RESOLifTION IiO. ��% �'r R E C I T A L S ' 1. The United States Environmental Protection Agency :i (��EPA"), pursuant to §105 of CERCLA, 42 U.S.C. §9605, placed the Smuggler Mountiain Site on the National Priorities List, set forth at 40 C.F.R. Part 300, Appendix B, by publiCation in the Federal Register. �. 2. A Remedial Investigation and Feasibility Study ("RI/FS") '•�'; for the Smuggler Mountain Site pursuant to 40 C.F.R. §300.68 was commenced in 1985 and completed in 1986. '��'_i 3. Based on the RI/FS and other information contained in the • � � administrative record, EPA has selected a remedy for Operable Unit 1 of the Smuggler Mountain Site ("Site") to abate the release and threatened release of hazardous substances at and from the Site. `�. � The remedy is embodied in a Record of Decision ("ROD") issued on -_ September 26, 1986. The ROD includes EPA's Explanations of � � =i :� Significant Differences ("ESD's") published in March, 1989, and May ;:a:� 1990, which, in effect, modify the decision on remedial action ,;,';� embodied in the ROD. i � 4. On October 16, 1989, the IInited States, on behalf of EPA, filed a Complaint in U.S. District Court for the District of � Colorado, United States of America v. Smuggler-Durant Mininct � Cornoration. et al., Civil Action No. 89-Z-1802. The Complaint states claims against numerous parties including Pitkin County, pursuant to sections 107 and 113(g) (2) of CERCLA, 42 U.S.C. §§9607 and 9613(g) (2), and 28 U.S.C. §2201. The U.S. seeks reimhursement "`I of Past Response Costs, a declaration of defendants' liability for �'''�� Future Response Costs, and other relief. � .:± �'.� 6. The United States alleges, in the above-referenced case, � that Pitkin County is a responsible party under §107(a) of CERCLA, .':� and is liable for the costs to the United States of responding to � releases or threats of releases of hazardous substances at or from �'� � the Site. 7. The County denies the allegations of liability, but has cooperated with EPA in this matter in order to assure the protection of the public health and safety. Such efforts have ,,'r�.'j imposed costs on the County in terms of money and staff time. �':'� 8. The Board believes that approval of the SSC is in the - public interest in order to protect the public health and safety � and in order to resolve the issue of the County's liability. The � , � expense of litigation and the potential for a judgment against the County are costly and unreasonable risks. Performance of the obligations contained in the SSC is reasonably limited to requirements within the financial, administrative, and technical capabilities of the County. <:;:_.=,� 10. Enforcement of the SSC is expressly contingent upan the approval by July 1, 1991, of a Consent Order between the United � States and Pitkin County, resolving all outstanding issues of t:�::. � �"�1 liability in the pending litigation. APPENDIX B � MAINTENANCE AND INSTITUTIONAL CONTROLS 1. The City agrees, subject to the Constitution and lavs of the ;•r �' State of Colorado and Home Rule Charter of the City of Aspen, to promulgate the institutional controls in Appendix , S.4 for all areas of Operable Unit i that are within its ��'± jurisdiction. • � _ 2. The County agrees, subject to the Constitution and laws of the State of Colorado and Home Rule Charter of Pitkin County, to promulgate the institutional controls in Appendix ; B.3 for all areas of Operable Unit 7 within its jurisdiction. � �::. 3. The State agrees that the County may use monies collected as � solid waste user fees at the Pitkin County Landfill for its � � Operable Unit 7 activities, so long as allowed by C.R.S. sec. 25-16-101, et seq., and so long as the monies are spent � on activities that are consistent with the National j Contingency Plan. r, 4. The County agrees to fund its obligations requized herein in � the following manner: �• � a. in the first instance, all fees collected annually 6 pursuant to C.R.S. § 25-76-104.5(3) shall be applied in : full to fund the County's obligations in that year; and � b. all surplus fees which have been collected and retained � ' to date by the County pursuant to C.R.S. § 25-76- � 704.5(3), and interest thereon, shall be used by the � County to establish a federally insured trust fund R whose sole purpose shall be to finance the County's t j obligations in the event that the fees referenced in fi Subparagraph a., above are inadeauate; and - � c. to the extent permitted by law, any fees collected � � puzsuant to C.R.S. § 25-16-104.5(3) xhich are not , � expended on the County's obligations in any one year, ! , shall be deposited into the trust fund referenced in _ . The hazardous substances of concern at this site have been identified as lead and cadmium. � In 1986 the Environmental Protection Aqency (EPA) selected a remedy for the Site in a Record of Decision (ROD). That ROD was . subsequently modified by two Explanations of Significant Difference (ESDS) issued in March 1989 and May 1990. As ::;;; described in the May 1990 ESD, institutional controls are an -�"� integral part of the remedy at the Site. In order to ensure the ;�--:,� protectiveness of the remedy at the Site, the City of Aspen has ~_ adopted and codified the institutional controls identified by EPA ;j at City Ordinance No. _, Article V, Chapter 7, Section 7-743. Upon reinspection within, '� seven (7) working days, should no measures have been ,, � taken to correct such noncompliance, a Notice of Violation Letter will be issued and hand delivered or sent by mail with a return receipt requested, to the n ':j party or parties involved in the alleged violation. Thirty (30) days or other reasonable time, will be � � given the party or parties involved, to respond to compliance under the Notice of Violation Letter issued . by the Aspen/Pitkin Environmental Health Department. If an imminent health hazard exi.sts, an immediate remedy will supercede the Notice of Violation Letter. (2) After thirty (30) days has expired, if compliance has not been achieved, the alleged violation will be ,��'p:� referred to the City Attorney for possible legal action. If the City Attorney determines that no action shall be taken, he shall so inform the inspector Who �' made the refezral. , -:;; :_:,';� •::`.� (3) Any action.•concerning a verbal warninq or a Notice of Violation Letter, may be terminated upon the inspectors conclusion that the noncompliance has been corrected. That ROD was ' subsequently modified by two Explanations of Significant Difference (ESDs) issued in March 1989 and May 1990.
