REVEGETATION AGREEl�ffii'P
TiiIS AGRffi�1T is made and entered into as of this 4th day
of September, 1990, by and between the County of Pitkin, a ` .
political subdivision of the State of Colorado, 506 East Main, =.�
Aspen, Colorado 81611 ("County") and the City of Aspen 130 South r '•
Galena, Aspen, Colorado 81611 ("City"), wherein the County and
the City shall sometimes be referred to jointly as "the Parties." ,+�_^�;.r' `

W I T N E S S E T H .��`�`•
WHSREAS, the City is preparing the eactension of water lines
' known as Red Mountain, Buttermilk/Aspen Airport Business Center f
and Meadowood-Hi hlands; and � �� .. `"

WHEREAS, the City has been granted 1041 Aazard approval for ' %.;�,,� . i
the referenced construction project by the County, contingent, in ;,�, �:.
part, upon its agreement to revegetate the construction site in
accordance with the standards set by the application and 'y,�� !� �
approval; and � ii'.,:

WHEREAS, the Parties wish to memorialize their revegetation ��
agreement as set out herein below.
NOW, THSREFORE, in consideration of the premises and of the ;
mutual benefits and detriments set out herein, the sufficiency of �
which is hereby acknowledged by the respective Parties hereto, it �
is agreed as follows:
1. The City, in consideration for the issuance of an ,
excavation permit and building permits for the contemplated j�
construction projects, shall undertake and complete said project
in compliance with the conditions of approval of said project by �
the County and, upon completion of that project, revegetate said
construction site completely, all in accordance with the approved
revegetation plan.
2. In order to secure the performance of the City
: concerning the referenced revegetation obligation undertaken `
herein, the City warrants and represents to the County that it
, has incorporated similar requirements and standards within its �
construction contracts, and that it has obtained surety bonding "
from its contract for 100$ of their obligations. The City agrees �„ 'y �
� that upon the completion of the project, it shall not release �t�
said bonds without the prior written approval of the County of ; ,,�
the revegetation of the project site in accordance with the
City's obligations under Paragraph 1 hereof. The County shall `
have fifteen (15) working days from notification of the '' `• �
completion of the revegetation to inspect and approve same. In � :�!
the event the County fails to inspect and approve said revegeta- ,�
tion within the fifteen (15) working days, then its rights as `E•`' i
provided in this paragraph 2 shall be deemed to have been waived . �'��, Y�..'
and the City may release any and all bonds as herein required. -- :.=.

3. The City further agrees, as security for its '
performance hereunder, that in the event it is notified by the j:. . ;
;; County that the revegetation coramitments of this agreement have.
- not been satisfied; it shall immediately pursue a recovery upon
said bonds and itself perform the required �revegetation of the
project, or, alternatively, assign all ,of its rights under said `� �, f,�:
'' bonds to the County, so that the County may pursue a recovery and ' �� �
; perform the revegetation. �x�� ; �
� 4. This written agreement constitutes the full agreement ,'��y�,4�'
j of the Parties with respect to the subject matter hereof, and may -
� not be amended or modified except in writing. -
