' part traverses the Rio Grande Railroad right of way near the City ��
�; of Aspen, which right of way is now awned by the Caunty and is ��
� currantly being used as a portion of the County trail system, and
.� WHF-RFAG� the District has been granted 2041 Hazard approval _
for the referenced construction project by the County, �
oontingent, in part, upon its agreement to revegetate the
construction site in accordance with the standards set by the
U.S. Army Corps of Engineers, and ' -
wF�REAS, the Parties wish to memorialize their revegetation !�
agreement as set out herein below.

NOW, Ti�:REFORE, in consideration of the premises and of the �
mutual benefits and detriments set out herein, the sufficiency of
which is hereby acknowledged by the respective Parties hereto, it
is agreed as follows:
1. The District, in consideration for the issuanee of an
excavation permit for the contemplated construction project, ,�.
shaZl undertake and complete said project in compliance with the
conditions of approval of said project by the County and, upon s„ `,,, �
completion of that projact, .reveqetate said construction site �
completely, all in accordance with the attached memarandum dated
Auqust 29, 1990, and to the satisfaction of the County based upon i� �
said standards.

• 2. In order to secure the performance of the District � '`•��a
concerning the referenced conditions and revegetation obligations �
undertaken herein, the District warrants and represents ta the ��^: , y ';
County that it has incorporated similar requirements and . � �*���.+-
standards within its construction contracts, and that it has '�-:�".,=:
` obtained surety bonding from its contract for 100� of their �a ° -
ebligations. The District agrees that upan the completion of the

DESCRIPTTON OF THE PROPOSAL: The ACSD wishes to replace an �F�' �
� existing line along the Rio Grande Trail. The line is needed as

=f! a result of potential failure of the existing line and to ���
eventually be able to hold a larger capacity flow given �-s::?., �
additional development in Aspen. The section of line that is ;
beinq zequested to be replaced is approximately 2000 feet, �
•located totally on the northeast side of the tzail. `s
i Construction of the line will entail the followinq:

' - A map of the construction area is attached; �
� - Access to the line via Sneaky Lane;
. - A trench of no greatez width than 10-15 feet at .
� varying depths of 4 feet to 15 feet becoming
deeper as the line approaches Hunter Creek; ?
� - Construction and revegetation will start on �
i Septembert�, 1990 and will be completed by no
later than October 15, 1990.
� STAFF COI+Il�4ENTS: On June 11,1990 the BOCC accepted a policy �
I regarding replacement of existing utility lines. See attached
memorandum. In summary, the ACSD is allowed to review under a
I Minor 1041 Review process. In addition, the applicants have
� committed to hold a public hearing regarding the replacement of
i the line. This hearing is being published for 5eptember 4,1990 at
� 7 PM at the District Offices. •

attached plans. Your correspandence concerns the construction of • "� "
= a tWenty-four inch sanitary sewer outfall pipeline across Hunter
- Creek and through wetland areas adjacent to the Roaring Fork •
=f, ' River near the City of Aspen, Pitkin County, Colorado. '� ,

We have reviewed your correspondence and are concerned that •
a "worst-case saenario" may result in potentiel adverse impacts �
��;, to approximately one acre of wetland. On the surface, the
- magnitude of these potential adverse impscts appesr to be
��, excessive. However, we have decided not to seek discretionary �
authority and require an individual permit for these Wetland
impacts provided you and/or your contractor(s) adhere to the .
management practices which were recommended to you by Gary Davis
of this office and srhieh are partislly reiterated in your letter.
�
I would like to restate those management practices which you
discussed �rith Mr. Davis and which are included, in part, in your
letter to insure that these wetland impacts are minimized.
1. Wetland areas to be crossed should be identified by
conspicuous flagginS to delineate these sensitive areas from '
upland areas. Work in wetlands shouln be restricted to the
minimum amount possible.
- 2. Permeable Seo-textile fabric should he used where excavated
material must be placed in Wetland areas to insure all fill is
r:, removed from the wetland.

wetland areas and at Ehe Hunter Creek crossing must be removed to
upland sites. You must return "waters of the United States" to
pre-construction contours. "

6. Wet areas disturbed by construction activities, if not =� �,

As mentioned above, we believe that these management • �t
practices caill minimize potentiel adverse impacts to wetlands.
Accordingly, we concur that the construction of the seKer outfall
_ pipeline can be authorized by the nationwide general permit for
+ utility line crossings provided you and/or your contractor(s)
�' adhere to these previously discussed management practices snd the �
special conditions outlined in the enclosed information paper.
Please be aware that this verification will be valid until
the nationwide general permit is modified. reissued, or revoked. �
All of the nationwide general permits are scheduled to be �
modified, reissued, or revoked prior to January 13, 1992. It is
incumbent upon the permittee to remain informed of changes to the
� nationwide general permits. We will issue a public aotice
• announcing these changes when they occur. Furthermore, if you
commence or are under contract to commence this activity before
the date the nationsaide Beneral permit is modified or revoked,
you Nill have twelve months from the date of the modification or
revocation to complete the activit�• under the present terms and
conditions of this nation�+ide general permit.
