She stated that the Aspen Quik Mart will not allow them f�-• + to put their recycling dumpster on property owned by the County ;�-.'•. ,:.':� which is adjacent to the market. She stated that the owners feel 9 that the County has not fulfilled their commitment to maintain '`� the property efficiently. The Commission concurred with the Planning c;: ' office's recommendation to deny the Caretaker Employee Dwelling ;��:; �. Units. The Planning Office and Planning Commissioners' concern ; r;"- ; is that a caretaker dwelling unit for each of the three adjacent �� properties will have a cumulative adverse impact on an environmentally sensitive site containing geologic, wildlife and wildfire hazards. The Planning Commission is also concerned ; about the additinnal impact on an unsafe Sinclair roadway. In addition, the visual impact of the steep driveway access road to � the buildinq envelopes is of concern. � The Planning staff and Planning and Zoning Commission recommend that the Board direct staff to write a resolution of denial of � the Caretaker Employee Dwelling Unit. t ,� Marty Pickett, representing the applicant, stated that they are } perplexed with the Planning Commission and the Planning Office's � recammendation of denial. She stated that the applicant is � willinq and ready to provide employee housing. She said that Dr. � � Nick Lampiris, Consulting Geologist for the project, looked at ; the issue and gave a report that suggested that they do not build `� on the 20 percent slopes. Randy Cote, Wildlife Officer, suggested that dogs be either leashed or kenneled. With regard � to wildfire the applicants have agreed to submit a major x mitigation plan. The only issue that came up in the Planning t y Commission meeting was the internal road standards. He asked if that issue had been resolved. Pickett responded by stating that it has. She said that when • ' the District looked at the matter in 1980, the employee caretaker units at that point were not a request by the current owners. At that time, the District made a resolution that it would provide � ' for three employee units. However, they did not address whether `�';' or not they would provide enough water for the caretaker units. � They requested that in exchange for the service to the three �`%v�,"' dwelling units that .lcfs be conveyed to the District, and that is sufficient water rights for the three additional caretaker �::�, ! units. She stated that she has a letter from Gene Mu2linex of - � the District stating that the engineers have determined there is . sufficient water. However, there has been no official Board action a� this time because her clients have not decided to ,•i spend the money required to go before the Board to get that � � clarified. , Dean Gordon En '-'`" `? , gineer for the applicant, stated that there is a > ,. � gap with regard to the road standards, and the County Engineer �r::': _ � and he has gone through this on a number of projects. Through �1 these discussions, he hopes that in the next few months perhaps 'd there might be a revision to the road standards to address the `� low end type roadway. He suggested that an idea in handling this i. situation is perhaps leavinq the roadway criteria somewhere ..,", between the Driveway and the Class v standard, providing turnouts �'� and other abilities for people to see. They feel that the <:� driveway standard with some modifications would be acceptable for '�'� this type of deve�opment with the proposed number of units. . Commissioner Penne commented that they are in receipt of a letter from the Wildridge Subdivision Homeowners who have stated '� that the are o y, y pposed to the extra cars going through the subdivision because they do not feel that the road is safe -,:;� enough. Also, the road standards do not fit what the applicant :: wants to do, and the Sanitation District says they cannot serve ':?� ;�� them although the advocate for the project says they can. :.,� Therefore, she feels the Board is in a difficult spot to approve ; this application. She asked Gordon if they have talked to the people from the subdivision. �� Gordon responded by stating that he has not. , ,?� Ethridge asked the applicant if the proposed units are to be - � primary or secondary residences. Pickett responded by stating that at this point there is no plan in the near future to build at all. Chairman Penne opened the hearing to public comment. There being none, she closed that portion of the hearing. A discussion ensued by Commission members. Commissioner Crowley commented, that there have been several instances whereby the policy conflicts with the actual standards that the County has on some of the roads. There have been other - - reasons of denial stated, however, he feels that the three more employee units which will be provided far out weigh the F,.2,..: negativ� reasons which have been given. Therefore, he is in � . favor of approving the application. �'`.`'-.':` Commissioner Ethridge commented, that unti l t here is a c hange #��; � made in the standards, he is not willing to negotiate on a case �- � by case basis for the County standards. However, it is one of the Board's priorities to review the standards and until such � time as the road standards perhaps are amended and if they would E,.';.:, ' include this limited level of development, he would be willing to � • reconsider the application but based on the standards which are � in existence at this time he would have to vote for denial of �; `: • � !'., -. � � the application. . � . f Commissioner True commented, that he too has a problem with the k j conflict as stated by Commissioner Crowley. His particular (.� � concerns are addressed in the efforts made by the applicant to & 1 consider the wildlife and other problems which could potentially �f `•+ be up there, and he does not see that they exist. He does not �: � want to compromise the road standards. However, he does like the +�:� thought of having additional employee housing which he feels is �' ivery important and would tend to lean toward approving the units. � � _� Chairman Penne reiterated her earlier comments. She feels they � would have to override Wildridge Subdivision, the Snowmass Sanitation District, the comments of Snowmass, and the County -f Road Standards and she is not willing to do this all at one time. � `1 Eiowever, she would be willing to table the matter pending a vote � ' ifrom Commissioner Ross who could break a tie vote or give the applicant time to get more current information for the Board's ` consideration on some of the issues. ` � " �: ,} Further discussion ensued with regard to this matter. =. .� ;j. She stated, that the Planning Commission has recommended approval of the proposal with conditions of approval. Tha City Council has reviewed the application and also recommends approval with conditions. �'�:'° She further stated, that in talking with the applicants, the idea �.�;�'.�•��'�� for the subdivision is that it is a subdivision where the lots s -.: ;:- will be sold. Therefore, they had a difficult time with the ¢�-. '� - elevation ar the detailed design elements which were being `�'' � requested in the conditions o£ approval. As a compromise, she �" . ' recommends that the condition addressing design/elevations be . reworded to say that what will be supplied at detailed � submission is a perimeter model showinq the massing of the buildings, how long, etc. At that time a determination can be - . made as to limitations which will be imposed with regard to these �',�� ' issues. ;y�;S. ,,.�., ! The planner for the project said they are willing to work with ` r••, � the Planninq staff to create guidelines that will satisfy the r Board's concerns. These guidelines will be provided at Detailed Submission. Souberi continued by stating, that with regard to Condition 1.(f) staff would still want to see elevation drawings submitted for the roadway and the driveways. She has worded it to state that "the applicant shall submit design perimeters for the homesites. These shall include limitations on massing, length of walls, � heights, and use of materials". Therefore, all those design � guidelines will be seen at Detailed Submission. Commissioner Crowley requested that language be added to the condition which states "not to exceed 6,000 square feet total square footage including the attached caretaker units. Commissioner True requested that a condition be placed that the caretaker units will be dedicated to the Emgloyee Housing Authority guidelines and available to the employee market at large. � Chairman Penne opened the hearing to public comment. t'° � Charlie Knight commented that the proposed development affects �`� his neighborhood significantly. Ae feels this is the appropriate time for the City and the County get together to perhaps figure a �' way to trade the developer this property for a more usable site. c. He urged Commission members to be very careful in considering the oonditions imposed making sure that things are not overlooked, i.e., road cuts and vegetation. There being no further comments, Chairman Penne closed that portion of the public hearing.
