WHEREAS, Pitkin County, Colorado as owner, sponsor and a�'
operator of the Aspen-PiCkin County (Sardy Field) Airport "' ��
(hereinafter the "Airport"), does provide various spaces and areas �r '
for the use of the public and from time to time does and shall
� license or permit the exclusive and nan-exclusive use of parts of
- - these areas to various individuals, firms or corporations to serve
the users of the Airport; and ��
WHEREAS, Pitkin County has the authority to regulate !
� commercial activities, to license spaee at the Airport, and to
enforce these regulations and to set and collect fees for these
commercial activities pursuant to, inter alia, i973 C.R.S. 30-35- �
202, 41-4-101 et sea•, Title IV of the Pitkin County Code, Section
8.� of the Pitkin County Aome-Rule Charter; and .
WLiEREAS, '�Off-Airport" rental car companies/operators are �
defined as those companies/operators located off-airport and not
leasing space from the Airport, and engaged in for-profit
commercial rental of motor vehicles to passengers arriving at the
Airport by air or other ground transportation; and
WHEREAS, in determininq the total amount of fees to be charged '_.
.� to "Off-Airport" rental car companies the County intends to recover
�� its costs in the administration, operation, maintenance, and ln �
; improvement of the Airport from such commercial activities, and has � " �
attempted to set fees based oa a balance of use of the Airport and ' ��
convenience to the travelling pvblic as a whole; and ;- �
WHEREAS, the County finds that there is ample state and ' � -
federal legal precedent indicating the legality of the imposition +
of regulations arid fees on off-airport car rental companies; and `

NOW THEREFORE, $E IT ORDAINED BY THE BOARD OF COUNTY • �
COMMISSIONERS OF PITKIN COUNTY, COLORADO:
Section 1. All off-airport car rental companies engaging in '��'

commercial car rental operations through the Airport shall hereby � F.,,,•..
be required to enter a Use and License Aqreement with the County. '�`'""=�_

Section 2. That the fees and charges for entry and use of the j: �rk�,-
; �:�,:�.r�' .
Airport from January 1, 1991 to December 31, 1992, or for any part ,, �
thereof, for off-airport car rental companies (hereinafter the ;�f:'.:= .�.> •
� ^COmpanies"), shall be seven and one-half percent (7 1/2�) of the
gross revenues or gross receipts to the Companies, or which the f
Companies are entitled to receive, for the rental of motor vehicles ,.`�,7•-�"? .
to airport customers who enter a rental contract with the Companies ��!��>r:''> �
within fourty-eight (48) hours of arriving at the Airport by means i:'�::;;',�''. ,
of scheduled commercial airline, scheduled or non-scheduled charter ;��,,.; ,
: aircraft, privately owned general aviation aircraft, commercial :� -
� bus, 2imousine, or taxi. `R�

':'-�:'� Section 3. All off-airport car rental companies engaging in -+�
commercial car rental operations through the Airport shall hereby
. be required to comply with the Airport Title V Regulations of the "'
Pitkin County Code, and Ground Transportation Rules and
� Regulations, and as may be amended from time to time.
Section 4. That the License and Use Agreements between Pitkin ��
County, and respectively, Alamo Rent-A-Car, Inc., Colorado Rent-A-
Car, Inc. (Thrify Licensee), and Mountain Express Rent-A-Car, Inc.
� which are attached hereto as Exhibits "A", "B^, and "C", and
incarporated herein by this reference, are hereby approved and �
adopted according to their terms and conditions.
i Section 5. That the Chairman (or Vice-Chairman) of the Board
of County Commissioners is hereby authorized and directed to -.
execute this Ordinance, and the subject Agreements on behalf of the
County and any other documents necessary to accomplish the
transaction, which documents have been approved as to form by the
County Manager, Director of Aviation and County Attorney.
Section 6. That a copy of this Ordinance, including Exhibits,
shall be kept available for public inspection prior to the public �
� hearing thereon during normal business hours at the office of the
