Aspen Kiwi Properties, LLC ( "Applicant') has applied to the Pitkin County Community Development Director for Activity Envelope Review, Site Plan with Scenic Review for construction of guardrails on Star Mesa Road. 2. The Kiwi parcel is located at 875 Star Mesa Road (Rondelay Parcel), PID# 264322400010 (Legal description Exhibit A). 3. The parcel contains approximately 40 acres and is conforming in size in the RS -20 zone district. 4. The guardrail installation is on the Star Mesa Road which has easements across the Rondelay Parcel and two intervening properties. 5. The Applicant proposes to remove boulders at the switchbacks of Star Mesa Road and replace them with guardrails. 6. The request complies with the applicable provisions of the Land Use Code, as follows: a. The visual impact of the road will be lessened as viewed from Highway 82 and McLain Flats Road. b. The proposal can be permitted through an Access Permit. c. Proper easements for the road are in place. NOW THEREFORE BE IT DETERMINED by the Pitkin County Community Development Director that the Aspen Kiwi Properties, LLC Activity Envelope, Site Plan with Scenic Review for guardrail installation is approved subject to the following conditions, which shall run with the land and be binding on all successors in interest. 1. The Applicant shall adhere to all material representations made in the current or prior applications or in public meetings or hearings and shall consider those representations to be conditions of approval, unless amended by other conditions. Prior to submission of the required Access Permit for the guardrail installation, the Applicant shall be required to submit for approval by the County Attorney and Community Development a Site Plan with Activity Envelopes that include all disturbance areas in accordance with Land Use Code Section 2- 30 -20(g) and Application Manual Sections 2.1.1 & 2.1.12. The above referenced approvals shall be a condition precedent to finalization and recordation. The Mylar copy of the plat shall be signed by the owner prior to submittal for recording. 3. No structural development in excess of 30" in height above natural or finished grade shall occur within the setbacks of any lots. Any external structural development exceeding 30" in height located within setbacks mandated by County zoning regulations shall require a variance from the Board of Adjustment. Approval of an activity envelope within such setbacks does not assure approval of a variance. 4. Prior to commencement of any earthmoving or construction activity, the Applicant shall stake the corners of the activity envelopes and install construction fencing around the perimeter of the envelopes. The fencing shall remain in place until issuance of a Certificate of Completion. 5. The Applicants shall comply with all standards for development within Scenic View Protection Areas as represented in the application and approved in this Determination: A) Reflective materials shall not be used unless the materials are treated prior to installation to eliminate reflection. B) All development shall be built or painted with indigenous earth tone materials or colors. C) Driveway lighting is prohibited. D) All new utilities located on or servicing the parcel shall be located underground. 6. No development, including grading, excavation, fill placement, landscaping, vegetation removal or disturbance, shall occur outside of the approved development envelopes. 7. At submittal for access permit application for the proposed guardrail installation, the Applicant shall: A) Submit a site specific revegetation plan for any newly disturbed areas for review and approval by Planning /Zoning. All historical drainage patterns shall be maintained. All Slopes steeper than 2:1 shall utilize erosion control blankets. If the project disturbs more than one (1) acre, a State Stormwater Permit shall be obtained prior to permit issuance. B) Submit a construction management plan for review and approval by Planning /Zoning showing the locations of staging, material storage including all retained soils, and employee and construction traffic parking. 8. All newly disturbed areas cleared by construction shall be re- vegetated with native shrubs and grasses, to limit water consumption and additional runoff, within one growing season after completion of construction. 9. Failure to comply with these conditions of approval may result in revocation of this permit or any subsequent permits related to this property or vested rights associated with this property. 10. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin County Land Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin County Land Use Code, § 4 -140 and C.R.S., § 24 -68 -105. As you know, Star Mesa Road, which provides access to all six (6) lots in the Star Mesa Subdivision, runs through Lot 6, aka the "Rondelay Parcel ", which is owned by Aspen Kiwi Properties, LLC (the Applicant). It also runs through adjoining parcels of land owned by the Jaffee Family GST Trust and White Star Ranches HOA (aka W/J Filing #5). The segment of the road upon which we are proposing to install guardrails is on the steep hillside which has several switchbacks. There is a recorded easement agreement for the access road through the Rondelay Parcel in Book 493 at pages 146 through 155. Please refer to Exhibit A. Since our conference, the Applicant has had a survey prepared for the segment of the existing road through the Jaffee and White Star Parcels. Please refer to Exhibit B. The access easement depicted in this survey is in conformance with the alignment described in an easement agreement which was recorded August 20, 1985, in Book 493, at pages 156 through 206. Please refer to Exhibit C. This access easement was not surveyed and recorded at that time by Star Mesa HOA as the agreement directed. The Applicant will have this new survey and the short form agreement recorded once this application is approved. The recorded access easement agreement (Exhibit C) for the Jaffee Parcel contains a specification for a guardrail at page 201, which was never built. This application for site plan review proposes to build guardrails at the switchbacks only, in conformance with the recorded specification. We are attaching photoshopped pictures of the hillside showing the road as it is today and with the proposed guardrails. Please refer to Exhibit D. We are also attaching a picture of the proposed guardrail. Please refer to Exhibit E. In reference to Land Use Code Section 7- 10 -50: Activity Envelope; The Activity Envelope for this proposed project will be the access easement, which is described in Exhibit A and depicted in Exhibit B. More specifically, the switchback areas depicted in Exhibit C are where the guardrails are proposed. In reference to Land Use Code Section 7- 20 -10: Site Preparation and Grading; The installation of the proposed 8 "x8" guardrail posts will not require any site preparation other than removal of the large white boulders that are currently located at the switchbacks. It has shown no signs of instability to date. In the event additional width is needed for construction purposes, Star Mesa shall first obtain ' the consent of Collins Engineering, Inc. before utilizing any portion of the construction easement. Further, Grantors and Jaffee hereby grant and convey to Star Mesa a perpetual exclusive easement for utility purposes across and along a stip of land twenty (201) feet in width parallel to the southerly boundary of the Jaffee Parcel and Grantors' Parcel and continuing from the county road easterly to the easterly boundary of Grantors' Parcel. 2. Survey. The parties to this agreement shall mark with stakes the exact location of the easements following the descrip- tions set out in paragraph 1, above. Star Mesa shall, at it's expense, immediately cause a survey of the centerline of the above described easements and proper legal descriptions shall be prepared based upon such survey locating the approved easements. The legal descriptions shall be attached to the short form ease - eat aareement to be executed by the parties hereto and recorded in the office of the Clerk and Recorder of Pitkin County, Colorado. 3. Use. Said easements shall be utilized only as a private road to provide ingress and egress and utilities to the single family dwellings and accessory uses to be located on the six 35 -acre parcels in Star Mesa. The easements granted herein shall serve no more than the number of single family dwellings permitted by law, which shall in no event exceed a total of six single family dwellings and six caretaker units not to exceed 500 square feet in size as prescribed by applicable county regula- tions. Star Mesa shall construct the private road which shall provide ingress and egress to Star Mesa located within the forty (40') foot wide easement described above and continuing easterly to Star Mesa. Construction of the road and installation of utilities shall conform to Pitkin County - standards or as otherwise approved by the County Engineer. Star Mesa agrees to bear all costs of construction including but not limited to: engineering, including fees from and including May 28, 1983 of Collins Engineering, Inc. up to the sum of $4,500.00, and survey costs, labor and material costs of con- struction and revegetation and landscaping costs. Star Mesa shall obtain all permits required by Pitkin County to construct the road and extend utilities and shall comply with all require- ments of Pitkin County in constructing the road and installing utilities within the easements granted herein. Prior to com- mencement of construction of the road on Star Mesa's property, Star Mesa shall provide a performance bond or other performance guaranty satisfactory in amount to Pitkin County. The bond shall be obtained by Star Mesa to insure the completion of the road, revegetation, landscaping and other improvements or restoration to original condition of the easements should the project be abandoned before completion. Construction specifications are attached hereto as Exhibit E. The road shall be constructed in accordance therewith and with generally a 108 grade although a 128 grade maximum may be allowed for some sections in the judgment of the project engineer and with maximum curve radius of 100 feet. Unless less restrictive requirements are subsequently approved by Pitkin County the cross- section of the Star Mesa Access Road shall be designed to meet Pitkin County standards for a local access road , in mountainous terrain (Class IV, Type 3 Road). The paved lanes shall be chip and seal pave- ment and 8 inches of aggregate base course. The structural section has been designed using the "Group Index Method" as outlined in the Pitkin County Design Standards, based on an assumed A -4 soil type. In the event that any of the existing road included in the easements described herein requires upgrading to meet current Pitkin County standards, Star Mesa shall, at it's expense, -, complete such upgrading. It is a condition of this Agreement and the easement grants contained herein that Star Mesa shall place that portion of the road to be constructed easterly of Grantors' Parcel and on Star Mesa's property in an alignment no further north than a line , '• approximately 800 feet north of the south boundary of Star Mesa's property in order to provide a corridor wide enough to construct said road with no more than two switch -backs above the Salvation Ditch. In the event the road can be built within a corridor less than 800 feet in width, Star Mesa shall do so. Star Mesa shall cause the proposed alignment to be staked on the ground and such alignment shall be approved by Collins Engineering, Inc. prior to Star Mesa commencing construction of the road easterly of Grantors' Parcel. In the event, however, that the road requires - a wider corridor than the aforementioned 800 feet, Star Mesa shall be and is hereby permitted to utilize a wider corridor pro - (.r vided, however, that Collins Engineering, Inc. first approve such wider corridor. ROOH 493 FAuffit Salvation Ditch. In connection with such installation, Star Mesa may construct a pioneer road over said easements to gain access to the Salvation Ditch. The dimensions and grade of such pioneer road shall first be approved by Collins Engineering, Inc, prior to commencement of construction. 5. Maintenance. Grantors shall maintain that portion of the easement granted herein that is parallel to the south bound- ary of the Grantors' Parcel and the Jaffee Parcel and shall divide the costs of said maintenance with Star Mesa. Grantors shall maintain said easement in a safe condition and in a state of good repair including snow removal, and the costs of such maintenance shall be divided between Grantors and Star Mesa with Star Mesa assuming a portion of the costs for each residence that is constructed in Star Mesa. For example, if a maximum density of six units is constructed in Star Mesa, Grantors constitute one unit and shall pay 1/7 of maintenance costs and Star Mesa shall pay 6/7 of total maintenance costs. Grantors shall submit quar- terly itemized billing statements to Star Mesa for maintenance costs, which shall be paid by Star Mesa in a timely manner. 6. Additional Users. Star Mesa agrees that it will not at any time convey to or permit the use of the easement granted hereunder by any third party to access lands other than the Star Mesa property, nor shall it enlarge the use of the easement with- out the written consent of the Grantor(s). 7. Provisions Relating to the Easement. The parties hereto agree to the following: (a) That the easement is not open to the public and shall be used only for a private roadway. (b) No party will at any time convey or dedicate any land in the easements as a public street, road or other public way of any kind without the consent of all parties. (e) That Star Mesa shall indemnify and hold harmless Grantors and Jaffee from any and all claims, costs, and expenses including reasonable attorney's fees resulting from the use of the Easement by any party, other than the use by Grantors, Jaffee, their guests or invitees successors, representatives and assigns. (f) That Star Mesa hereby agrees to immediately abandon all i of its easement rights adjacent to the Grantors' Parcel and the Jaffee Parcel through White Star Ranches. (g) That White Star Ranches hereby agree a two hundred (2001) foot wide green belt easement along its south boundary as such is contiguous with the Jaffee parcel and Grantors' Pare*, provided, however, that White Star Ranches shall be permitted to retain and utilize the existing easement from Wilton Lindner Jaffee providing access to White Star Ranches over said green belt area. (h) That all utilities installed by Star Mesa in the ease- ment granted herein shall be placed underground and the surface restored to its prior condition all at Star Mesa's expense. Such relocation, reconstruction or repair shall be done in a man- ner so as to avoid any interruption in service of the foregoing utilities and irrigation water. 8. Termination of Easement. In the event Star Mesa obtains an alternative access route providing satisfactory access and utility easements to star Mesa, the access easements granted to Star Mesa herein shall automatically terminate upon utilization by Star Mesa of such alternative access route. 9. Pending Litigation. Upon the execution of this Agreement and full compliance with all provisions herein by Star Mesa, Grantors agree to dismiss with prejudice its action for preliminary injunction 83CV228, Pitkin County, Colorado, District Court. 10. Short Form Agreement. Upon the completion of the survey work required above, the parties hereto agree to execute a short form version of this Agreement for the purpose of placing of record the easement grants contained herein. 11. Binding Effect, Etc. (a) The provisions of this Agreement shall bind and inure to the benefit of the parties and their successors in title. (b) The covenants herein contained shall attach to and run with the land and be appurtenant to the Grantors' Parcel, the Jaffee Parcel and the Star Mesa property so that a transfer of legal title to said parcels or portions thereof shall automati- cally transfer an interest in said easement and right of way and the benefits and burdens of this Agreement. (d) The parties agree that money damages are not an adequate remedy for breach of any covenant herein and that, therefore, any present or future owners of the Grantors' Parcel and the Jaffee Parcel or the Star Mesa property have the right to institute and prosecute any proceeding whatever, at law or in equity against persons violating or threatening to violate any covenant, including actions for injunctions, or for specific per- formance, and actions to compel removal of any condition or dis- continuance of any use which violates such covenants. The pre- vailing party to any such action shall be paid by the other party all costs of enforcing the provisions of this Agreement, including but not limited to, reasonable attorney's fees. I noticed that Item 3 of the Recitals states that the Rondelay Parcel contains approx. 35 acres. It is actually 40.25 acres. Also, Item 4 does not mention that one of the switchbacks is partially located on property owned by Lands of White Star Ranches HOA, and one is located on Lands of Jaffee Family Trust property. The plat of the easement is in the Site Plan Review Documents, Exhibit B, page two of two. The switchback located on Lands of White Star and the property line abutting Rondelay will be within prescribed building setbacks from the property line. Referencing item 3 of the Determination, since the guardrails are 30" high, we assume that no variance will be required. As I mentioned in my earlier email, there will be no earth moving or disturbance of existing vegetation and thus we see no need for Determination Item 7.A) requirement for a drainage, erosion control and revegetation plan, etc. - Similarly, Item 8 appears to be irrelevant, since the areas around the boulders have no vegetation, other than random weeds, and we intend to simply smooth out the existing grade after the boulders are removed and install washed gravel around the wooden posts.
