RECITALS
1. James White is the owner of a parcel of land in Pitkin " ,'
i County known as Aspen Ridge Lot 4. �

2. Mr. White made application to Pitkin County for ��
� approval pursuant to Section 5-400, et, seq. and Article 18 of
the Pitkin County Land Use Code for construation of a single- �.. '
� family residence on his property. �
3. By Resolution PZ-89-31, the Pitkin County Planning and
:4°' Zoning Commission recommended denial of General Submission and
- ��� denied the 1041 Hazard Review application, for the reasons stated 'i
_S_ .:� in the resolution.
. :';,:,�, 4. Denial of the 1041 Hazard Review application was '
appealed by Mr. White to the Board of County Commissioners, whiah � -
- conducted hearings on the appeal on September 26, 1989 and
' � October 10, 1989.
;;,1;.?-� 5. Hy Resolution No. 89-111, the Board affirmed the
'° "" decision of the P&Z for the reasons stated in trie resolut3on.
+`''' More specifically, the Baard found that the proposed development
=:� would violate Section 5-404.2(d) (1) and (2) because of the
:"� failure to demonstrate adequate mitigation of impacts on ;
` wildlife.
..',� 6, Mr. White filed suit against the Board, 89 CV 347,
seeking to overturn the Board's decision and also seeking
=� damages.
7. The parties have negotiated a eettlement of the dispute
~'� which
��._ provides Mr. White with 1041 Hazard Review Approval, b�
, �;� subject to conditions identified below which address the Board's
, ;'•k,' concerns regarding the impact of the proposed development on ,� :
% wildliPe. Most significantly the building envelope has laeen �
-;::5 relocated to minimize wildlife impacts in the area. ��
'i '�'.
� 8. In accordance with Resolution No. 89-111, this
'� settlement resolves all 1041 Hazard Review concerns, but does not

dispose of Mr. White's General Submission application which must F•�+ `
� be reviewed by the Board at a subsequent hearing. _ .

l. The Board hereby approves the James White 1041 Hazard
Review Application for one single family residence on Aspen Ridge
Lot 4, subject to the conditions identified below.
2. In order to mitigate wildlife impacts, the approval is �z,�'.:

a. Buildings and structures shall be permitted only within °?3.� :
the approved building envelope, as identified in Exhibit A, �`"

� b. No dogs shall be permitted on the property. �;;;,

c. There shall be no disturbance of natural vegetation
' located outside the approved building envelope. �

:`_,� d. The grazing of livestock on the property is prohibited. �`"

' •=d e. The home shall be visually obscured from the elk ;i

f. No construction shall occur between May ist and June
'� 20th of each year.

����; h. Any fences on the property shall be no more than 42
f� inches high or no more than a three (3) wire fence. �

i. At the time of issuance of the building permit, the
applicant must prove that, in addition to the domestic water
supply, there is an adequate water supply Por Chris Smith and .
,Y.:j wildlife of 1/6th of a gallon per minute or ten (10) gallons per
i hour for wildlife needs. This supply shall be certified as
,,!�� available by a registered engineer who shall submit a certified
,,. letter to the Building Department, Planning Office and
` Environmental Health Department prior to the issuance of the
'Ya building permit. The supply for wildlife sha21 be available as
'� surface water between the months of April through November. t

:{ 3. In order to mitigate the wildfire ha2ards, the approval K: d
, 4'� is subject to the following condition: proof of adequate water
supply and quality of water shall be demonstrated to the �
°� Environmental Health Department prior to issuance of a building �;, �
