SECOND READING - ORDINANCE AMENDING THE IAW IMPACT SDBDIVISION ' REGIILATIONS - MOTTON TO APPROVE - PASSED UN'ANSMOUSLY - Cindy � Houben, representing the Planning Office, summarized this item by .. stating, that the first reading of this ordinance was approved on October 24, 1989. At that meeting, staff was asked to amend the � ordinance as follows: 1. Section (viii) (d) (1) (b) was deleted (making reference to a non-existent section of the regulations) . 2. Section (F) the Sunset provision was updated providing for the expiration of the regulations on December 12, 1991, unless extended by the Board. There were two things that � needed to be addressed. The first issue was to prove adequaay of `^ water storage for fire fighting protection. He said, that he has met with the Basalt Fire Chief, and they have agreed to install � another 10,000 gallon tank per their request. Therefore, they . • will have two 10,000 gallon tanks to provide adequate water for fire protection. , � � The other issue had to do with the fact, that there is an i existing subdivision which includes two lots across the street. Those two lots do not share the water, access, etc. They were ,`- part of the original ownership of the land but subsequently have been sold off to different owners. However, they are slightly more expensive to build. The area to the south of the Last Chance Ditch on Lot 1 is currently, and has historically been maintained as an irrigated hay field. All of Lot 1 is located in mapped critical winter range for elk and mule deer. Ar^ development on Lot 1 will have an impact on existing elk and deer use of the area. Should development occur, the Division of Wildlife has recommended that the building envelope be located as far away from the northern _ edge of the lot as possible. While the entire lot is used by the � ����'� - ;G•y'-. elk herd, the norther area is the most heavily used due to its �`:�'��-• .: proximity to the slope and draws behind the property. ��`•- -: s'v�. The • applicant has, subsequent to the Planning and Zoning :r�'! � Commission meeting, proposed to move the building envelope to an �, . another area close to a hayfield. The amended envelope is p., , located to avoid the most critical habitat on site and to avoid encroachment on the irrigated hayfield. Randy Cote, with the Division of Wildlife, has determined that the proposed residence ��' and new building envelope have been sited such that their impact �1.�•.' , on wildlife use of the site will be "insignificant." However, he has said, that any development on this lot will impact the elk C�;' ,, herd to some extent. Further development of Snowmass Canyon, in ` r''•. ;� areas which are specifically used by wildlife, may result in a � cumulative impact on the elk herd which may be irreversible. ` In review of the application, staff had determined, that the site meets the Low Impact Subdivision criteria in terms of bulk and area requirements. However, there is some question as to whether the application meets the intent of the Low Impact Subdivision � regulations. The underlying intention of this regulation is to r aid in the preservation of critical wildlife, agricultural and scenic lands in the Pitkin County down valley area, and to maintain open space. Preservation of these lands is accomplished s - - through the siting of development in areas outside of those lands deemed to be agricultural or wildlife habitat resources. The R&O � Partners' development site {Lot 1) does not include lands which � are outside of mapped critical wildlife areas. As such, the applicant is unable to locate development in an area which does . � not impact the wildlife habitat resource. i , � Planning staff and the Planning and Zoning Commission recommend denial of the request for a Low Impact Subdivision based on the finding that the proposed subdivision is not low impact in nature. The density and visual quality of the proposed t��- subdivision is low impact in nature, but its impact on wildlife lands is not. The Planning Office finds that the application /.`,� does not meet the intent of the Low Impact Subdivision , regulations, which is to preserve both agricultural and wildlife lands. Therefore, the Low Impact Subdivision Growth Management Quota System Exemption is inappropriate for this application. Also, they have proposed a new location for the well to correspond with the new building �'�•� envel ope. ��;.' , With regard to impacts to drainage and erosion, there will be !� +� 1=: none. '� ?" ' There will be no impacts to the road system in the area. There � will be no significant increase of traffic on Lower River Road. The building envelope would border the existing access road for. which permission is granted in their deed for access. The driveway they would be cutting would only involve moving some brush. � With regard to the impact on wildlife, they have moved the proposed building envelope to a site on the property which according to Randy Cote, of the Division of Wildlife, would make � v:-= an insiqnificant impact on wildlife. After the P&Z meeting, he '# had Mr. Cote come out and walk the property, and he said, that ? the most desirable buildinq site would be in the new proposed � location which they are talking about tonight. Also, Mr. Cote said that he approved of the clustering effect of the structures. i Following, the meeting with Mr. Cote, they had Pete Davis, a � Certified Wildlife Biologist, come out and walk the property. He ; „ agreed with Mr. Cote that the impact to wildlife would be � insignificant as stated in his letter. A copy of this is made a � part of this record as Exhibit "B". �°,: , Mr. Olson continued by stating, that the Planning and Zoning Commission said in their meeting, that if he would be willing to ,.� move the building envelope, they would possibly approve the lot split. But during that meeting he was unwilling to do that which was his mistake. She said, that she would speak with Randy Cote again. Based on that conversation, he was advised that planning staff would recommend approval. He only _ found out last Friday that they are back to their original �.�i�; . position. f.,�;:.,�,_ He thinks this emphasizes the fact, that they had a difficult �'' �' time with their decision. The new buildinq envelope is set far ���� '-' � enough back from the west side of the property which is F - i predominantly a large depression that a house would not even be f visible from the areas most used by wildlife. His recent project eYperience includes field studies and report preparation for Aspen Skiing Company's proposed Burnt Mountain E:cpansion, a field reconnaissance and consultation for Morgan and Company regazding their pioposed . development of the Wildcat area, a similar scope of work for Hadid Aspen Holdings in the Aspen Meadous area, and a housing development near Conifer, Colorado. A copy of Dr. Davis' curriculum vitae is attached. The site reconnaissance xas performed on the ar�a indicated as Lot 1 on the Preliminary Plat and Site Plan provided by R&O Partners. The lot is comprised of an irrigated hay meadow on the south side with the remainder being a sagebrush flat with a small amount of oakbrush on the west side. . Mule deer tracks were scattered throughout the lot, but Nere � most abundant in the northwest corner of the lot. Elk tracks and beds were also found in the north+rest corner of the lot by the oakbrush. This makes sense since the northwest corner is in a � shallow draw and out of sight of the existing houses to the east ?" and south of Lot 1. This draw also presents a logical movement corridor for big game, particularly elk. . .`t The placement of the building envelope on the north edge of the hay meadow and netit to the existing access road on the east - side of the property should minimize impacts to big game.
