WHEREAS, the County has agreed to accept the maintenance . `�"

responsibilities for roads within the orchard Estates Subdivision �(�� � �

economical method of performing such functions while maintaining ,�

� WFSETtEAS, whether by fellow-government exemption, sole

� source exemption or small purchase exemption, this contract is

not subject to the Procurement Code; and

understood that payment under any contract is conditional upon
� annual appropriation of funds by said governing body and that
before providing services, the Contractor, if he so requests,

'� sezvices or materials for which funds have not been appropriated.
� This contract shall automatically be extended on a �'

Contract, the Contract Amount of One Thousand Four Hundred Fi.fty
Two and 92/100 Dollars ($ 1,452.92) , which shall accrue and be

b. All maintenance, repair, and construction shall
be done in strict conformance with the requirements of the then-
current Pitkin County Road Specifications, Standard State of �

comply with the requirements of 1973 C.R.S. 43-4-207, as it may

open and passable throuqh the winter months. A prompt and
efficient response to all storms greater than 3 inches in
depth is required. During large or extended periods of snow `•'

. 4. TERMINATION FOR DEFAULT OR FOR CONVENIENCE OF COUNTY
A. The performance of work under the Contract may be terminated
by the County:
. (1) Whenever the Contractor shall default in performance of
this Contract in accordance with its terms, and fails to
cure or show cause why such failure to perform should be '

(2) Place no further orders for materials, sexvices or facil-

termination, and costs incurred because of termination, which ,

any determination made by the County under "Termination for
