OF PITKIN COUNTY, COLORADO, AMENDING SECTION 7
OF THE PITKIN COUNTY LAND USE CODE BY ADDING SECTTON 7-1.22

Commissioners of Pitkin County, Colorado, (hereinafter "Board") , '` �

reviewed a request by Village. Resort, Inc. (hereinafter ��

"Applicant"} , for an amendment to the non-conforming regulations

of the I,and Use Code; and . I � "' �'

WHEREAS, on September 19, 1989, the Pitkin County Planning ; '

;� and Zoning Commission r.eviewed the request and recommended �=��� .� r
, ;.
� approval to the Board; and ��= '
WHEREAS the� ro osed amendment was made ursuant to Section '�
. P P P
17 of the Land Use Code; and - ,��
WfIEREAS, the amendments are specifical2y requested to allow �
the enlargement of square #ootage to a non-conforming lodge where �
the enlargement increases on-site, deed restricted employee units
�
in addition to meeting specific site planning criteria; and
NoW, TFIEREFORE, BE IT ORDAINED by the Board of County
Commissioners of Pitkin County, Colorado:
Section 1. Section 1 of the Pitkin County Land Use Code �
is hereby amended to add Section 7-1.21 as follows: "
7-1.21 Construction of Employee Housing �y� ,!'

(a) The enlargement of a lodge use that is pre-existing �
under this Article 7, for the purpose of constructing �. �
employee housing, shall be reviewed and considered as a .� y
Development Application for a Special Review Permit pursuant �
to the provisions of Section 3-6. In determining whether to •?
approve, approve with conditions, or disapprove the �.�i��,� . `
application, the Soard sha11 insure all of the following t6"' ,;

{1) There is no increase in the number of free marl:et
lodge or hotel units. -

(2) The proposed affordable housing units are in J't,�.:�.
compliance with the applicable Housing Guidelines of
the Aspen/Pitkin Housing Authority. �;w;.f:` .

(3) The construction quality and unit size of the
proposed affordable housinq units meet the standards of � '
the Aspen/Pitkin Housing Authority Resident Housing
Guidelines. "Resident" as used herein shall mean any f:_.
person currently residing and employed in the City of �': '
Aspen or Pitkin County for a minimum average of thirty °� . ,
(30) hours per week, nine months out of any twelve- ( ? +
- . month period.

'f� ' (4) There are adequate public facilities to serve the .
proposed development including adequate off-street
` parking. �i`
(5) The proposed affordable housing is compatible with
the surrounding land uses and the dimensional
requirements of the underlying zone district.
(6) The proposed affordable housing is deed restricted �
to the applicable housing rental guidelines of the
Aspen/Pitkin County Housing Authority, and against
commercial rental or sale. In the event the lodge is
condominiumized, the deed restricted units must be 1�
retained as deed zestricted rental units.
(7) The proposeti affordable housing receives health,
. safety and fire inspections, and commitments are made
to comply with the results o£ said inspections.
(8) The affordable housinq units are limited in their
� rental solely to employees of the lodge or hotet, and
shall not be rented to other employees of the County
nor rented on the open market unless otherwise appzoved
" by the Board of County Commissioners.
(9} There may be no increase in the ovezall height or +cs.,.°*
` footprint of the lodge or hotel, and any visua2 impact �`"��
' is substantially mitigated. :, �
