� � NOW, TI�REFORE, BE IT ORD�D by the Board oP County �
'� Commissioners oP Pitkin County, Colorado,: ;_
� Section 1. Title TV (Airport Regulations), Pitkin County i'
�� Code, shall be. amended by tha repeal oE Article 32 ��Night
Operations��, and Article 26 ��Noisa��, in their entirety.
,;� Section 2. TitYe IV (Airport Requlations), Pitkin County
Code, shall be amended by the addition of tha foilowing sections:

,� Section 6-35 No person shall operate any aircraft to,
fzom or upon the airport, or service, repair or maintain any
aircraft upon the airport, or conduct any aircraft operatioh
''.� on or fram the airport, unless said aircraft shall be rated ;
;.r:� as a ��Stage II'� or °Staga III° aircraft pursuant to the i`
noise rating standards oP Part 36 of the Federa2 Air �
� Regulations, as the same may be published and amended from ":

Administration and, implement atandardized noise reduction
Craffic patterns, to the end that such patterns minlmize the
• noise d�sruptions to surrounding lands Erom day to day
airport operations.

Section 6-37 (a) No aircraft shall land or take off .
from the airport during the period between one-half (1/2)
hour after sunset and 7:00 a.m., local time, the following �;;�„�:.:
dayf except in cases of in-flight emergency or other ��:ti;
emerqency conditior, such as a natural disastiar, medical ��?�r�=<�
emergency or civ11 diaturbance. •`l;''-=
; (b) Notwithstanding anything to tha contrary containad
in Section 2-18 or in subsaction (a) hareoP, tha lollowing �:�, ;
=i shall govern aircraft operationa at tha airport during the � _
period each year beginning w;-th tha Wednesday prior to i'; ;
1 Thanksgiving, throuqh the third Sunday in April of the

a (1) No aircraft shall be permitted to arrive at

(IFR) as es�ablished by tha Federal Aviation _

(c) Any aircraft oparating pursuant to tha provisions
1� oP section (b)(2) hereof, shall ba permitted promptly to
return to the airport aPter its departure if necessitated by
,,� in-flight emergency.

;�'�� (d) Tha �lirector oP aviation, airport manager, or ,`
person acting in'his capacity may, in his discretion, grant ;�
a similar departura extansion for up to two and one-halP (2
1/2) hours past sunset, local time, upon the following high-
traffic holiday pariods: ±�;'

(1) The Wednesday preceding Thanksgiving Day r�

Certificated Scheduled Air Carriere�� which are (1) operating
�ona Pide pursuant to echedule, (2) with aircraPt that
comply with, or are exampt trom ��FAR Part 36, ��Stage III'� >
Noise 'Regulations, and (3) have acaess to an on-aite
instrument landing system, which is in operation at the time
shall be subject to the following curtew extension:
(a) For those operations set out in this Section, .
all arrivals shall ba on the ground prior to 11:00
p.m., local tima. With regard to arrivals, it is the
responsibility oP the pilot oE tha aircraEt and the `�.�;'';;' -
owner and operator oE that aircraYt, jointly and ��r;•--`
severally, to have departed that aircraft from its last �� �
previous point oE departura, non-stop to Aspen at a � _
� time reasonably calculated to meet this curPaw, after ��(!":�,�;�
taking all factors into account, including, but not ,r;:- ::i ;
limited to, the Eollowing: �
(1) Forasaeable gate delays, '�,

(2) Foreseeable air trafPic control (ATC) delays, �
�, .' (3) Foreseeable Weather conditions at point oP �'�
, departure, en routa to As en, and at Aspen, � L. :

(4) Individual aircraPt perPormance capabilities, !'

(5) InPormation contained in all applicable ;

�� (6) The�fact that the airport may be unlighted,
(7) Tha Eact that the airport Air TrafPic Control
, Tower may be closed.
(b) If any commercial air carrier Plight operation is
expected to arrive at tba airport at any time after
;.� 11:00 p.m. local time, that carrier shall immediately
report that Elight to tha Airport Manaqer, or h3s
designea, prior to ita arrival at Aspen. The Airport
� Manager shall thereafter promptly report this activity
to the Board of County Commissioners.

� (c). For al]. arrivals required to ba reported under (b)
j above, and Por any departura after 10:30 p.m. local
! time, the responsible air carrier shall file a full
` writtan report (siqned and certiPiad as accurate by an <
' authorized oPficial or employea oE the carrier) !,�

` beyond the control or reasonable foreseeability of '
� , the pilot, operator or owner. r

! (3) The extent of tha curfew violation.
� (4) A, number and/or pattern of curPew violations
m indicating a lack of an intent to evada the curEew
� ragula�ions.
(e) Any Denver-to-Aspen non-stop flight operation that
+ arrives at the airport under the provisions of
� subsections (b) and (c), above, may depart from Aspen �:,:
and return to Stapleton Airport, ii the turnaround
� departure is prompt and is nacessary for the �,�.
� operational plan of tha air carrier. All departures
� under this section shall ba subject to the eame �
reportinq requirements as are found in (b) and (c) ,�
above.
