COUNTY COMMISSIONERS OF PITKTN COUNTY, COLORADO,
SUBM2TTING TO THE ELECTORATE A PROPOSED
HOME RULE CHARTE22 A N�D-MENT

WHEREAS, Section 2.8 of the Home Rule Charter does not �
currently address action by the Board in the form of an �
ordinance; and
WHSREAS, notice, hearing, and publication requirements are '
vaque and from time to time in conflict with Colorado Statute; �. -_

WHEREAS, these amendments affect certain definitions � ,

��=^} presented in Section 1.1 of the Home Ru1e Charter; and _

�° WHEREAS, the Board finds that these amendments to Section
= ���:'�� 1.1 and 2.8 preserve the original intent of the Home Rule Charter
' `•"' and serve the best interest of Pitkin County to eliminate these '`��
`f '-��`�-� conflicts and ambiguities; and

� �`"`•`�' WHEREAS, Article VII of the 'Aome Rule Charter gives the - _
electors of the County the power to require a referendum on any �
. :i resolution, exaept those specified in Section 7.1.2, by filing a
- petition within 45 days after the effective date of the

?�°� WHEREAS, Article X of the Home Rule Charter requires voter
- •..:� approval prior to tha incurrence of indebtedness or borrowing by
::,''� the Caunty; and

� WHEREAS, the referendum provision unnecessarily delays the
.� .; closing on bond issues and other forms of indebtedness already
,;,;�� approved by the electorate for 45 days after approval of the bond
;,;� resolution; and

"!y� WHEREAS, Section 8.1.1 of the Home Rule Charter states that
action to amend the charter may be initiated by a �'resolution
�`�� adopted by the board of county commissioners submitting the - `
;;� proposed amendment to the qualified'electors"; and � ,

� _y`j WHEREAS, Section 5.1.5 of the charter provides that "if a �',

Shall Section 1.1 of the Pitkin Countv Home Rule Charter be �µ`��'�
a�nended and shall Sections 2.8 and 7.1.2 of the Pitkin
County Home Rule Charter be repealed and reenacted as '
provided in Resolution No. 90-, to provide for actions by `��
the Board of County Commissioners in the form of ordinance,
formal resolution, one step resolution, and emergency Y��.
i resolution, and to exclude from the power of referendum the
' : incurrence of debt or borrowing already approved by the
