Revicw,and revise as necessary,the airport drawings which provide the basis for the � project design; F d. Prepare preliminary plans,specifications,contract documents,and cost estimates for ' � the design,to be approved by Pitkin and cortified to the FAA; P e. Provide acceptable Airport Layout Plan and associated drawings,as required; - sf. Preparc and submit final plans,specifications,and contract documents for approval , by Pitkin and certified to the FAA prior to advertising for bids; S g. Prepare a Design Engineer's Rtport, including estimates of final quantities and � � constructioa cosis. The report will be submitted with the final plans and specifications , to Pitkin and the FAA; t h. Prepare or assist in the preparation of 2ho Application for Federai Funds and the Prop�rty map; i. Coordinate the estabiishment of bid proposais into schedules to allow flexibility of award to match the funds availabte; `i j. Provide compete sets of approvod pians,spccifications,and contract documents for ihe bidding of the project; �� �i .tv s k. Arrange for and conduct Pre-bid Conferonce and job showing as needed; i i. Assist with the bid opening and processing of bid documents, and make :�, roeommendations to Pitkin for award of contract schedules; m. SPECIAL SERVICES x�^'�"'': . �,;.:a�`•,ti;v,.. �,,,,�''si�'r t"•' 3.l The following are defined as special services, which shall be performed by r�4'�'��:�'�': Consultant in relation to designated Projects only upon the specific written request of Pitkin, and for the performance oC which Consu�tant shal! be paid in accordance with the Special Servicos Dayment schedule set out below. , a. Soils and Pavmeni Investiaation(for desian). Perform soils and/or pavement testing and investigation of proposed construction areas as required for design. b. To�o¢raohic Survevs(for desittn). Perform topographic surveys of proposed construction areas as required for design. c. Field EnQineerin¢. Arrange for and conduct Pro-Construction ConCerence. �-•�'+':{�s ' Provide complete resident engineering coordination of the construction work with `��" � sufficient qualified inspectors who shall be present during a11 construction operations, #'� to observe that construction is accomplished in accordancc with the plans and ` � specifications. It is expressiy understood that the term"engineering coordination"does ,�:�..'-:"' not mean that the Consultant will assume any responsibitity that usurps or replaces the i-::r�• duties and authority of a Construction Superintendent or other Contractor agent ;.`r charged with responsibility for the construction operation. The Consultant,in carrying out his responsibilities Cor engineering coordination shait guard Pitkin against defects and deficiancies in the permanent work constructed by the Contractor,but does not r`�:: guarantee the performance of the Contractor.The above disclaimers da not in any way :�,p;,<. abrogate the responsibility of the Consultant as agent for Pitkin to ezercise technical ;:�ti::';; ;, i competence, ezpertise, skill and engineering judgement so that the Contractor's f : construction producis are provided in accordance with the construction contract ,� documents. The Consultant shall issue such instructions to the Contractor's � �. " a Construction Superintendent as are necessary to protect Pitkin's intereSts to the same � r'',''� d extont as would Pitkin itself, if it were present and equipped with the requisite � knowtedge,skiil,competence,eapertise,and engineering judgement. �� The Consultant shall provide suCficient surveys and obscrve and check surveys ? conducted by the Contractor in accordance with the plans and specifications. % �; The Consultant shall submit applications for local licenses including but not limited a to excavation and dust control permits. d ' The Consultant shall conduct materials tests required by the FAA and/or observe and ' evaluate a!I such tesis made by the Contractor in the field and in the laboratory as +' ,y necessary in accotdance with the plans and specifications. Copies of all test reports gwill be furnished to Pitkin and the FAA. Test results will be available on the day tests y are taken. � The Consultant shall act as Pitkin's agent during construction to protect Pitkin's � interest and shall have the authority to recommend to Pitkin that the construction be y stopped if not in accordance with the plans and specifications. The Consultant will � furnish Pitkia and the FAA a weekly construction progress and inspection rcport. i The Consultant shall prepare ali addition and detetion change orders and supplemental ,� ! agreements as required. When the project has been comDieted and is ready for final acceptance,the Consultant ! shall arrange for inspection of the finished work by the FAA,Piikin,the Contractor, and the Consultant,foilowing which the final estimate for the work will be considered by Pitkin. Upon acceptance of the Project,the Consultant shall prepare the"As Built"drawings, including any £ield surveying required to compute final quantities, and the Construction Engineeriog Report,and shall provide Pitkin and the FAA with one(i) copy of the Construction Report. ;�'��� ' :Z: - On completion of the Project,the Consultant shall prepare and supply Pitkin with an "'%��"` Airport Maintenance Program far the improvements constructed under the Project. �° ` It is mutually agroed that any change in the scope of the Project as outtined in Article '"f�' " I hereof, or the services outlined in Articles II and III, and/or delays (including '�K';,�' - ! completion of the work in more than one project)by Pitkin,resulting in eztra expense `.�� to the Consultant,shail be considered beyond the normal scope of this contract. In " addition to the foregoing services, Pitkin may require additional services such as �j'�� Property Surveys,Descriptions of Land,Easements,Redesign or Major Changes oC the ,4�; concept after Cinal plans or concepts have been approved by the FAA. Payment to �` r the Consultant for such work because of the change in scope of the project shall be ��,�� . mutually agreed to by amending this Agreement. " � a �- d. The Consultant may be directed to provide for other"Incidental Services"as �.t';'c' T identiCied and set forth in Section IV, Subsection E. of the County's Request for Proposals of December I5,1988.Incidental Services,Scope-of-Work and fees are subject to negotiations and inclusion in future addendums under this agreement. IV. CONSULTANT'S OBLIGATIONS 4.I. Pitkin,the FAA,and the Comptroller General of the United States or any of their designated representatives shall have access to any books,documents,papers and records of the Consultant which are directly pertinent to any grant program which is related in any way to the Contracted Services for the purpose of making audit examination,excerpts,and � � transcriptions. 3 4.2. Alt services performed shalt be in conformance with any and all applicable rules and regulations of the FAA and with all other applicable Federal,state,and local laws and regulation. 43. Consultant agrees to furnish all of the professional services,professional staff, subconsultants,materials,equipment,computer hardware,computer sof tware,plans,drawings, specifications,calculations,reports and documents specif ied or necessarily imptied to complete all tasks required for the completion or Consultant's Contracted Services,as set out in and in strict compiiance with the Scope of Work herein and the remaining Contract Documents,to the highest standards for ConsultanYs profession in Colorado. • i .��:. V. PITKIN'S OBLIGATIONS 5.1. This Agreement may be terminated by either Party upoa seven(7)days written natice should either party faii substantially to perform in accordance with its terms through no fault of the other. It is also understood that any such violation or breach of contract is subject to legal rcmedies in addition to any contractuai or administrative mcasures. 7.3. The Contract Documents shall not be � construed as creating any contractuat rtlationship between the sub-contractor and Pitkin. i 7.7 Ati services sha!(be perFormed under the generat direction and observation of �! th�Airport Ma.nager or his designe�. Consultant agrees to fulty cooperate with tht Airport Maaager and promptly to respond to his inquirios and requests for information. The Airport i Manager shalt decide any and all questions that may arise as to the quatity and acceptability � of services performed,materiais furnished,rate of progress of the Project and related services, interpretation of the Agreement and all questions as to the acaeptable p�rformance and completioa of the Agreement on the part of the Consuitant. � � _<. ; ?.8. a.
