Service shall notify the County by mail to the County
�_� Planning Department within fifteen (15) days of the date any aAplication
£or a Special Use or other permit for any development on National Forest
lands located within Pitkin County is deemed complete snd accepted For �p
,1 processing. 'i

2. The noti.ce referred to above shall state the nature of the application,
+ shall speciFy a thirty (30j day time period for the County to comment on " ,
the application, and shall be addressed as £ollows:

A copy of such notice shall be forwarded to the applicant.
, � 3. The Forest Service shall consider the comments of the County in making
its decision, and shall notify the County of its decision by mail on the
date that notice is made to the applicant. - � :

4. Any permit issued by the Forest Service shall place the permittee on F
notice of the need to comply with applicable County regulations, including ,�'�
applicable requirements of the County Land Use Code and Building Code. In A s
the case of a Special Use Permit or Operating Plan, the notice shall read ��� �'-`
as follows, in accordance with existing practice: ' ` '

; 5. The Forest Service shall not Fail to notify the County of the receipt
� of an application based upon its belie£ that the County lacks jurisdiction
over the proposed development. As part of the not3ce required herein, the
Forest Service may comment upon the scope of County jurisdiction. However,
the exiStence or non-e�cistence of County jurisdiction is a matter to be
resolved solely between the County and the applicant, tuiless the Forest
' ' Service determines that Federal Law has occupied the field or that there is
� confZict between federal law and the County's position or that the County's �;
position obstructs the execution of federal law.

6. The Forest Service shall meke available for review by the County upon
5 requests any information received as part of any application which is not
a privileged from disclosure.
( B. DUTIES OF THE COUNTY. -

� 1. The County shall notify the Forest Service by mail, to the District
Ranger for the District in which development is proposed, within fifteen
,� (15) days of the date upon which an application for Land Use Code or .
Building Code epproval for development within the National Forest is deemed

complete and accepted for processing. �s'
2. The notice referred to above shall state the nature of the application
j and specify a thirty (30) day time period for the Forest Service to comment 'l'�
j on the applicat3on, and

I C. OTfiER PROVISIONS. '
i
j 1. As used in this Memorandum oF 13nderstand3ng, "development" shall mean
any construction or activity which chenges the character or use of the land '
that is the subject of the application, and shall include, without
; limitation, the construction of any building or structure or additions and
' ` improvements thereto, the construction or improvement of any public or
{ private road or right-of-way, any mining or mining-related activity, and {
' the construction or improvement of recreational facilities including
� trai.ls, camping areas, and downhill or cross-country skiing facilities. -
� This shall not include construction of structures or other facilities
� solely owned and operated by the Forest Service or such temporary
� short-term uses as the Guide and Outfitter permits, geophysical permits, _
� Filming of commercial advertising, weddings, bicycle races, and the like.
Permits for the maintenance of irrigation structures are also excluded.
2. The parties agree to provide the maximum cooperation possible, within
the availability of Funds, manpower and establ3shed laws, regulations, and
policies governing the parties, to assure a process satisfactory to the
needs of both the Forest Service and the County. It is the primary purpose t��:
of this Memorandum oF Understanding to assure both parties of adequate
notice of proposed development within the National Forest. � �

While it is recognized that legitimate diFferences may exist in individual
cases regarding the jurisdiction of the parties, neither party will benefit
by a failure to cooperate and share information, and affected third parties
� r should be advised at the earliest opportunity of jurisdictional matters.

4 3. Nothing herein shall be construed as obligating the parties to expend ' .

5. This Memorandum of Understanding shall remain in effect for five (5) -
� years unless sooner terminated by mutual agreement of the parties, or '_'
unilaterally by a party with thirty (30) days prior written notice. �
