conduct activities related to a car rental business at the Airport

3. Pavments/Securitv/Records.
3.1 In consideration of the rights and �� "°'

All paymants hereunder shall be considered delinquent

3.3. Immediately upon the Company's receipt of ��; �,.

become the property of the County and the Company shall hold and

3.4 Definitions for the purposes of calculation
of "gross revenues" and "gross receipts'� percentage payments and
payment shall be as follows:
3.4.1 As used herein, the term "motor
vehicles" shall consist of motor vehicles designed primarily for �

coupes, convertibles, station wagons, four-wheel drive vehicles, �

appropriate permits and approvals required by the Land Use Code for ;

damages for such breach, an additional amount equal to fifty (50�)
percent of the verifiable costs, fees and charges due from Licensee
hereunder for the period in question. If any audit shows

� lessees, licensees and permittees (LLPs) including specifically

' WHEREAS, Pitkin County, Colorado as owner, sponsor and ��'
.f � operator of the Aspen-Pit3.in County (Sardy Field) Airport �� '
' (hereinafter the "Airport"), does provide various spaces and areas �': �
for the use of the public and Erom time to time does and shall -n
license or permit the exclusive and non-exclusive use of parts of � "
these areas to various individuals, firms or corporations to serve ��
the users of the Airport; and
WHEREAS, Pitkin County has the authority to regulate �
commerciaZ activities, to license space at the Airport, anc3 to T�,
enfoxce these regulations and to set and collect fees for these '{
commercial activities pursuant to, inter alia, 1973 C.R.S. 30-35-
202, 41-4-101 e� sea•, Title IV of the Pitkin County Code, Section
8.7 of the Pitkin County Home-Rule Charter; and �
wHEREAS, "Off-Airport�� rental car companies/operators are
defined as those companies/aperators located off-airpart and not
leasing space from the AiYport, and engaged in for-profit
commercial rental of motor vehicles to passengers arriving at the
Airport by air or other ground transportation; and
WHEREAS, in determining the total amount of fees to be charged
to "Off-Airport'� rental car companies the County intends to recover
its costs in the administration, operation, maintenance, and
improvement of the Airport from such comraercial activities, and has
; attempted to set fees based on a balance of use o£ the Airport and
convenience to the travelling public as a whole; and ~ .E. •�

NOW THEREFORE, BE IT pRDAZNED BY THE BOARD OF COUNTY '
COMMISSIONERS OF PITKIN COUNTY, COLARADO: - "

Section 1. All off-airport car rental companies engaging in
commercial car rental operations through the Airport shall hereby ' c`:�fn:�.�,
be required to enter a Use and License Agreement with the County. �;���'".'�
Section 2. That the fees and charges for entry and use of the ��' ` °
Airport from January 1, 1991 to December 31, 1992, or for any part
thereof, for off-airport car rental companies (hereinafter the ' /-
"COmpanies'�), shall be seven and one-half percent (7 1/2�) of the �` `
gross revenues or gross receipts to the Companies, or which the ; �'`� ,'
_ Companies are entitled to receive, for the rental of motor vehicles ;�`;' �
= to airport customers who enter a rental contract with the Companies .•�' '
� within fourty-eight (48) hours of arriving at the Airport by means ' 't�
-3 of scheduled commercial airline, scheduled or non-scheduled charter � -��� ' .

Section 3. All off-airport car rental companies engaging in
commercial car rental operations through the Airport shall hereby
be required to comply with the Airport Title v Regulations of the
Pitkin County Code, and Ground Transportation Rules and �
Regulations, and as may be amended from time to time. ` �

' Section 4. That the License and Use Agreements between Pitkin
County, and respectively, A1amo Rent-A-Car, Tnc., Colorado Rent-A- -
Car, Inc. (Thrify Licensee), and Mountain Express Rent-A-Car, Inc. �
which are attached hereto as Exhibits "A", "B", and "C", and
incorporated herein by this reference, are hereby approved and
adopted according to their terms and conditions.
Section 5. That the Chairman (or Vice-Chairman} of the Board
of County Commissioners is hereby authorized and directed to
execute this Ordinance, and the subject Agreements on behalf of the
County and any other documents necessary to accomplish the
transaction, which documents have been approved as to form by the
County Manager, Director of Aviation and County Attorney.
