TO DENY Tf�: PETITION OF G.M. WILKINSON
TO CLOSE SMUGGLER MOUN'PAIN ROAD AND �:
TO RETAIN SM[TGGLER MOUNTAIN ROAD AS OPEN TO THE PUBLIC ..,
Resolution No. 91 - 42
WHEREAS, G.M. Wilkinson has petitioned the Board of County 3 •
Commissioners to close Smuggler Mountain Road, also known as �
County Road No. 21, which runs from Park Circle to Warren Lakes,
pursuant to C.R.S. Section 43-2-201(4); and

- WHF.RF.AC� proper notices of the petition have been posted on : .
the road for over eighteen months; and
.^1'� WHEREAS, a public hearing on the petition has been duly
,.?;:,� noticed and published in accordance with state statute and the
home rule charter of Pitkin County; and

�`:,^�', W�REAS, a public hearing was held on February 26, 1991; and
�;;:�._
WHEREAS, the Board has received several written objections
to any closure of the road from citizens of Pitkin County; and
i• WI�REAS, the Board heard the recommendation of the County
.''7! Engineer that the County retain public use of the road; and
` WHEREAS, the Board has determined that the road is in fact a
� `'s'°.� public road which is actively used by citizens of Pitkin County.

"`; NOW, T�EFORB BE IT RESOLVED, that the Board of County
F` ' Commissioners does hereby deny the petition of G.M. Wilkinson for
, closure of the Smuggler Mountain Road and does retain the
a:�>� Smuggler Road as a County road open for public use.
