RECITALS -
1. There is presently litigation involving a variety of � �+r��,-,?s .
issues regarding the public access to the National Forest lands � :�`�`?
in the Hunter Creek Valley. `��'` ���� ••
2. It is appropriate for the Board of County Commissioners � .
of Pitkin County to pursue acquisition of an alternative pub2ic �� , -
vehicular access to these lands regardless of the existence of `t!�•::;.;'•.� �
< vehicular access along the North Hunter Creek Road. ��,' • `. ;

� 3. There is insufficient documentation to establish that � �
_��1 the road traversing the Hunter creek side of Smuggler Mountain, � :_
=••� from the crest of that mountain overlooking Aspen down into the �
� I Hunter Creek Valley just downstream from the old Electric Light -�
Reservoir Dam is a public right-of-way. �.

' 4. Such acquisition would significantly enhance the
natural, open space values which have been enjoyed by the y
citizens and visitors to Pitkin County and the Hunter Creek �
Valley. �
+ NOW, THEREFORE. BE IT ORDAINED by the Board of County
Commissioners of Pitkin County, Co2orado that it is in the
inteYest of Pitkin County and for the welfare of its citizens and �
residents to preserve public vehicular access to the National
Forest lands in the Hunter Creek Valley and to acquire said
property in the name oE Pitkin County.
BE IT FURTHER ORDAINED that the Chairraan is hereby
authorized and directed, on behalf of the Board, personally or
through appropriate County Staff, to take all necessary and
appropriate actions to acquire said parcel of real estate, either �.
through negotiated purchase or proceedings in eminent domain.
